RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS
BY FIREFIGHTERS IN THE MATTER OF FRANKLIN STUART, ET AL
V. AUGUSTA-RICHMOND COUNTY; AUTHORIZING THE MAYOR TO
EXECUTE SETTLEMENT DOCUMENTS AND THE FINANCE
DEPARTMENT TO DISBURSE THE SETTLEMENT AMOUNT;
WAIVING AUGUSTA, GEORGIA CODE OF ORDINANCES SECTIONS
IN CONFLICT FOR THIS INSTANCE ONLY; AND FOR OTHER
PURPOSES.
WHEREAS, Frank Stuart, Jason Adams, Michael Barnes, Douglas Bell, George Brewer
Jr., Ian Buckley, Brian Cameron, James Campbell, Trey Cashwell, Jose Colon, Dustin Colson,
Nicholas Costello, Michael Dooley, John Dowdy Jr., Steven Fowler, Otis Germany, Darian
Gilchrist, Ryan Goodson, Brian Goodwin, Aaron Groenenboom, Mary Guest, Jonathan
Guilfoyle, Robert Holliday, Willie Ivey, Jermaine Jennings, Daniel Johnson, Larry Johnson, Paul
Johnson, Sean Johnson, Jasper Jones Jr., Joshua Kitchens, Christopher Lavarias, Walter
Lavarias, James Leisey, James Lord, Evan Luda, Harry Maeky, Willie Mathis, Ian Matijczuk,
James May, Zachary McCormick, Cody Mercer, Anthony Moody, Ralph Mosley, Shaun Nale,
Janssen Pollard, Douglas Pullen, Kenneth Richardson, Daniel Rigdon, Perry Riley, Steven
Schultz, Michael Steele Jr., Thomas Stokes Jr., David Stroman, James Thompson, Michael
Tomaszewski, Marty Walker, Linda Warrick, Kevin Washington, Steve Weddle, Keith White,
Franklin Williams Jr., Russell Williams, Wayne Wingrove, William Womack, and Justin
Yeager, ("Claimants") have made claims against Augusta, Georgia arising out of their
employment with Augusta, Georgia;
WHEREAS, all parties to said claim desire to settle all claims; and
WHEREAS, Claimants have agreed to settle all claims against Augusta, Georgia for the
sum of twenty-eight thousand seven hundred fifty-nine dollars and seventy-nine cents
($28,759.79);
WHEREAS, it is in the best interests of Augusta, Georgia to resolve this matter and pay
the amount of twenty-eight thousand seven hundred fifty-nine dollars and seventy-nine cents
($28,759.79) to Claimants to settle all claims of Claimants against Augusta, Georgia arising out
of their employment with Augusta, Georgia; and
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia and liability is expressly
denied.
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission,
Section 1: The Augusta, Georgia Commission will settle the claims of Claimants for
the aggregate amount of twenty-eight thousand seven hundred fifty-nine
dollars and seventy-nine cents ($28,759.79).

Section 2: The Mayor is authorized to execute the Settlement Agreement as approved
by General Counsel.
Section 3: The Finance Department of Augusta, Georgia is authori:. ed to pay the total
settlement amount in accordance with the settlement agreement from
account 101-10-1110/6011110.
Section 4: To the extent that any section of the AUGUSTA, GA. CODE is in conflict
herewith, that subsection is waived for this instance only.

The undersigned Clerk of Commission, Lena Bonner, hereby certifies that the foregoing
Resolution was duly adopted by the Augusta, Georgia Commission on ,
2018 and that such Resolution has not been modified or rescinded as of the date hereof and the
