RESOLUTION AUTHORIZING THE SETTLEMENT OF
RICHMOND COUNTY SUPERIOR COURT CIVIL ACTION
STYLED SANITA CHEATHAM, V. AUGUSTA-RICHMOND
COUNTY, UNITED STATES DISTRICT COURT FOR THE
SOUTHERN DISTRICT OF GEORGIA, CASE NO. 1:16CV00104,
WAIVING AUGUSTA, GEORGIA CODE OF ORDINANCES
SECTIONS IN CONFLICT FOR THIS INSTANCE ONLY;AND FOR
OTHER PURPOSES.
WHEREAS, On May 26, 2016, Plaintiff filed the above-styled lawsuit seeking
damages for alleged violations of the Family and Medical Leave Act and the Americans
with Disabilities Act of 1990; and
WHEREAS, the parties have participated in mediation;
WHEREAS,the parties have agreed, subject to Commission approval,to settle the
instant action for the aggregate sum of $20,000.00 and setting Plaintiffs salary as 911
Deputy Director at $65,331.55;
WHEREAS, it is in the best interest of Augusta, Georgia to resolve this matter
pursuant to the terms expressed herein and disburse the sum of$20,000.00 to settle this
action as authorized by the Augusta, Georgia Commission;
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission:
Section 1: The Augusta, Georgia Commission agrees to settle United States
District Court for the Southern District of Georgia, Case No.
1:2o16CVoo1o4 for the aggregate sum of $20,000.00 and setting
Plaintiffs salary as 911 Deputy Director at $65,331.55; and
Section 2: To the extent that any section of the AUGUSTA CODE is in conflict
herewith,that subsection is waived for this instance only.
Adopted this I3 day of June, 2017.
