HomeMy WebLinkAboutORD 7552 CHANGE OF ZONING FROM ZONE R-1C TO ZONE B-1 AFFECTING PROPERTY COMPRISED OF 5 TAX PARCELS_ JENKINS STREET, TUTTLE STREET Augusta Planning & Development Department 535 Telfair Street, Suite 300 Augusta, GA 30901 ORDINANCE NO. 1 55 2—., An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone R-1C(One-family Residential)to Zone B-1 (Neighborhood Business)affecting property comprised of 5 tax parcels located at Tract 1. located on the southeast intersection of Jenkins Street and Tuttle Street, Tract 2. located on the southern right- of-way line of Jenkins Street, approximately 42 feet east of the southeast intersection of Jenkins Street and Tuttle Street, 3. located on the southern right-of-way line of Jenkins Street, approximately 84 feet east of the southeast intersection of Jenkins Street and Tuttle Street,4.Tract 4.located on the southern right-of-way line of Jenkins Street, approximately 126 feet east of the southeast intersection of Jenkins Street and Tuttle Street, Tract 5. located on the southern right-of-way line of Jenkins Street, approximately 168 feet east of the southeast intersection of Jenkins Street and Tuttle Street; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone R-1C (One-family Residential)to Zone B-1 (Neighborhood Business) affecting property as follows: Z-16-44 Tract 1: Beginning at a point located on the southeast intersection of Jenkins Street and Tuttle Street;thence, in a easterly direction along the southern right-of-way line of Jenkins Street a distance of 42.0 feet to a point;thence, in a southerly direction a distance of 160.00 feet to a point on the northern right-of-way of Franklin Lane; thence, in a westerly direction along the northern right-of-way line of Franklin Lane a distance of 49.00 feet to a point,being at the northeast intersection of Franklin Lane and Tuttle Street;thence, in a northerly direction along the eastern right-of-way line of Tuttle Street a distance of 161.39 feet to the point of beginning. This property contains approximately 0.16 acre and is known as 1692 Jenkins Street. Tax Map 035-4-500-00-0 Tract 2: Beginning at a point located on the southern right-of-way line of Jenkins Street, approximately 42 feet east of the southeast intersection of Jenkins Street and Tuttle Street; thence,in a easterly direction along the southern right-of-way line of Jenkins Street a distance of 42.0 feet to a point;thence,in a southerly direction a distance of 160.00 feet to a point on the northern right-of-way of Franklin Lane;thence,in a westerly direction along the northern right-of-way line of Franklin Lane a distance of 47.00 feet to a point;thence,in a northerly direction a distance of 160.00 feet to a point, being at the right-of-way of Jenkins Street, and also being the point of beginning. This property contains approximately 0.16 acre and is known as 1690 Jenkins Street. Tax Map 035-4-511-00-0 Tract 3: Beginning at a point located on the southern right-of-way line of Jenkins Street, approximately 84 feet east of the southeast intersection of Jenkins Street and Tuttle Street; thence,in a easterly direction along the southern right-of-way line of Jenkins Street a distance of 42.0 feet to a point;thence,in a southerly direction a distance of 160.00 feet to a point on the northern right-of-way of Franklin Lane;thence,in a westerly direction along the northern right-of-way line of Franklin Lane a distance of 47.00 feet to a point;thence,in a northerly direction a distance of 160.00 feet to a point, being at the right-of-way of Jenkins Street, and also being the point of beginning. This property contains approximately 0.16 acre and is known as 1688 Jenkins Street. Tax Map 035-4-510-00-0 Tract 4: Beginning at a point located on the southern right-of-way line of Jenkins Street, approximately 126 feet east of the southeast intersection of Jenkins Street and Tuttle Street; thence, in a easterly direction along the southern right-of-way line of Jenkins Street a distance of 42.0 feet to a point; thence, in a southerly direction a distance of 160.00 feet to a point on the northern right-of- way of Franklin Lane;thence, in a westerly direction along the northern right-of-way line of Franklin Lane a distance of 47.00 feet to a point;thence, in a northerly direction a distance of 160.00 feet to a point,being at the right-of-way of Jenkins Street,and also being the point of beginning. This property contains approximately 0.16 acre and is known as 1686 Jenkins Street. Tax Map 035-4-509-00-0 Tract 5: Beginning at a point located on the southern right-of-way line of Jenkins Street, approximately 168 feet east of the southeast intersection of Jenkins Street and Tuttle Street; thence, in a easterly direction along the southern right-of-way line of Jenkins Street a distance of 42.0 feet to a point; thence, in a southerly direction a distance of 160.00 feet to a point on the northern right-of- way of Franklin Lane;also being the eastern terminus of Franklin Lane;thence,in a westerly direction along the northern right-of-way line of Franklin Lane a distance of 46.00 feet to a point;thence, in a northerly direction a distance of 160.00 feet to a point,being at the right-of-way of Jenkins Street,and also being the point of beginning. This property contains approximately 0.16 acre and is known as 1684 Jenkins Street. Tax Map 035-4-508-00-0 Z-16-44 Section II. The Comprehensive Zoning Maps for Augusta, Georgia are amended subject to the following conditions: 1. Development of the property must conform to the concept plan submitted with this petition; and the lots must be combined if the zoning petition is approved. 2. Development of the property will require compliance with the Augusta Tree Ordinance. 3. The site plan must demonstrate compliance with any other ordinances and regulations. 4. The abandonment of Franklin Lane must be completed before any land disturbing permit or building permit is issued. 5. Any new curb-cuts and additional right-of-way and easements for the site are subject to approval by the Augusta Engineering Department. 6. Parking lot and security lighting must be directed away from any nearby residential properties. 7. There shall be no access to Jenkins Street from the subject properties. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
