HomeMy WebLinkAboutORD 7546 CHANGE OF ZONING FROM ZONE HI AND ZONE A TO ZONE HI AFFECTING PROPERTY LOCATED ON THE EAST RIGHT-OF-WAY LINE OF MIKE PADGETT HIGHWAY WHERE OLD LOUISVILLE RD EXTENDED INTERSECTS ORDINANCE NO.15'i to An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone HI (Heavy Industry) and Zone A (Agriculture) to Zone HI affecting property located on the east right-of-way line of Mike Padgett Highway where Old Louisville Road extended intersects;and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map by changing the zoning from Zone HI(Heavy Industry)and Zone A(Agriculture)to Zone HI affecting property as follows: Beginning at a point located on the east right-of-way line of Mike Padgett Highway where Old Louisville Road extended intersects; thence, in an easterly direction a distance of 197.39 feet to a point;thence,in a northerly direction a distance of 122.80 feet to a point; thence, in an easterly direction a distance of 80.40 feet to a point; thence,in a southerly direction a distance of 26.40 feet to a point;thence,S 88°03'10" E a distance of 62.07 feet to a point;thence,N 74°54'25"E a distance of 89.64 feet to a point;thence,S 88°09'19"E a distance of 205.28 feet to a point;thence,S 23°24'27" E a distance of 252.69 feet a point; thence,N 88°07'11" W a distance of 441.18 feet to a point located on the east right-of-way line of Mike Padgett Highway;thence, in a northerly direction along the east right-of-way line of Mike Padgett Highway a distance of 99.95 feet to the point of beginning.This property contains approximately 2.9 acres and is known as 2722 Mike Padgett Highway and part of 1778 Lumpkin Road. Tax Map 111-0-002-00-0 and part of 111-0-002-07-0 Z-16-34 Section II. The Comprehensive Zoning Maps for Augusta, Georgia are amended subject to the following conditions: 1. The use of the site is limited to the existing businesses on 2722 Mike Padgett Highway and 1778 Lumpkin Road and all uses permitted in the LI zone, subject to no outdoor production or manufacturing,due to the close proximity to floodplain and wetlands. 2. The approved plat combining 2722 Mike Padgett Highway and the two-acre portion of 1778 Lumpkin Road must be recorded with the Clerk of Superior Court prior to site plan submittal. 3. The project site plan must comply with all development related ordinances and regulations in effect at the time of site plan review. 4. Any modification to the existing curb cuts and any traffic-related improvements must be approved by the Traffic Engineering Department and Georgia Department of Transportation(GDOT). 5. Water and sewer must be extended to the proposed building from the existing water and sewer lines within Mike Padgett Highway at the petitioner's expense. SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed.
