SEVIER IN THE AGGREGATE SUM OF ONE HUNDRED AND FIFTEEN THOUSAND DOLLARS RESOLUTION RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS BY MARK J. SEVIER (CLAIMANT) IN THE AGGREGATE SUM OF ONE HUNDRED FIFTEEN THOUSAND DOLLARS ($115,000.00), PAYABLE AS FOLLOWS: MARK J. SEVIER AND THE LAW OFFICE OF BRYAN S. HAWKINS, LLC, AS HIS ATTORNEYS; FURTHER AUTHORIZING THE THIRD-PARTY ADMINISTRATOR, CORVEL CORPORATION, TO DISBURSE THE AMOUNT OF ONE HUNDRED FIFTEEN THOUSAND DOLLARS ($115,000.00); WAIVING AUGUSTA, GEORGIA CODE OF ORDINANCES SECTIONS IN CONFLICT FOR THIS INSTANCE ONLY; AND FOR OTHER PURPOSES. WHEREAS, Mark J. Sevier, filed a workers' compensation claim for injuries he sustained on August 27, 2014 while employed with the Richmond County Sheriffs Office bearing claim number 2014-026735; WHEREAS, all parties to said claim desire to settle all issues; and WHEREAS, Claimant has agreed to settle all claims against Augusta-Richmond County, Augusta-Richmond County Commission, and the Richmond County Sheriffs Office, for the sum of one hundred fifteen thousand dollars ($115,000.00), payable to Mark J. Sevier and The Law Office of Bryan S. Hawkins, LLC, as his attorneys. WHEREAS, it is in the best interests of Augusta, Georgia to resolve this matter and pay the amount of one hundred fifteen thousand dollars ($115,000.00) to Claimant as set out above to settle all claims of Claimant against Augusta-Richmond County, Augusta-Richmond County Commission, the Richmond County Sheriffs Office and their employees and agents arising out of the facts alleged in said claim: Whileconducting police training on high-speed chases, after having come to a complete stop, Deputy Sevier was rear-ended by another Deputy causing significant injury to his neck and back. In addition, he was knocked unconscious for a period of time. At the time of the accident, Deputy Sevier was a 22 year veteran of the force. Mr. Sevier is still undergoing medical treatment and as a result of his injuries, his treating physician has recommended the surgical implantation of a spinal cord stimulator. Mr. Sevier, through counsel, submitted a demand of $190,000.00 on May 15, 2016 to settle his claim. WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not constitute any admission of liability on the part of Augusta, Georgia, Sheriff of Richmond County, or any of their deputies or employees and liability is expressly denied; Settlement Resolution for WC Claim Claimant: Mark J.Sevier Employer: RCSO Claim#: 2014-026735 Page 1 of 2 NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission, Section 1: The Augusta, Georgia Commission will settle the claims set forth above for the sum of one hundred fifteen thousand dollars ($115,000.00), payable to Mark J. Sevier and The Law Office of Bryan S. Hawkins, LLC, as his attorneys. Section 2: The Third-Party Administrator, Corvel Corporation, is authorized to pay a total sum of one hundred fifteen thousand dollars ($115,000.00), payable to Mark J. Sevier and Radford&Keebaugh, LLC, as his attorneys. Section g: To the extent that any section of the AUGUSTA, GA. CODE is in conflict herewith,that subsection is waived for this instance only.
