RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS
BY ROCKY THOMAS IN THE AGGREGATE AMOUNT OF SEVENTY
FIVE THOUSAND DOLLARS ($75,000); AUTHORIZING CORVEL, THE
THIRD PARTY ADMINISTRATOR FOR THE AUGUSTA-RICHMOND
COUNTY WORKERS' COMPENSATION PROGRAM TO DISBURSE NO
MORE THAN THE AMOUNT OF SEVENTY FIVE THOUSAND
DOLLARS($75,000);WAIVING AUGUSTA-RICHMOND COUNTY CODE
OF ORDINANCES SECTIONS IN CONFLICT FOR THIS INSTANCE
ONLY; AND FOR OTHER PURPOSES.
WHEREAS, Rocky Thomas, a former employee of Augusta has a pending Workers'
Compensation claim arising out of an on the job injury on February 24, 2014;
WHEREAS, all parties to said Workers' Compensation proceedings desire to settle all
claims; and
WHEREAS, Claimant has agreed to settle all claims against Augusta and the Augusta-
Richmond County Commission for the sum of seventy five thousand dollars ($75,000);
WHEREAS, it is in the best interests of Augusta-Richmond County to resolve this matter
and pay the amount of seventy five thousand dollars ($75,000) to Claimant as set out above to
settle all claims of Claimant against Augusta-Richmond County arising out of the facts in said
Workers' Compensation claims:
On February 24, 2014, Claimant suffered an on the job injury
necessitating surgery and resulting in permanent disability to
Claimant. Claimant has subsequently retired from his position with
the Augusta-Richmond County Recreation Department in part due
to his injuries and is still owed approximately $53,000 in future
benefits for his permanent disability arising out of his injury and is
due continiuing medical treatment for his injury and resulting
condition for the remainder of his life.
WHEREAS, Augusta-Richmond County acknowledges that the payment set forth herein
does not constitute any admission of liability on the part of Augusta-Richmond County and
liability is expressly denied;
NOW, THEREFORE, BE IT RESOLVED by the Augusta-Richmond County
Commission,
Section 1: The Augusta-Richmond County Commission will settle the claims of
Rocky Thomas for the aggregate amount of seventy five thousand dollars
($75,000).
Section 2: The third party administrator for Augusta-Richmond County, CorVel, is
authorized to pay the total sum of seventy five thousand dollars ($75,000)

to Rocky Thomas and his attorney subject to approval of the State Board of
Workers' Compensation.
Section 3: To the extent that any section of the AUGUSTA, GA. CODE is in conflict
herewith, that subsection is waived for this instance only.

Resolution was duly adopted by the Augusta-Richmond County Commission
on , 2016 and that such Resolution has not been modified or rescinded as
of the date hereof and the undersigned further certifies that attached hereto is a true copy of the
Resolution which was approved and adopted in the foregoing meeting(s).
