HomeMy WebLinkAboutORD 7614 CHANGE OF ZONING FROM ZONE R-1C TO ZONE B-1 AFFECTING PROPERTY LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF CONKLIN AVENUE AND SWANS LANE ORDINANCE NO.1 Lo i4 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone R-1C (One-family Residential) to Zone B-1 (Neighborhood Business) affecting property located on the northeast corner of the intersection of Conklin Avenue and Swans Lane,being the point of beginning; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-1 C(One- family Residential)to Zone B-1 (Neighborhood Business) as follows: Beginning at a point located on the northeast corner of the intersection of Conklin Avenue and Swans Lane, being the point of beginning; thence, in a southeasterly direction along the southeastern right-of-way of Conklin Avenue a distance of 75.0 feet to a point; thence, in a northeasterly direction a distance of 50.0 feet to a point; thence, in a northwesterly direction a distance of 75.0 feet to a point; thence, in a southwesterly direction along the eastern right-of-way line of Swans Lane a distance of 50.0 feet to the point of beginning. The property contains 0.09 acres and is known as 1301 Conklin Avenue. Tax Map 059-1-305-00-0 Z-18-24 SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: 1. The applicant shall establish and maintain a shared parking agreement to ensure that the intended use meets the minimum off-street parking requirement as expressed in the Ordinance. 2. The applicant shall operate the establishment from 11:00 a.m. to 11:00 p.m. Monday through Saturday. 3. The applicant shall not be permitted to seek an alcohol license or serve alcoholic beverages. 4. The applicant shall maintain a 6-foot privacy fence or wall separation from the adjacent residential properties. 5. If the use ceases to exist the zoning reverts to the current R-1C(One-family Residential)zoning. SECTION III.
