HomeMy WebLinkAboutORD 7588 CHANGE OF ZONING FROM LIGHT INDUSTRY TO R3B MULTIPLE FAMILY RESIDENTIAL FOR PROPERTY 1923 BARTON CHAPEL ROAD ORDINANCE NO.1 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia"by changing the zoning from Zone LI (Light Industrial) to Zone R-3B (Multiple-Family Residential) affecting property located at the northwest intersection of Gordon Hwy and Barton Chapel Road, being the point of beginning; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone LI(Light Industrial)to Zone R-3B (Multiple-Family Residential) as follows: Beginning at a point located at the northwest intersection of Gordon Hwy and Barton Chapel Road, being the point of beginning; thence, along the right-of-way of the northwest intersection of Gordon Highway and Barton Chapel Road in a southwesterly direction a distance 32 feet, more or less; thence in a northwesterly direction a distance of 1003 feet, more or less to a point; thence, in a northeasterly direction a distance of 380 feet, more or less to a point; thence, in a southeasterly direction a distance of 634 feet,more or less,to a point,located on the estern right-of- way of Barton Chapel Road; thence, in a southwesterly direction along the western right-of-way of Barton Chapel Road, a distance of 722 feet,more or less,to a point at the northwest intersection of Gordon Hwy and Barton Chapel Road, being the point of beginning. This property contains approximately 9.5 acres and is known as 3644 Belair Road. Tax Map 068-0-003-00-0 Z-17-37 SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: 1. This conceptual plan is for the purpose of rezoning the property from LI—Light Industrial to R-3B -Multiple Family Residential and does not take the place of the final development drawings required before construction can begin. 2. The final development drawings cannot have any buildings located in the floodplain and shall meet all applicable requirements of the Comprehensive Zoning Ordinance of the City of Augusta, GA and Richmond County and the Flood Damage Prevention Ordinance. 3. The sole access road to the site will need to be moved to within 200 ft.of the north property line to improve the ingress and egress of residents to Barton Chapel Road. 4. A 175 ft. deceleration lane will be required for ingress from southbound Barton Chapel Road. 5. The new access road and deceleration lane shall require the approval of the Georgia Department of Transportation since Barton Chapel Road is a county road and Gordon Highway is a state road. 6. A sidewalk will be required along Barton Chapel Road featuring a two-foot wide grass strip and a five-foot wide sidewalk meeting ADA standards. 7. An inventory of all trees on the site is required with the final development plan to determine if the proposed project meets the requirements of the Tree Ordinance and to determine the need for a variance. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this nday of O0'0P/,2017.
