HomeMy WebLinkAboutLEASE RENEWAL AGREEMENT BETWEEN AUGUSTA, GEORGIA AND CHARLES THOMPSON & THOMPSON FARMS FOR THE BIG FARM PROPERTY State of Georgia LEASE RENEWAL AGREEMENT This Lease Renewal Agreement is made as of this &.'11 day of /2/-/ d./71, 2018, by and Augusta, Georgia, a political subdivision of the State of Georgia, by and through its Augusta Utilities Department, hereinafter referred to as"Landlord" and Charles Thompson and Thompson Farms, hereinafter referred to as"Tenant". WHEREAS, Landlord and Tenant entered into a Lease Agreement dated April 17, 2012, for the rent and use of a 29 acre property located off Doug Barnard Parkway, said property being a portion of a tract of land known as the"Big Farm"; and WHEREAS, the Lease Agreement will expire on December 31, 2018; and WHEREAS, Landlord and Tenant now wish to extend the term of the Lease Agreement pursuant to Section 3 of the Lease Agreement. NOW THEREFORE, in consideration of the premises and mutual covenants contained herein and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows: 1. The term of the Lease Agreement is hereby extended from January 1, 2019 to 12:00 midnight on December 31, 2023. 2. The rent for the new term shall remain unchanged. 3. The address, for the Landlord, is changed to: Augusta Utilities Department Attn: Finance Director 452 Walker St., Suite 200 Augusta, GA 30901 4. Except as expressly stated herein, the terms of this Renewal shall be effective as of the first date of the Extension Term. 5. Capitalized terms used herein but not otherwise defined shall have the meaning ascribed to them in the Lease Agreement. 6. Except as expressly modified herein, the Lease Agreement remains unchanged and in full force and effect. 8. This Renewal may be executed in one or more counterparts, each of which shall be deemed an original and all of which together, shall constitute one and the same document. 9. The terms of this Renewal shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflicts of law provisions.
