HomeMy WebLinkAboutORD 7619 CHANGE OF ZONING FROM ZONE R-1A , ZONE B-1 AND B-2 TO ZONE B-2 AFFECTING PROPERTY LOCATED AT THE SOUTHEAST INTERSECTION OF THE RIGHT-OF-WAY OF BARTON CHAPEL ROAD AND THE RIGHT-OF-WAY OF GORDON HIGHWAY ORDINANCE NO.1 La I An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone R-1A(Multiple-family Residential),Zone B-1 (Neighborhood Business)and B- 2(General Business)to Zone B-2(General Business)affecting property located at the southeast intersection of the right-of-way of Barton Chapel Road and the right-of-way of Gordon Highway; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-1A (Multiple-family Residential), Zone B-1 (Neighborhood Business) and B-2 (General Business) to Zone B-2 (General Business)as follows: Beginning at a point located at the southeast intersection of the right-of-way of Barton Chapel Road and the right-of-way of Gordon Highway, being the point of beginning; thence in a northeasterly direction along the southern right-of-way of Gordon Highway a distance of 220 feet, more or less,to a point; thence leaving the right-of-way of Gordon Highway in a southeasterly direction a distance of 500 feet, more or less to a point; thence in a southwesterly direction a distance of 730 feet, more or less to a point, being on the northern right-of-way of Milledgeville Road; thence along the northern right-of-way of Milledgeville Road in a northwesterly direction a distance of 590 feet to a point; thence along the northern right-of-way line of Milledgeville Road a distance of 55 feet, more or less, to a point, being on Z-18-29 the northeast intersection of the right-of-way of Milledgeville Road and the right- of-way of Barton Chapel Road; thence along the eastern right-of-way of Barton Chapel Road in a northeasterly direction a distance of 765 feet more or less to a point; thence along the eastern right-of-way of Barton Chapel Road in a northeasterly direction a distance of 65 feet more or less to a point located at the southeast intersection of the right-of-way of Barton Chapel Road and the right-of- way of Gordon Highway, being the point of beginning. The property contains approximately 12.7 acres and is known as 2190 Gordon Highway, Tax Map 068-0- 019-00-0; 2192 Gordon Highway, Tax Map 068-0-018-01-0; SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: 1. The following uses ordinarily permissible in the B-2 zoning district shall be prohibited: (8) flea markets,(10)travel trailer parks,(14)gun shops,(15)pawn shops,(16)funeral homes, (19) liquor stores, and (22) crematoriums. 2. Issuance of development permits shall be contingent upon submission and approval of plans meeting all applicable development standards. 3. There shall be sidewalks adjacent to all public ROW, with the exception of Gordon Highway,and pedestrian facilities to facilitate safe movement of foot traffic throughout the site. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
