TEMPORARY CONSTRUCTION EASEMENT
GEORGIA,RICHMOND COUNTY
THIS CONVEYANCE made and executed the ,, (l uay of rY1 ,201

WHEREAS,the City of Augusta,Georgia,desires to construct a road project known as
Berckmans Road Widening and Realignment,Phase I1,from Wheeler Road to Wicklow Drive,P.I.No.
0011381.
NOW,THEREFORE, for value received I/we, Jeffrey C. DeLaney, do hereby grant to the City of
Augusta the right to execute certain construction over and upon my/our land abutting on and adjacent to the
right of way in such manner as the City of Augusta may deem proper to support or accommodate the
improvement of said road,including the right to slope the adjacent ground to tie in with roadway or sidewalk
elevations, and to construct any required slopes and facilities within the easement area(s) shown colored
green on the attached plat dated the 4th day of August 2014,and last revised October 14,2014. Slopes will
remain in place,and the City of Augusta will cease to maintain slopes upon completion and final acceptance
of the project by the City of Augusta.
THE FOLLOWING PARAGRAPH(IS)(IS NOT)APPLICABLE TO THIS TRANSACTION.
Grantor,in addition to the above,hereby expressly grants to the City of Augusta,its successors and
assigns, the right to demolish and remove in their entirety all buildings, walls, fences, gates, signs or any
other improvements or structures of any nature or description, lying wholly or partially situated within the
easement area(s),and the right to enter upon the adjacent lands not included in said required easement(s)for
the purpose of removing or demolishing such improvements.
This easement becomes effective at the beginning of construction of the above numbered project
and will expire upon completion and final acceptance of said project by the City of Augusta.
For the same consideration I/we hereby convey and relinquish to the City of Augusta all rights of
access between the proposed highway and approaches thereto on the above numbered highway project and
my remaining real property from which said construction easement is taken as shown on the attached plat
preparedby the Cit of Augusta.

This Agreement is to be construed as a Covenant not to sue as well as a full accord and satisfaction
of any and all claims as set out above,and the conveyance hereunder of all claims or rights shall be deemed
to be in perpetuity.
I/we hereby warrant that I/we have the right to sell and convey said land and bind
myself/ourselves,my/our heirs,executors,and administrators forever to defend by virtue of these presents.
