HomeMy WebLinkAboutORD 7585 CHANGE OF ZONING FROM ZONE R-1C TO ZONE P-1 AFFECTING PROPERTY LOCATED ON THE NORTHWEST RIGHT OF WAY LINE OF AUGUSTA AVE OPPOSITE WHERE THE CENTERLINE OF MAUGE ST EXTENDED INTERSECTS ORDINANCE NO.1 '&5 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia"by changing the zoning from Zone R-1C (One-family Residential) to Zone P-1 (Professional) affecting property located on the northwest right-of-way line of Augusta Avenue opposite where the centerline of Mauge Street extended intersects; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-1C (One-family Residential)to Zone P-1 (Professional)as follows: Beginning at a point located on the northwest right-of-way line of Augusta Avenue opposite where the centerline of Mauge Street extended intersects; thence, in a northwesterly direction a distance of 360 feet, more or less, to a point located on the southeast right-of-way line of Holley Street; thence, in a northeasterly direction along the southeast right-of-way line of Holley Street a distance of 40 feet to a point located on the southeast right-of-way line of R. A. Dent Boulevard; thence, in a northeasterly direction along the southeastly right-of-way line of R. A. Dent Boulevard a distance of 103 feet, more or less,to a point;thence,in a southeasterly direction a distance of 115 feet to a point; thence, in a southwesterly direction a distance of 66 feet,more or less, to a point;thence, in a southeaster direction a distance of 180 feet, more or less, to a point located on the northwest right-of-way line of Augusta Avenue;thence,in a southwesterly direction along the northwest right-of-way lien of Augusta Avenue a distance of 60 feet, more or less, to the point of beginning. Tract A consists of three land parcels totaling .7 acres having present addresses of 1239 Augusta Avenue; 1204 Holley Street and 1236 R. A. Dent Boulevard.(Tax Map 046-3-248-00-0,046-3-185-00-0&046-3-184-00-0)DISTRICT 1 Z-17-25 r y SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia is subject to the following stipulations: 1. The lot be fenced to prevent the current use from continuing until such time as all improvements can be executed; 2. The applicant move to start development within the proscribed timeframe of six(6)months or the property reverts to its previous zoning designation of residential use which prevents the use of the property as it currently operates; 3. The applicant provide a detailed engineered site plan that meet all development regulations in place at the time of site review; 4. The site shall not be available for use until such time as all requirements have been met; 5. A business license for the operation of a paid parking lot shall be acquired. 6. Per Section 35-7 of the Comprehensive Zoning Ordinance the Planning Commission may submit information to the Augusta Commission having jurisdiction relative to property which has been rezoned for a period of eighteen (18) months from the date of approval, and for which no site plan or subdivision development plan approval or building permit has been obtained. The Augusta Commission may then review such information and, if considered appropriate,initiate reversionary zoning procedures. Such reversionary actions shall proceed in accordance with the amendment provisions of this Ordinance. SECTION III.
