RESOLUTION AUTHORIZING THE SETTLEMENT OF UNITED
STATES SOUTHERN DISTRICT COURT OF GEORGIA CIVIL
ACTION STYLED LISA VEGA V. KELLIE MCINTYRE et al.,CIVIL
ACTION FILE NO:17-CV-00053-JRH-BKE, WAIVING AUGUSTA,
GEORGIA CODE OF ORDINANCES SECTIONS IN CONFLICT
FOR THIS INSTANCE ONLY;AND FOR OTHER PURPOSES.
WHEREAS, On March 30, 2017, LISA VEGA filed the above-styled complaint for
damages in Richmond County Superior Court against the Solicitor General and her
employees extending from an alleged false arrest that occurred on April 17, 2015.
WHEREAS, On April 17, 2015 the plaintiff was arrested on a bench warrant issued
for failure to appear;
WHEREAS, prior to April 17, 2015 the plaintiff had paid and disposed of the traffic
ticket that was the subject of the court appearance where she failed to appear;
WHEREAS, the bench warrant was not contemporaneously dismissed with the
payment of the underlying traffic ticket;
WHEREAS, the parties have agreed, subject to Commission approval and judicial
disbursement, to settle the instant action for the aggregate sum of$12,500.00;
WHEREAS, it is in the best interest of Augusta, Georgia to resolve this matter
pursuant to the terms expressed herein and recommends that it disburse the sum of
$12,500.00 as just and adequate compensation to settle this action as authorized by the
Augusta, Georgia Commission;
NOW,THEREFORE,BE IT RESOLVED by the Augusta,Georgia Commission:
Section 1: The Augusta, Georgia Commission agrees to settle The United States
Southern District Court of Georgia, CIVIL ACTION FILE NO:17-CV-
00053-JRH-BKE, for the aggregate sum of $12,500.00 to Plaintiff,
LISA VEGA.
Section 2: To the extent that any section of the AUGUSTA CODE is in conflict
herewith, that subsection is waived for this instance only.
