HomeMy WebLinkAboutMOU- PHINIZY CENTER WATERSHED BASED PLAN_ SECTION 319 (H) NONPOINT SOURCE IMPLICATION GRANT PROGRAM MEMORANDUM OF UNDERSTANDING Thisf\ ..rorandum of Understanding (hereinafter "Memorandum") made this _j±411___ r 1 day of Q, , 2017, by and between AUGUSTA, GEORGIA, as a political subdivision of the State of Georgia reinafter referred to as "Augusta, Georgia" or "Augusta"), as Party of the First Part, and PHINIZY CENTER FOR WATER SCIENCES, (hereinafter referred to as "PCWS') as Party of the Second Part. WHEREAS, the PCWS is the professional partnering entity of the FY2015 Section 319(h) Water Quality Grant Funds and assisting Augusta Engineering Department in the development of a Nine-Element Watershed Management Plan; WHEREAS, the specific purpose of the 319 Grant Fund is to develop a nine-element watershed management plan (WMP) for the Augusta Canal (HUC-12 #030601060601) / Butler Creek (HUC-12 #030601060602) / Beaverdam Ditch (HUC-12 #030601060607) watersheds in the Savannah River Basin. The WMP will address the impaired streams in the watershed that are not supporting their designated uses on the 2014 Georgia 305(b)/303(d) List of Waters, and target Total Maximum Daily Loads (TMDL) established by Georgia Environmental Protection Division (EPD) for the impairments. expand existing water quality monitoring program and implement activities for water quality improvements of local water bodies in the Augusta through public outreach& education and utilization of relevant best management practices; WHEREAS, the 319 Grant funding entity, Georgia Environmental Protection Division (EPD) has determined that it would be of benefit to the citizens of Augusta, Georgia that funds from the grant be used to develop a nine-element watershed management plan; WHEREAS, Augusta has determined it would be of benefit to the citizens of Augusta, Georgia to contribute funding for this project; NOW, THEREFORE, as a desire of Augusta and PCWS to properly coordinate the development of the nine- element watershed protection plan, the parties hereby agree as follows: UNDERSTANDING Augusta, Georgia and PCWS do hereby agree to the following: 1. Augusta and PCWS will develop a watershed-based plan that includes water quality monitoring and existing water/land use data and education and outreach in the form of establishing an advisory committee, hosting public meetings, updating a website, identifying landowners for BMP cost-share projects, localizing need for urban BMPs, and distributing educational materials. 2. PCWS will conduct project activities for Project Tasks 1 to 7, 9, 12, 13, 14, and support Augusta in delivering Project Tasks 8, 10, 11, 15, and 16. The PCWS shall produce relevant deliverables as specified in 319 the grant workplan under the Deliverables identified for each Task in the Project Activities Section. 3. The 319 grant total estimated funds available for these activities are $50,266 over the grant duration. 4. Augusta Engineering Department (AED) will maintain over all program coordination and communication with the EPD (grant funding entity). 5. The PCWS and AED shall collect additional data from stressed creeks watershed for identify problematic areas using EPD approved methodology. 6. Augusta shall contribute $10,266 of its own funds (In kind& others) toward the 319 grant's matching funds. 7. The PWSC shall submit quarterly reimbursement claim with detailed description of work done during that quarter to AED within five days by end of the respective quarter. These reimbursement claims shall be prepared in a format acceptable by the EPD to process 319 grants expenses submittals. 8. Upon completion of the activities funded by 319 grant, material produced under this grant will become property of Augusta. However,the PCWS can use this material for their activities and scientific search purposes with approval of Augusta Engineering Department. TIME This Memorandum will remain in effect, only so long as the aforesaid conditions remain in effect. TERMINATION Both parties may terminate this MOU for just cause at any time by giving of thirty (30) days written notice of such termination. Upon receipt of such notice of termination, PCWS shall discontinue and cause all work under this MOU. Data gathered and material produced will become property of Augusta. MISCELLANEOUS 1. This Memorandum of Understanding shall be controlled by and construed in accordance with the laws of the State of Georgia. 2. Any notice given under this Memorandum shall be deemed given when provided in writing to the following persons: TO AUGUSTA, GA: Augusta, Engineering Department Engineering Administration Attn: Assistant Director Engineering 535 Telfair Street, Building 4000, Augusta, Georgia 30901 TO PHINIZY CENTER FOR WATER SCIENCES: Phinizy Center for Water Sciences Attn: Executive Director 1858 Lock and Dam Road, Augusta, Georgia 30906 This Memorandum of Understanding is the entire agreement between the parties, and may not be amended, except by a writing executed by both parties. IN WITNESS WHEREOF, Augusta and the Phinizy Center for Water Sciences have executed signed, sealed and delivered this Memorandum of Understanding as of the day and year first above written.
