RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS
BY JANICE HARDY; AUTHORIZING THE MAYOR TO EXECUTE
SETTLEMENT DOCUMENTS AND THE FINANCE DEPARTMENT TO
DISBURSE THE SETTLEMENT AMOUNT; WAIVING AUGUSTA,
GEORGIA CODE OF ORDINANCES SECTIONS IN CONFLICT FOR
THIS INSTANCE ONLY; AND FOR OTHER PURPOSES.
WHEREAS, Janice Hardy ("Claimant") has made a claim against the State Court of
Richmond County and Augusta, Georgia arising out of her separation from employment with the
State Court of Richmond County;
WHEREAS, all parties to said claim desire to settle all claims; and
WHEREAS, Claimant has agreed to settle all claims against the State Court of Richmond
County and Augusta, Georgia for the sum of forty thousand dollars ($40,000.00);
WHEREAS, it is in the best interests of Augusta, Georgia to resolve this matter and pay
the amount of forty thousand dollars ($40,000.00) to Claimant to settle all claims of Claimant
against State Court of Richmond County and Augusta, Georgia; and
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia or the State Court of
Richmond County and liability is expressly denied.
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission,
Section 1: The Augusta, Georgia Commission will settle the claims of Janice Hardy
for the aggregate amount of forty thousand dollars ($40,000.00).
Section 2: The Mayor is authorized to execute the Settlement Agreement as approved
by General Counsel.
Section 3: The Finance Department of Augusta, Georgia is authorized to pay the total
settlement amount in accordance with the settlement agreement from
account 101-10-1110/6011110.
Section 4: To the extent that any section of the AUGUSTA, GA. CODE is in conflict
herewith, that subsection is waived for this instance only.
