HomeMy WebLinkAboutMOU WITH STATE OF GEORGIA EMERGENCY MANAGEMENT & HOMELAND SECURITY AGENCY (GEMHSA) MEMORANDUM OF UNDERSTANDING/AGREEMENT BETWEEN STATE OF GEORGIA GEORGIA EMERGENCY MANAGEMENT&HOMELAND SECURITY AGENCY(GEMHSA) AND AUGUSTA-RICHMOND COUNTY,GEORGIA 1. PARTIES: The parties to this Agreement are GEMHSA and Augusta-Richmond County, Georgia (Augusta-Richmond County). 2. PURPOSE: The purpose of this Agreement is to set forth terms by which GEMHSA will provide Emergency Evacuation Shelter Initiative (EESI) equipment and other items as listed on Exhibit A, attached hereto, to Augusta-Richmond County in support of all-hazards emergency management missions. 3. RESPONSIBILITIES: A. Obligations of Augusta-Richmond County I. Commitment to participate in annual reviews by GEMHSA of designated and local shelter coordination planning sessions each year prior to the advent of Hurricane Season,June 1. II. Commitment to cooperate with GEMHSA and American Red Cross (ARC) if GEMHSA requests the community open an Emergency Evacuation Shelter and to notify GEMHSA and ARC if local community believes a local Emergency Evacuation Shelter should be opened. III. Commitment to participate with ARC hosting annual shelter training for local volunteers and state agency staff participating in EESI. IV. Commitment to accept EESI equipment and supplies provided by GEMHSA. V. Commitment to inventory all EESI items annually, at a minimum, and maintain EESI items in ready- to-use condition. VI. Commitment to notify GEMHSA Field Coordinator if any EESI items are damaged or consumed during activities in the community other than operation of an Emergency Evacuation Shelter. VII. Commitment to replace any EESI items damaged or consumed during activities in the community other than operation of an Emergency Evacuation Shelter. VIII.Commitment to work with other local public agencies,nonprofit organizations,faith-based institutions and civic volunteers to provide decent, safe and sanitary shelter to those seeking refuge from a hurricane threatening to impact the State of Georgia. IX. Commitment to execute a new Emergency Evacuation Shelter Memorandum of Agreement with GEMHSA at the expiration of this Agreement, if Augusta-Richmond County chooses to remain an EESI participant. Emergency Evacuation Shelter Initiative—August 2016 B. Obligations of the Georgia Emergency Management&Homeland Security Agency I. Commitment to prepare and maintain a State of Georgia Sheltering Plan,which provides guidelines for operation and administration of EESI. II. Commitment to conduct an annual statewide review of EESI and host an annual planning session with participating counties and state agencies. III. Commitment to replace any EESI equipment and supplies damaged or consumed while conducting approved sheltering actions. IV. Commitment to execute a new Emergency Evacuation Shelter Memorandum of Agreement with Augusta-Richmond County at the expiration of this Agreement, if Augusta-Richmond County chooses to remain an EESI participant. 4. SEVERABILITY: Nothing in this Agreement is intended to conflict with current laws or regulations of the State of Georgia or Augusta-Richmond County. If a term of this Agreement is inconsistent with such authority,said term will be invalid,but the remaining terms and conditions of this Agreement will remain in full force and effect. 5. EFFECTIVE DATE: The terms of this Agreement will become effective on September 15,2016. 6. MODIFICATION: This Agreement may be modified upon the mutual written consent of the parties. 7. TERMINATION: The terms of this Agreement,as modified with consent of both parties,will remain in effect until August 31, 2020, unless terminated earlier by either party. Either party may terminate this Agreement upon sixty (60) days' written notice to the other party. Upon termination of this Agreement for any reason, all EESI equipment and supplies will be returned in operable condition to GEMHSA headquarters, 935 E. Confederate Avenue SE, Atlanta, Georgia 30316, within thirty (30) days of said termination. 8. ASSIGNMENT: GEMHSA and Augusta-Richmond County's privileges herein are personal to GEMHSA and Augusta-Richmond County and may not be assigned, in whole or part. Any attempted assignment of this Agreement by will be null and void and of no force and effect. 9. NOTICE:All notices required herein will be in writing and delivered to either party at the address contained herein by(a)hand delivery to the address below;(b)United States Certified Mail-Return Receipt Requested,postage prepaid;or(c)by e-mail immediately followed by a confirmation call.The day upon which such notice is hand delivered,mailed or e-mailed will be deemed the date of service of such notice. 10. WAIVER:No failure of the parties hereto to exercise any right or power granted under this Agreement and no custom or practice of the parties at variance with the terms and conditions of this Agreement will constitute a waiver.
