RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL
CLAIMS BY THERON WILSON IN THE AGGREGATE
AMOUNT OF SIXTY THOUSAND DOLLARS ($60,000);
AUTHORIZING CORVEL, THE THIRD PARTY
ADMINISTRATOR FOR THE AUGUSTA-RICHMOND
COUNTY WORKER'S COMPENSATION PROGRAM TO
DISBURSE THE AMOUNT OF SIXTY THOUSAND DOLLARS
($60,000); WAIVING AUGUSTA-RICHMOND COUNTY CODE
OF ORDINANCES SECTINS IN CONFLICT FOR THIS
INSTANCE ONLY; AND FOR OTHER PURPOSES.
WHEREAS, Theron Wilson, a former employee of Augusta has a pending Workers'
Compensation claim arising out of an on-the-job medical condition;
WHEREAS, all parties to said Workers' Compensation proceedings desire to settle all
clams; and
WHEREAS, Claimant has agreed to settle all claims against Augusta and the Augusta-
Richmond County Commission for the sum of sixty thousand dollars ($60,000);
WHEREAS, it is in the best interests of Augusta-Richmond County to resolve this matter
and pay the amount of sixty thousand dollars ($60,000) to Claimant as set out above to settle all
claims of Claimant against Augusta-Richmond County arising out of the facts in said Workers'
Compensation claims:
Claimant was a supervisor at the City cemeteries who was shot by a fellow
employee while on the job on May 12, 2015. Claimant has been unable to perform
his prior employment and has not returned to his former position. Claimant has
since been terminated as a result of his inability to return to his job after one year.
WHEREAS, Augusta-Richmond county acknowledges that the payment set forth herein
does not constitute any admission of liability on the part of Augusta-Richmond County and
liability is expressly denied;
NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County
Commission,
Section 1: The Augusta-Richmond county Commission will settle the claims of
Theron Wilson for the aggregate amount of sixty thousand dollars($60,000)
which shall be issued in one check payable jointly to Theron Wilson and
counsel.
Section 2: Corvel, the third party administrator for Augusta-Richmond County is
authorized to pay the total sum of sixty thousand dollars ($60,000) to
Theron Wilson and his counsel as set out above subject to approval of the
State Board of Workers' Compensation.
Section 3: To the extent that any section of the AUGUSTA, GA. CODE is in conflict
�herewith,� _ that subsection is waived for this instance only.
