HomeMy WebLinkAboutSECOND AMENDMENT TO AGREEMENT BETWEEN AUGUSTA, GEORGIA AND LANEY WALKER DEVELOPMENT CORPORATION FOR 2016 HOME INVESTMENT PARTNERSHIP PROGRAM_ 802 PERRY COURT SECOND AMENDMENT TO AGREEMENT BETWEEN AUGUSTA, GEORGIA LANEY WALKER DEVELOPMENT CORPORATION FOR 2016 HOME INVESTMENT PARTNERSHIPS PROGRAM This Second Amendment to the agreement executed by and between the Parties on November 5, 2017, is made and entered into on the day of 2017,by and between AUGUSTA, GEORGIA, (hereafter referred to as "Augusta"), and LANEY WALKER DEVELOPMENT CORPORATION. (hereinafter referred to as the "LWDC"). WHEREAS, AUGUSTA desires to amend the original agreement to allow Laney Walker Development Corporation to effectively administer its HOME eligible affordable housing development activities; WHEREAS, Laney Walker Development Corporation has determined that this Amendment is in its best interest and has agreed to the said Amendment; NOW THEREFORE, in exchange for their mutual good and valuable consideration,the receipt and sufficiency of which each PARTY acknowledges, and intending to be legally bound, AUGUSTA and LWDC agree to amend said agreement as follows: (1) Article II Section D. Project Budget: Limitations. HCD will provide LWDC with an additional $7,973.23 in the form of a loan to complete the construction of the unit. Additional funding will be paid back to HCD at closing along with original loan repayment of$35,155.04. Total amount of loan repayment at closing shall be $43,128.27. B. Use of Funds HOME Program funds shall be used by LWDC for the purposes and objectives stated in Article I, Scope of Services, and Exhibit"A" of the original Agreement. There will be no change in the use of funds as it will remain as original agreement. Only change as outlined in project budget. Except for the modifications made by this Amendment, the terms and conditions of the Agreement, as previously amended, shall remain in full force and effect.
