WHEREAS,the DEPARTMENT and the SPONSOR heretofore on September 21,2016 entered into an AGREEMENT, hereinafter called the Original Contract, for the purpose of Augusta Entryway & Corridor Master Design,hereinafter referred to as the"PROJECT;"and WHEREAS, the parties wish to amend said Original Contract to extend the Time for Performance of Work on the PROJECT. NOW, THEREFORE, THE PARTIES HERETO mutually agree that for and in consideration of the mutual benefits to flow from each to the other,the Original Contract, dated September 21,2016 is hereby modified as follows: By deleting ARTICLE II, TIME OF PERFORMANCE in its entirety and the following substituted in lieu thereof: ARTICLE II TIME OF PERFORMANCE TIME IS OF THE ESSENCE IN THIS AGREEMENT. The SPONSOR shall perform its responsibilities for the PROJECT, commencing on receipt of written "Notice to Proceed" from the DEPARTMENT, and shall complete the PROJECT no later than December 31, 2018. No work on any phase shall begin without a written Notice to Proceed from the DEPARTMENT. The DEPARTMENT's Notice to Proceed with Construction must be issued within 210 days from the execution date of this contract and the SPONSOR must submit an invoice for reimbursement within 270 days of the execution date of this contract or the contract is terminated without further notice and the funds will be de- obligated. The work shall be carried on expeditiously, it being understood, however, that this Agreement may be extended or continued in force by mutual consent of the parties and evidenced by a written amendment hereto. Except as modified, changed, or amended, all terms and conditions of the Original Contract dated September 21,2016, shall remain in full force and effect. The covenants herein contained shall, except as otherwise provided, accrue to the benefit of and be binding upon the successors and assigns of the parties hereto.
