MORE OR LESS, EAST OF THE INTERSECTION OF GORDON HIGHWAY AND CHAMBERLAIN AVENUE ORDINANCE NO. 1 59 L An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia"by changing the zoning from Zone R-MH (Manufactured Home Residential) to Zone R-1E (One-family Residential)affecting property located 3,473 ft., more or less, east of the intersection of Gordon Highway and Chamberlain Avenue begin the point of beginning; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-MH (Manufactured Home Residential)to Zone R-1E(One-family Residential)as follows: All that lot,tract or parcel of land, with any improvements thereon, situate, lying and being in Richmond County, Georgia, being shown and designated as "Parcel A"on a plat by Cranston, Robertson&Whitehurst, P.C. dated November 3, 2000, a copy of which is recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Book 706, at Page 797. Reference is hereby made to said plat and it is incorporated herein and made a part hereof for a more complete and accurate description of the metes,bounds and location of said property. Beginning at a point located 3,473 ft., more or less, east of the intersection of Gordon Highway and Chamberlain Avenue begin the point of beginning: LESS AND EXCEPT, all that lot,tract or parcel of land,with any improvements thereon, situate, lying and being in Richmond County, Georgia,being shown and designated as Lots 1-16, Block "A", Lots 1-7, Block"B", Lots 1-12 and 31-35, Block"C", Lots 1-5, 14 and 15, Block"D", "Common Area(Private) 307.999 sq.ft. 7.07 acres", on a plat entitled"A Plat of Belair Lakes Z-18-09 Section 1"prepared by James G. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: Z-18-09 . 1 " 1. The concept plan reviewed is considered for illustrative purposes of the present zoning action only, and does not meet development plan submission criteria. 2. A development plan meeting all applicable state and local codes and ordinances must be submitted and approved prior to permit issuance. The development plan shall not exceed the 131 lots or 3.32 unit/acre density proposed on conceptual plan revision#4,updated December 11, 2017. 3. No public roads shall be closed without a request from the property owner, review by the Augusta Engineering,Fire,and Planning and Development Departments,and approval of the Augusta Commission by way of resolution. The review of the concept plan is not considered a request for public road or right of way abandonment. j 4. A means of ingress and egress shall be maintained to the parcels presently addressed as 2547 B and 2551 Waterfront Drive. This access point shall be indicated on the development plan. 5. The second entrance, as required by Article IV, Section 400(K) of the Land Subdivision Regulations,must be constructed with the first phase of the subdivision. 6. Acceleration and deceleration lanes meeting the specifications of Augusta Traffic Engineering and the Georgia Department of Transportation shall be required at all access points on Gordon Highway. 7. All required buffers shall be undisturbed. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
