HomeMy WebLinkAboutRESOLUTION IN SUPPORT OF THE CONSOLIDATED GOVERNMENT OF AUGUSTA, GA IN SUPPORTING THE CONVEYANCE OF 4.11 ACRES OWNED BY AUGUSTA, GEORGIA LOCATED NEAR THE END OF FORWARD AUGUSTA DRIVE FOR USE IN A PROJECT RESOLUTION
A RESOLUTION IN SUPPORT OF THE CONSOLIDATED GOVERNMENT OF AUGUSTA, GEORGIA
SUPPORTING THE CONVEYANCE OF 4.11 ACRES OWNED BY AUGUSTA, GEORGIA LOCATED NEAR
THE END OF FORWARD AUGUSTA DRIVE AND BEING A PORTION OF TMS #170-0-239-00-0 FOR USE
IN A PROJECT.
WHEREAS, the Development Authority of Richmond County d/b/a the Augusta Economic Development
Authority (AEDA) is financing a new FedEx facility ("Project") through an Industrial Revenue Bond a 14.10 acre
tract(TMS# 170-1-001-00-0)located at the end of Forward Augusta Drive; and
WHEREAS, AEDA has requested 4.11 acres owned by Augusta, Georgia(portion of 8.36 acre tract TMS
No. 170-0-239-00-0)for use in the Project;and
WHEREAS, AEDA transferred 8.36 acres to Augusta, Georgia in 1991 following its development of
Forward Augusta Richmond County Industrial Park with its intended use being a storm water detention area;and
WHEREAS,the entire 8.36 acres is not necessary for storm water detention;and
WHEREAS, to enable AEDA to finance and develop this Project and maintain 28 jobs, this Commission
desires to transfer the 4.11 acres back to AEDA.
NOW,THEREFORE,BE IT RESOLVED by the Augusta-Richmond County Commission that:
1. In support of AEDA's efforts to finance and develop the Project on Forward Augusta Drive, the
Commission hereby authorizes and approves the conveyance to AEDA 4.11 acres(portion of TMS 170-0-239-00-0)
as depicted on a boundary survey for the Westmoreland Company, Inc. by Augusta Land Surveying, LLC dated
December 9, 2016, revised August 22, 2017 and shown as Parcel E on said plat. The conveyance will be made
subject to the following stipulations:
1. Augusta shall retain an easement of a minimum of 20 feet over the existing sanitary sewer
pipeline,which runs along the EASTERN edge of the property in question.
2. Cover, over sanitary sewer pipeline, shall be less than 18 feet in depth, before pipe material has to
change. Twenty feet is the maximum depth of any sanitary sewer pipeline.
3. If a request to relocate the sanitary sewer pipeline, referenced in #1 above, is submitted to
Augusta,a development plan shall accompany the request.
A. Any and all costs associated with the relocation of said sanitary sewer pipeline shall be
incurred and paid by the requesting party.
B. Once the new sanitary sewer is constructed, the property owner shall enter into an exchange
of easement(s)agreement,with the Augusta and the Utilities Dept.
