HomeMy WebLinkAboutORD 7378 TO AMEND COMP ZONING ORD CHANING THE ZONING FROME ZONE A (AGRICULTURE) TO ZONE R-3B (MULTIPLE-FAMILY RESIDETIAL) AFFECTING PROPERTY RIGHT-OF=--WAY OF WAY LINE OF FLOWING WELLS RDORDINANCE NO. 7378 An Ordinance to amend the Comprehensive Zoning Ordinance adopted by the Augusta, Georgia Commission effective September 16, 1997 (Ordinance No. 5960) together with all amendments which have been approved by either the Augusta Commission as authorized under the Home Rule Provisions of the Comprehensive Zoning Map from Constitution of the State of Georgia" by changing the zoning from Zone A (Agriculture) to Zone R -3B (Multiple - family Residential) affecting property consisting of 2 tracts located as follows: Tract A located where the northeast right -of -way line of Flowing Wells Road intersects with the southeast right -of -way line of Elm Avenue and Tract B located where the centerline of Elm Avenue intersects the northeast right -of -way line of Arabian Horse Drive; and for the repeal of ordinances in conflict herewith and for other purposes: THE AUGUSTA, GEORGIA COMMISSION HEREBY ORDAINS: SECTION I. That the Comprehensive Zoning Ordinance adopted by the Board of Commissioners of Richmond County on the 15th day of November, 1983, the caption of which is set out above, is amended by changing the Comprehensive Zoning Map from Zone A (Agriculture) to Zone R -3B (Multiple - family Residential) affecting property as follows: Tract A Beginning at a point located where the northeast right -of -way line of Flowing Wells Road intersects with the southeast right -of -way line of Elm Avenue; thence, in a northeasterly direction along the southeast right -of -way line of Elm Avenue a distance of 501 feet, more or less, to a point located on the southwest right -of -way line of Arabian Horse Drive; thence, in a southeasterly direction along the southwest right -of -way line of Arabian Horse Drive a distance of 865 feet, more or less, to a point; thence, S 60 °19'52" W a distance of 184.85 feet to a point; thence, in a northwesterly direction a distance of 555 feet, more or less, to a point; thence, S 57°00'16" W a distance of 191.66 feet to a point located on the northeast right -of -way line of Flowing Wells Road; thence, N 35 °24'48" W a distance of 304.91 feet to the point of beginning. This property contains approximately 5.94 acres and is known as 1332 Flowing Wells Road, 1533Elm Avenue and 1515 -1531 (odd only) Arabian Horse Drive. (Tax Map 029 -0- 051 -00 -0, 029- 0 -048- 03-0, 030 -0- 250 -00 -0, 030 -0- 251 -00 -0, 030 -0- 252 -00 -0, 030 -0- 253 -00 -0, 030-0- 249 -00- 0, 030 -0- 248 -00 -0, 030 -0- 247 -00 -0) Tract B Beginning at a point located where the centerline of Elm Avenue intersects the northeast right -of -way line of Arabian Horse Drive; thence, in a northwesterly direction along the northeast right -of -way line of Arabian Horse Drive a distance of 80 feet, more or less, to a point; thence, in a northeasterly direction a distance of 985 feet, more or less, to a point; thence, S 09 °11'41" E a distance of 527.93 feet to a point; thence, S 65 °40'03" W a distance of 850.90 feet to a point located on the northeast right -of -way line of Arabian Horse Drive; thence, N 23 °19'08" W along the northeast right -of -way line of Arabian Horse Drive a distance of 248.67 feet to a point; thence, in an easterly direction a distance of 424 feet, more or less, to a point; thence, N 09 °50'20" W a distance of 205.79 feet to a point; thence, S65 °30'56" W a distance of 422.90 feet to a point located on the northeast right -of -way line of Arabian Horse Drive; thence, N 24 °10'37" W along the northeast right -of -way line of Arabian Horse Drive a distance of 223 feet, more or less, to the point of beginning. This property contains approximately 10.5 acres and is known as 1524 and 1530 Arabian Horse Drive. (Tax Map 030 -0- 019 -00 -0 & 030 -0- 019 -02 -0) SECTION II. This amendment to the Comprehensive Zoning Maps for Augusta, Georgia are subject to the following stipulations: That the petitioner /developer must improve Elm Street (aka Arabian Horse Drive) to County standards between Flowing Wells Road and parcel 030 SECTION III. All Ordinances or parts of Ordinances in conflict with this Ordinance are hereby repealed. Done in Open Meeting under the Common Seal thereof this 15 day of JdLi , 2013.
