HomeMy WebLinkAboutORD 7598 AMENDING ORDINANCE 7597 CHANGE OF ZONING FROM ZONE R-2 AND ZONE R-1E TO ZONE B-2 AFFECTING PROPERTY LCOATED AT A POINT ON THE NORTHWEST INTERSECTION OF MARSCHALK ROAD AND KISSINGBOWER ROAD- WITH CONDITIONS ORDINANCE NO. 15q An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by amending Ordinance #7597 changing zoning from Zone R-2 (Two-family Residential) and Zone R-1E (One-family Residential)to Zone B-2(General Business)affecting property located at a point on the northwest intersection of Marschalk Road and Kissingbower Road, thence in a northeasterly direction a distance of 163 feet, more or less,to a point, on the western right-of-way of Kissingbower Road; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by amending Ordinance#7597 changing the zoning from Zone R-2 (Two-family Residential) and Zone R-1E (One-family Residential) to Zone B-2 (General Business)as follows: Beginning at a point on the northwest intersection of Marschalk Road and Kissingbower Road, thence in a northeasterly direction a distance of 163 feet, more or less, to a point, on the western right-of-way of Kissingbower Road,being the point of beginning;thence N 58 degrees 05 minutes 51 seconds W, a distance of 380.53 feet to a point; thence N 35 degrees 05 minutes 41 seconds E, a distance of 429.08 feet to a point; thence N 85 degrees 08 minutes 00 seconds E, a distance of 142.17 feet to a point; thence S 33 degrees 56 minutes 04 seconds W, a distance of 162.97 feet to a point; thence S 58 degrees 09 minutes 31 seconds E, a distance of 268.09 feet to a point located on the western right-of-way of Kissingbower Road; thence along the western right-of-way of Z-18-07 Kissingbower Road S 35 degrees 05 minutes 41 seconds W, a distance of 120.05 feet to a point; thence N 56 degrees 41 minutes 22 seconds W, a distance of 209.29 feet to a point; thence S 31 degrees 52 minutes 31 seconds W, a distance of 105.04 feet to a point; thence S 58 degrees 05 minutes 51 seconds E, a distance of 203.60 feet to a point located on the western right-of-way of Kissingbower Road; thence along the western right-of-way of Kissingbower Road S 35 degrees 05 minutes 41 seconds W, a distance of 131.38 feet to a point,being the point of beginning. The subject property contains a total of approximately 2.9 acres and is more formally known as 1813 Kissingbower Road and a portion of 1815 Kissingbower Road. All that lot,tract or parcel of land, with any improvements thereon, situate, lying and being in Richmond County, Georgia, being shown and designated as TPN 057-3-137-02-0 on property of N/F Carol H Hiers and a portion of TPN 057-3-139-01-0 on property N/F David Harden found on a Rezoning Plat by Ayercorp dated December 14, 2017. Reference is hereby made to said zoning plat and it is incorporated herein and made a part hereof for a more complete and accurate description of the metes, bounds and location of said property. SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: 1. The only approved use of the property shall be a plant nursery. Any change of use will require reevaluation by the Planning Commission. 2. The site must substantially conform to the concept plan submitted with this application dated 12-14-2017 3. Issuance of development permits shall be contingent upon submission of plans meeting engineering, environmental, and all other pertinent development regulations. 4. If development does not commence within 24 months or if the use ceases to exist for a 6 month period the B-2 zoning shall revert to the current R-2 and R-1E zoning. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this O ay of 1TbLa1,2018.
