Cooper, Esq. 535 Telfair Street, Building 3000 Augusta,GA 30901-2386 STATE OF GEORGIA RICHMOND COUNTY ABANDONMENT OF AN EXISTING EASEMENT (Parcel Identification Numbers 135-0-005-00-0 and 146-0-005-00-0) THIS INDENTURE, made and entered into this 6&- day of /MY _ 2017 , between Huntsman Pigments Americas LLC, a Delaware limited liability company, hereinafter referred to as HUNTSMAN and Augusta, Georgia, a political subdivision of the State of Georgia, hereinafter referred to as AUGUSTA; WITNESSETH: WHEREAS, AUGUSTA does own a certain easement, force main, pipelires and appurtenances, hereinafter referred to as the FORCE MAIN, on the above referenced parcels of land, by Easement Deed of HUNTSMAN, dated February 17, 2015, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Record Book 1475, Pages 0549-0554; and WHEREAS, HUNTSMAN is desirous that the said FORCE MAIN be private in nature and requests that AUGUSTA abandon same to HUNTSMAN; and • WHEREAS, AUGUSTA has agreed to such abandonment; Page 1 of 4 ' . . ' NOW THEREFORE: AUGUSTA, its successors, assigns and legal representatives, does hereby abandon, in its entirety, the FORCE MAIN reflected in the said Easement Deed dated February 17, 2015, to which reference is hereby made for a more accurate and complete description of the metes, bounds and courses ; and AUGUSTA, its successors, assigns and legal representatives, does hereby grant and convey any and all rights and privileges it has in and to said FORCE MAIN, to HUNTSMAN, said grant and conveyance being made "AS IS" ; and HUNTSMAN, its successors, assigns and legal representatives, does hereby agree to hold AUGUSTA harmless and that AUGUSTA will no longer have any responsibility, or liability, for the FORCE MAIN, or any issue that may have arisen prior to this abandonment, or that may arise in the future concerning this FORCE MAIN.
