EASEMENT DEED
PARCEL IDENTIFICATION NUMBER: 040-0-003-00-0 ADDRESS: 3801 Wrightsboro Road
THIS INDENTURE made and entered into this/3 day of s p 2016, between
Dempsey Clay Ward, as the Executor of the Estate of Leon C. Ward, hereinafter referred to
as OWNER, and Augusta, Georgia, a political subdivision under the laws of Georgia,
hereinafter referred to as AUGUSTA;
WITNESSETH, that OWNER, for and in consideration of the sum of ONE DOLLAR
($1.00) in hand and truly paid by AUGUSTA at and before the sealing and delivery of these
presents, and other valuable consideration, the receipt whereof is hereby acknowledged, has
granted, bargained, sold, conveyed and confirmed, and by these presents does grant, bargain,
sell, convey and confirm unto AUGUSTA, its successors and assigns, a TEMPORARY
CONSTRUCTION EASEMENT as hereinafter described.
Said easement consists of 2,260 Square Feet, more or less, shown as "Proposed 20'
Temporary Construction Easement "A- and "Proposed Temporary Construction Easement `B',"
on a plat prepared by the Augusta Utilities Department, dated April 25, 2016, attached hereto
and made a part hereof, and to which reference is made for a more accurate and complete
description of the metes, bounds and courses. Said easement being for the purposes of digging
such trenches in said parcel of land as may be necessary to construct, or reconstruct, a pipeline
within an existing permanent easement owned by Augusta, to pile thereon the material
excavated, to haul pipe, supplies and equipment connected with the construction thereof, over,
along and across the said parcel of land, to pile pipe and other equipment and park equipment
needed in the course of constructing the pipeline, and access to and from the aforementioned
existing permanent easement . Said temporary construction easement shall expire at the
completion and final acceptance of this pipeline by AUGUSTA.
IN WITNESS WHEREOF, OWNER has set his hand and seal, the day and year
first above written.

WITNESSETH, that Owner, for and in consideration of ONE DOLLAR ($1.00), the receipt whereof
is hereby acknowledged, and in consideration of the benefits derived by said Owner from the proposed
Project mentioned herein, Owner agrees to be bound, and to bind their representatives, assigns ar d heirs
as follows:
If Augusta shall, within one hundred and eighty (180) days from the date first written abc ie, pay
the sum of $113.00 the Owner agrees to execute and deliver to Augusta easements to the heri:inafter
described parcel of land.
Said Temporary Construction Easement consists of 2,260 Square Feet, more or less, of temporary
