WARRANTY DEED WITH EASEMENTS

THIS INDENTURE made and entered into this` ."day of 2018, between
Christopher M. Mack, hereinafter referred to as GRANTOR, and Aug sta, Georgia, a political
subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that GRANTOR, for and in consideration of the sum of ONE DOLLAR
($1.00) in hand and truly paid by AUGUSTA at and before the sealing and delivery of these
presents, and other valuable consideration, the receipt whereof is hereby acknowledged, has
granted, bargained, sold, conveyed and confirmed, and by these presents does grant, bargain,
sell, convey and confirm unto AUGUSTA, its successors and assigns the following lot, or parcel
of land:
ALL THAT LOT, or parcel, of land, in fee simple, consisting of 1,246 Square Feet
(0.03 ac), lying in Augusta, Georgia, and which is a portion of the property known
under the Property Identification Number of 111-0-024-00-0 and the local
address of 1731 Lumpkin Road, said lot, or parcel, of land being described
follows: Beginning at a point on the Northern right-of-way of Lumpkin Road, at
the conjunction of the Western boundary line of aforementioned 1731 Lumpkin
Road and the Northern right-of-way of Lumpkin Road and traveling in an Easterly
line along the Northern right-of-way of Lumpkin Road for an approximate
distance of 95 feet to the point of beginning; thence traveling in a line along said
right-of-way S80°56'47"W for a distance of 15.30 feet to a point; thence traveling
along said right-of-way S82°04'11"E for a distance of 14.54 feet to a point;
thence turning and traveling N2°30'56"W for a distance of 43.05 feet to a point;
thence turning and traveling N87°29'04"W for a distance of 30 feet to a point;
then turning and traveling S2°30'56"W for a distance of 39.90 feet back to the
beginning. Said lot, or parcel, of land being that marked as "Lift Station Site #3",
as shown on Sheet #12 and Sheet #13 of a plat prepared by W.R. Toole
Engineers, Inc., dated May 9, 2017, revised May 30, 2017, November 9, 2017,
and December 14, 2017, attached hereto as Exhibit A-1 and A-2 and made a
part hereof, and to which reference is made for a more accurate and complete
description of the metes, bounds and courses.
ALSO, a strip of land consisting of 1,586 Square Feet, more or less, of
Temporary Construction Easement, as shown on said plat. Said temporary
construction easement is marked as "Temporary Construction Easement" and
RECO D BOOK 1 62 9 P .. 7!."
granted together with the right to dig such trenches in said parcel of land as may
be necessary for this pipeline, to pile thereon the material excavated, and to haul
pipe, supplies and equipment connected with the construction and maintenance
thereof, over, along and across the said parcel of land. Said temporary
construction easement shall expire at the completion and final acceptance of this
pipeline by AUGUSTA.
ALSO, an exclusive utility, access and maintenance easement, in perpetuity
under, across and through the property known under the Property Identification
Number of 111-0-024-00-0 and the local address of 1731 Lumpkin Road,
consisting of 2,130 Square Feet, more or less, and shown on the aforementioned
plat referenced hereinafter described parcel of land. Said permananet easement
consists of 2,130 Square Feet, more or less, is marked a "New Permanent
Sanitary Sewer Easement", on the above referenced plat, which is attached
hereto and made a part hereof, and to which reference is made for a more
accurate and complete description of the metes, bounds and courses, and being
for the purpose of accessing, laying, adding, expanding, relaying, installing,
extending, operating, repairing and maintaining pipelines transporting and
carrying AUGUSTA's utility services.
GRANTOR does also grant, bargain, sell and convey unto AUGUSTA, its successors
and assigns, the right, but not the duty, to clear and to keep clear, all trees, undergrowth and
other obstructions from said permanent easement, along with the free right of ingress and
egress to and from said permanent easement for this purpose and all other purposes stated
herein.
GRANTOR further grants unto AUGUSTA the right to stretch communication lines, or
other lines, within the easements, for the use of AUGUSTA, its successors, assigns, legal
representatives, agents, and designees, upon or under said land, within said easements, with
the necessary cables, wires, apparatus, fixtures and appliances; and with the right to assign
said easements in whole or in part.
GRANTORR, his heirs, successors and assigns, after the completion of this Project,
shall have the right to use said parcel of land in any manner not inconsistent or interfering with
the rights herein granted, excluding, however, 1. the right to plant thereon any trees or other
vegetation that may interfere with the accessing, expanding, adding, laying, relaying, installing,
extending, operating, repairing and maintaining of pipelines transporting and carrying utility
services; and 2. the right to erect, construct or maintain thereon any buildings, structures, or
other permanent improvements, within the boundaries of said permanent easement.
TO HAVE AND TO HOLD the aforesaid rights, ways, easements, privileges and
appurtenances unto AUGUSTA, its successors and assigns, in perpetuity.

And GRANTOR, his, heirs, successors and assigns shall and will forever warrant and
defend unto AUGUSTA, its successors and assigns, the rights, ways, easements privileges and
appurtenances conveyed herein, against the claim of any person or persons whomsoever.

OPTION FOR EASEMENT
PROJECT: Rocky Creek Sanitary Sewer Force Main
Augusta Utilities Department
PARCEL IDENTIFICATION NUMBER: 111-0-024-00-0 ADDRESS: 1731 Lumpkin Road
THIS INDENTURE made and entered into this Pi- of l//// 2018, between
Christopher M.Mack,hereinafter referred to as OWNER,and Augusta,Georgia,a litical subdivision
under the laws of Georgia, hereinafter referred to as AUGUSTA;
WITNESSETH, that Owner, for and in consideration of ONE DOLLAR ($1.00), the receipt
whereof is hereby acknowledged, and in consideration of the benefits derived by said Owner from the
proposed Project mentioned herein,Owner agrees to be bound,and to bind their representatives,assigns
and heirs as follows:
If Augusta shall,within one hundred and twenty(120)days from the date first written above, pay
the sum of$1500.00 the Owner agrees to execute and deliver to Augusta easements to the hereinafter
described parcel of land.
Said easement consists of 2,130 Square Feet, more or less, of permanent utility and
maintenance easement and 1,586 Square Feet, more or less, of temporary construction easement, as
shown on a plat,of two pages, prepared by W.R.Toole Engineers, Inc.,dated May 9,2017, revised May
30, 2017, November 9, 2017 and December 14, 2017, labeled "Sheet#12" and "Sheet#13", attached
hereto and made a part hereof,to which reference is made for a more accurate and complete description
of the metes, bounds and courses, and being for the purpose of laying, relaying, installing, extending,
operating,repairing and maintaining pipelines transporting and carrying utility services.
ALSO,a tract of land in fee simple,consisting of 1,246 square feet(0.03 acres),as shown on the
aforementioned"Sheet 12"as"Lift Station Site#3.
And no agreement that would adversely affect these rights has been, or will be, made within the
option period.
CONTRACTOR WILL RESET EXISTING BARBED WIRE FENCE ALONG LUMPKIN ROAD.
