DENT BOULEVARD AND LANEY-WALKER BOULEVARD ORDINANCE NO.( 8 Lk An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997(Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia"by changing the zoning from Zone R-1C (One-family Residential) to Zone P-1 (Professional) affecting property located on the northwest right-of-way line of Augusta Avenue,245 feet southwest of R.A. Dent Boulevard and Laney-Walker Boulevard; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA,GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-1C (One-family Residential)to Zone P-1 (Professional) as follows: Beginning at a point located on the northwest right-of-way line of Augusta Avenue, 245 feet southwest of R. A. Dent Boulevard and Laney-Walker Boulevard; thence in a southwesterly direction along the northwest right-of-way line of Augusta Avenue a distance of 56 feet,more or less,to a point;thence, in a northwesterly direction a distance of 180 feet to a point; thence, in a northeasterly direction a distance of 40 feet to a point; thence,in a northwesterly direction a distance of 45 feet to a point located on the southeast right-of-way line of R. A. Dent Boulevard;thence, in a southeasterly direction a distance of 236 feet, more or less, to the point of beginning. Tract B contains two land parcels totaling.27 acres having the present addresses of 1223& 1227 Augusta Avenue.(Tax Map 046-3-253-00-0&046-3-252-00-0)DISTRICT 1 Z-17-32 w , SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta,Georgia is subject to the following stipulations: 1. The lot be fenced to prevent the current use from continuing until such time as all improvements can be executed; 2. The applicant move to start development within the proscribed timeframe of six(6)months or the property reverts to its previous zoning designation of residential use which prevents the use of the property as it currently operates; 3. The applicant provide a detailed engineered site plan that meet all development regulations in place at the time of site review; 4. The site shall not be available for use until such time as all requirements have been met; 5. A business license for the operation of a paid parking lot shall be acquired. 6. Per Section 35-7 of the Comprehensive Zoning Ordinance the Planning Commission may submit information to the Augusta Commission having jurisdiction relative to property which has been rezoned for a period of eighteen (18) months from the date of approval, and for which no site plan or subdivision development plan approval or building permit has been obtained. The Augusta Commission may then review such information and, if considered appropriate,initiate reversionary zoning procedures. Such reversionary actions shall proceed in accordance with the amendment provisions of this Ordinance. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this day of October, 2017.
