TEMPORARY CONSTRUCTION EASEMENT
AUGUSTA, GEORGIA PROJECT:Berckmans Road Widening
and Realignment, Phase II
WITNESSETH: that Charlotte R. Price, the undersigned, (hereinafter referred to as
"Grantor"), is the owner of a tract of land in RICHMOND COUNTY
through which Berckmans Road
Widening and Realignment Project, Phase II, P.I. No.0011413 has been laid out by Pond Architects,
Engineers, Planners, being more particularly described in a map and drawing of said project in the
Augusta Engineering Office,to which reference is hereby made.
NOW, THEREFORE, in consideration to the benefit to my property, I/we, the undersigned, de
hereby grant to the City of Augusta the right to execute certain construction over and upon my land
abutting on and adjacent to the right of way in such manner as said City of Augusta may deem proper to
support or accommodate the improvement of said road, including the right to slope the adjacent ground to
tie in with roadway or sidewalk elevations, and to construct any required slopes with the easement area(s)
shown colored green on the attached plat dated Jan. 29, 2016. Slopes will remain in place, and the City of
Augusta will cease to maintain slopes upon completion and final acceptance of said project by the City of
Augusta.
Said temporary easement consisting of 0.034 acre (1,485.98 sq. ft). , more or less; as shown on a
plat of the property prepared by Pond Architects, Engineers,Planners, dated Jan. 29, 2016, revised March
25, 2016, attached hereto and made by reference a part hereof for a more accurate and complete
description of the temporary easement.
For the same consideration, I/we hereby convey and relinquish to the City of Augusta all rights of
access between the proposed highway and approaches thereto on the above numbered highway project
and my remaining real property from which said construction easement is taken as shown on the attached
plat prepared by the City of Augusta.
This agreement is to be construed as a Covenant not to sue as well as a full accord and
satisfaction for any and all claims as set out above, and the conveyance hereunder of all claims or rights
shall be deemed to be in perpetuity.
The temporary easement herein granted shall bind the heirs and assigns of the undersigned.
