An ordinance 10 amend the Comprehensive Zoning Ordinance adopted by the
Augusta. Georgia Commission effective September 16, 1997 (Ordinance No. 51601
together with all amendments which have been approved by either the Augusta
Commission as authorized under the home Rule Provisions of the Comprehensive
Zoning Map from Constitution of the State of Georgia" by changing the zoning from
Zone A (Agriculture)to Zone 111 (1 Leavy lndustry)affecting property located:. and for
the repeal of ordinances in conflict herewith and for other puposes:
THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS:
SECTION L "Khat the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of
Richmond County on the 15th day of November. 1983, the caption of which is set out above, is
amended by changing the Comprehensive Zoning Map by changing the zoning from Zone A
(Agriculture) to Zone Hi (Heavy Industry)as follows:
Beginning at a point on the southeastern right-of-way intersection of Dean Bridge Road and
Birdwell Road; thence in a southwesterly direction along the eastern right-of-way line of Deans
Bridge Road a distance of 2,250 feet, more or less, to a point, being the point of beginning; thence
in southeasterly direction a distance of 1,143 feet,more or less,to a point; thence in a southwesterly
direction a distance of 1,337 feet, more or less, to a point; thence in a northwesterly direction a
distance of 1,1 25 feet,more or less, to a point, located on the eastern right-of-way of Deans Bridge
Road; thence in a northeasterly direction along the eastern right-of-way of Deans Bridge Road a
distance of 1234 feet,more or less to a point; thence in a southeasterly direction along the eastern
right-of-way line of Deans Bridge Road a distance of 15 feet, more or less, to a point, being the
point of beginning. The subject property contains a total of approximately 32.3 acres and is more
formally known as 4338, 4340,4344,4348,4352,4350,4358,4362 and 4364 Deans Bridge Road.
All that lot, tract or parcel of land, with any improvements thereon, situate, lying and being in
Richmond County. Georgia, being shown and designated as TPNs 176-0-005-00-0, 176-0-006-00-
0, 176-0-007-00-0, 176-0-008-02-0, 176-0-008-00-0, 176-0-008-01-0, 176-0-009-00-0. 176-0-
010-00-0 and 176-0-010-01-0 in Augusta ( 1S.

SFC1 ION 11. This amendment to the Comprehensive Zoning Maps for ugusta,Georgia is
subject to the stipulations:
1. A 600-foot buffer shall be undisturbed except for maintenance and activities permitted
under the Georgia Rules for Solid Waste Management.
SECTION 111. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby
repealed.

THIS COVENANT, made this l6"' day of January in the year of our lord Two Thousand and
Eighteen. between Augusta Environmental Service,on behalf of the City of Augusta of the State of
Georgia_ County of Richmond, hereinafter referred to as "Property Owners)", and AUGUSTA,
GEORGIA, a Political Subdivision under the laws of the State of Georgia,hereinafter referred to as
'Augusta_ Georgia'.
WITNESSETH:
That the said Property Owner(s), for and in consideration of the Commission of Augusta, Georgia
approving rezoning requested by the Property Owner(s) and the benefits flowing to each of the
undersigned. the undersigned, by execution of the Zoning Restriciion Agreement. attached hereto as
Exhibit "A". agree to and acknowledge the zoning terms and conditions stated in said Agreement as
they apply to the described property set forth in Exhibit "A",and agree that the attached zoning terms
and conditions shall run with said property as long as the requested zoning classification is effective.
The Planning Commission agrees to record this instrument in the Office of the Clerk of the Superior
Court for Augusta, Georgia,and to hear all costs for the recording of same.
