The Department of Housing and Urban Development has acknowledged receipt of this election by email on Wednesday, June 11, 2008. 6.0(b) 4 PHA Rent Determination Policies [24 CFR Part 903.12(b), 903.7(d)] Public Housing A family's income determines eligibility for assistance and is also used to calculate the family's rent payment. The AHA will use the policies and methods described in the ACOP to ensure that only eligible families receive assistance and that no family pays more or less than its obligation under the regulations. The ACOP describes HUD regulations and AHA policies related to HUD regulations that specify the sources of income to include and exclude to arrive at a family's annual income, the requirements and AHA policies for calculating annual income, mandatory deductions for which a family qualifies and used for calculating adjusted income and the statutory formula for calculating total tenant payment (TTP), the use of utility allowances, and the methodology for determining family rent payment, flat rents and the family's choice in rents. 3 • • Augusta Housing Authority 5- Year /Annual Plans 2013 -2017 Section 8 Tenant -Based Assistance The Housing Authority's payment standard is above FMR and are adequate to ensure success among assisted families in the housing authority's segment of the FMR area. The payment standards are reevaluated annually for adequacy and success rates and rent burdens of assisted families are considered in when conducting the assessment. The minimum rent for the housing assistance program is $50. A discretionary minimum rent hardship exemption policy includes: If the family has lost eligibility or is awaiting an eligibility determination; the family would or would not be evicted as a result of the imposition of the minimum rent requirement; the income of the family has decreased because of a change in circumstances, including loss of employment, death in the family or other circumstances as determined by AHA or HUD. The Administrative Plan further details the factors related to total tenant payment and family share determination. 6.0(b)4. Operation and Management HUD writes and publishes regulations in order to implement public housing laws enacted by Congress. HUD contracts with the AHA to administer programs in accordance with HUD regulations and provides an operating subsidy to the AHA. The AHA must create written policies that are consistent with HUD regulations. Among these policies is the AHA's Admissions and Continued Occupancy Policy (ACOP). The ACOP must be approved by the board of commissioners of the AHA. The job of the AHA pursuant to HUD regulations is to provide decent, safe, and sanitary housing, in good repair, to low- income families at an affordable rent. The AHA screens applicants for public housing and, if they are found eligible and accepted, the AHA offers the applicant a unit. If the applicant accepts the offer, the AHA will enter into a contract with the applicant known as the lease. At this point, the applicant becomes a resident of the public housing program. The Admissions and Continued Occupancy Policy (ACOP) is the AHA's written statement of policies used to carry out the public housing program in accordance with federal law and regulations, and HUD requirements. The ACOP is required by HUD and it must be available for public review [CFR 24 Part 903]. The ACOP also contains policies that support the objectives contained in the AHA's Agency Plan. All issues related to public housing not addressed in the ACOP are governed by federal regulations, HUD handbooks and guidebooks, notices and applicable state and local laws. The policies in this ACOP have been designed to ensure compliance with the consolidated ACC and all HUD- approved applications for program funding. The AHA is responsible for complying with all changes in HUD regulations pertaining to public housing. If such changes conflict with this plan, HUD regulations will have precedence. The Augusta Housing Authority will make all efforts to provide a healthy and pest -free environment for its residents. AHA will treat all public housing units quarterly and will provide the best possible treatment for the eradication of those pests at all public housing sites. AHA maintenance and management personnel will maintain an adequate schedule for treatment to address any existing infestation and special attention shall be paid to cockroaches. Resident cooperation with the extermination plan is essential. All apartments in a building will be treated by licensed AHA personnel for the plan to be effective. All residents will be provided a written notice of at least 48 hours before treatment unless immediate verbal permission is granted. The notification will also include instructions that describe how to prepare the unit for treatment. In addition, all units will be treated before move -in and following voluntary and involuntary move -outs. 6.0(b)5. Grievance Procedures The ACOP discusses grievances and appeals pertaining to AHA actions or failures to act that adversely affect public housing applicants or residents. The policies are discussed in the following three parts: the requirements and procedures for informal hearings for public housing applicants, informal hearings regarding citizenship status and where they differ from the requirements for general applicant and resident grievances and the requirements and procedures for handling grievances for public housing residents. The procedures mirror those found at 24 CFR Part 966, Subpart B. A copy of the grievance procedure is posted at each public housing site and a copy is provided to each resident at lease up. The informal hearing requirements defined in HUD regulations are applicable to participating families who disagree with an action, decision or inaction of the Augusta Housing Authority. The Administrative Plan describes the Augusta Housing Authority 5 -Year /Annual Plans 2013 -2017 policies, procedures, and standards to be used when families of the housing assistance program disagree with decisions of the AHA. The hearing procedures are provided to families in the briefing packets. 6.0(b)6. Community Service and Self - Sufficiencv HUD regulations pertaining to the community service requirement are contained in 24 CFR 960 Subpart F (960.600 through 960.609). PHAs and residents must comply with the community service requirement, effective with PHA fiscal years that commenced on or after October 1, 2000. Per 903.7(1)(1)(iii), the PHA Plan must contain a statement of the how the PHA will comply with the community service requirement, including any cooperative agreement that the PHA has entered into or plans to enter into. Community service is the performance of voluntary work or duties that are a public benefit, and that serve to improve the quality of life, enhance resident self - sufficiency, or increase resident self - responsibility in the community Community service is not employment and may not include political activities [24 CFR 960.601(b)]. In administering community service requirements, the PHA must comply with all nondiscrimination and equal opportunity requirements [24 CFR 960.605(c) (5)]. The ACOP explains HUD regulations requiring PHAs to implement a community service program for all non - exempt adults living in public housing. • The AHA will provide on -site training sessions to residents on a rotating basis for residents to meet community service requirements. • The AHA will attempt to provide the broadest choice possible to residents as they choose community service activities. • The AHA's goal is to design a service program that gives residents viable opportunities to become involved in the community and to gain competencies and skills. The AHA will work with resident organizations and community organizations to design, implement, assess and recalibrate its community service program. • The AHA will make every effort to identify volunteer opportunities throughout the community, especially those in proximity to public housing developments. To the greatest extent possible, the PHA will provide names and contacts at agencies that can provide opportunities for residents, including persons with disabilities, to fulfill their community service obligations. • Any written agreements or partnerships with contractors and/or qualified organizations, including resident organizations, are described in the AHA Plan. • The AHA will provide in -house opportunities for volunteer work or self - sufficiency programs when possible. MOU Agreements: Family Y Child Development Center in cooperation with the CSRA EOA provides childcare and support services to ROSS resident trainees. CSRA Partnership for Community Health provides educational inserts for distribution on the AHA resident newsletter and training at the resident association meetings. CSRA EOA operates a Neighborhood Networks Center to provide life skills training designed to assist in 5 • obtaining permanent employment and continuing education. Safety and Crime Prevention The need for measures to ensure the safety of public housing residents are based on the high incidence of violent and/or drug related crime in areas surrounding or adjacent to public housing sites, resident fearful for their safety and the safety of their children and applicants on the waiting list unwilling to move into one or more developments because of perceived levels of violent and/or drug related crime. The Augusta Housing Authority based the need for action of crime statistics committed in or around our developments, resident reports, police reports and staff reports. The Augusta Housing Authority coordinates with the Augusta Richmond County Sheriffs Department in carrying out crime prevention measures and activities through neighborhood watches, an agreement with the local law enforcement agency, police regularly testify and support eviction cases, police presence at the developments and regular submission of police reports to AHA. 6.0(b) 9. Pets The purpose of a pet policy is to establish clear guidelines for ownership of pets and to ensure that no applicant or resident is discriminated against regarding admission or continued occupancy because of ownership of pets. It also establishes reasonable rules governing the keeping of common household pets. Chapter 10 of the ACOP explains the difference between assistance animals and pets and contains policies related to the designation of an assistance animal as well as their care and handling, pet policies that are common to both elderly /disabled developments and general occupancy developments, policies for pet deposits and fees that are applicable to elderly /disabled developments and policies for pet deposits and fees that are applicable to general occupancy developments • 6.0(b) 10. Civil Rights Certification 6.0 (b) 11. Fiscal Year Audit The auditor recommended that AHA should strengthen its internal controls over tenant eligibility and should review public housing files periodically for accuracy and compliance. We agreed with the recommendation and files are reviewed for quality control. 6.0(b) 12. Asset Management The Augusta Housing Authority provided on -site training to management staff in preparation for conversion to property-based management services as required by asset management. AHA staff are assigned to each AMP and are charged with direct oversight of all property operations verses centralized management. 6.0(b) 13. Violence Against Women Act (VAWA) The Augusta Housing Authority's March 2007 Resident Spotlight provided information regarding the act and the hotline number to the local Domestic Violence Intervention Center. The hotline number is also listed on our webpage and the quarterly Family Self - Sufficiency Spotlight. Since there is a correlation between victims of domestic violence and homelessness, rent burdens and substandard housing, our agency will continue to employ these former federal preferences in our housing assistance program. In addition, a Tenancy Addendum (HUD form 52641 -A) has been provided to all landlords which outlines protections from evictions for victims of abuse. 7.0 HOPEVI , Mixed Finance Modernization or Development, Demolition and/or Disposition, Conversion of Public Housing Homeownership Programs and Project- based Vouchers • • Hope VI Revitalization AHA has not received a HOPE VI revitalization grant. Augusta Housing Authority 5- Year /Annual Plans 2013 -2017 Mixed Finance Modernization or Development The following sites have been approved for mixed finance modernization and development by Fair Housing for public housing: Demolition and Disposition [24 CFR Part 903.12(b), 903.7 (h)] The Housing Authority of the City of Augusta, Georgia (AHA) has submitted a phased demolition/disposition plan for Underwood Homes, GA001011, for the development new affordable, mixed income housing on the existing site. On May 13, 2009, the Authority received HUD approval for the demolition/disposition of Underwood Homes, GA001000110, a 250 public housing development on 26.82 acres. The Authority is planning to develop mixed- income, affordable housing on the site financed with Low Income Housing Tax Credits, LIHTC, and Replacement Housing Funds, RHF. The new development will be built in four phases with the first phase, The Legacy at Walton Oaks, will be a 75 unit senior complex with 12 of the 75 units designated as ACC units. The grand opening for the first phase will be held on October 25, 2011 with a scheduled completion date of December 2011. The Walton Oaks development will also include a rental office, community space, fitness facilities, library, computer rooms and park amenities. Development name: Underwood Homes Development number: GA0010011 Activity Type: Demolition Date of application: February 6, 2009 Date of approval: May 13, 2009 Number of units affected: 250 Coverage Action: Total development Projected start date: 01/2010 Projected end date: 12/2011 Phase I: A 75 unit complex consisting of one and two bedroom units for near seniors, age 55 +, residents: Of the 75 units, 12 will be for public housing, 26 will be project -based rental assistance, and 38 will be for tax credit units. The senior complex called the Legacy @ Walton Oaks was completed in January 2012. Phase II: A 75 family unit complex consisting of two and three bedroom units: Of the 75 units, 14 will be for public housing and 61 will be tax credit units. The project is planned to start in November 2011 and will be completed in December 2012. Phase III: A 75 family unit complex consisting of two and three bedroom units with a planned start date of October 2013 and a completion date of December 2014. Phase IV: A 75 family unit complex consisting of two and three bedroom units with a planned start date of October 2014 and a completion date of December 2015. The Housing Authority of the City of Augusta, Georgia (AHA) is planning to submit a • phased demolition/disposition plan Cherrytree Crossing, GA001002, for the development of new affordable, mixed income housing on the existing site and will use a grounds lease for re- development. • • The new affordable housing will be developed in multiple phases as a mixed-finance, mixed - income development serving people with incomes ranging from less than 30% of area median to unrestricted incomes. The majority of the units will qualify for Low - Income Housing Tax Credits. Some of the units will receive rent subsidies from an Annual Contributions Contract and/or Project -Based Section 8. Because some of the units are anticipated to be Public Housing Units, a portion of the units must be unrestricted, in accordance with Georgia's Qualified Allocation Plan. The agreement for the installation and maintenance of a communication tower, on 0.2296 acres (10,000 sq. ft.), is for an annual amount of $15,000.00, for an initial term of five (5) years with extensions for four (4) additional five (5) year terms. Sites include but are not limited to development of 40 single- family senior housing units and duplexes at Twiggs and Wrightsboro Road with a start date of April 2013. The property would be acquired from the City of Augusta's Land Bank Authority. Cherrytree Crossing GA001002 Demolition/Disposition January, 2013 June, 2013 389 Total development March, 2014 December 2018 Augusta Housing Authority 5- Year /Annual Plans 2013 -2017 Augusta Housing Authority 5- Year /Annual Plans 2013 -2017 Marion Homes Marion Homes is an older subdivision in East Augusta and is located adjacent to Walton Oaks, a mixed income rental complex being developed by The Housing Authority. Walton Oaks is being developed in four phases with Low Income Housing Tax Credits (LIHTC) issued by the Georgia Department of Community Affairs (DCA). The first two phases have been awarded and an application for the third year funding will be submitted in 2012. The LIHTC award is a competitive process based upon a graded criterion in which points are added or subtracted based on the activities that are present in and around the community site. Several properties in Marion Homes have been identified by the Augusta - Richmond County Government that are in a state of disrepair and are scheduled for demolition. Due to the current economic conditions, the Augusta - Richmond County lacks funds to perform the demolition. We are currently preparing a MOU with the Augusta, Georgia Land Bank Authority to pay up to $50,000 for the demolition of dilapidated structures in Marion Homes to increase our point rating for the award of 2012 LIHTC for the third phase. Energy Audit Energy audit for all sites performed by Siemens 1.2.1 FIM 1: Lighting Upgrade Scope of Work: Re -lamp existing fixtures with 15W compact fluorescent lamps in the kitchens, living rooms, bathrooms, bedrooms, hallways, storage /utility rooms and porches locations as applicable, per submittal package approval. Elevator upgrades • Hal Powell Modernization (GA001009): The 100 unit senior high rise is planned for a total modernization work to begin in 2013 utilizing capital funds in addition to proposed elevator upgrades. • M.M. Scott (GA001012): The 100 unit development, including senior mid -rise, is planned for replacement of all exterior doors and hardware in addition to proposed elevator upgrades. • Barton Village (GA001014): The 150 unit scattered site single family site is planned for: total window replacements, re- roofmg, HVAC improvements, exterior repairs, bathroom and kitchen renovations. • Overlook Apartments (GA001016): The 76 unit development is planned for total window replacements. Site work improvements to include retaining walls. Conversion of Public Housing N/A Augusta Housing Authority 5- Year /Annual Plans 2013 -2017 Section 8(y) Homeownership Program [24 CFR Part 903.12(b), 903.7(k)(1)(i)] The AHA's homeownership program is designed to promote and support homeownership for first -time homebuyers and allows one of more family members to purchase a home. The program permits participants who meet the general requirements for admission into the AHA's Section 8 Housing Choice Voucher Program and satisfy additional requirements, as further described in Chapter 19 of the Administrative Plan, the option of purchasing a home with their assistance rather than renting. Participation is voluntary. Project -Based Vouchers The Augusta Housing Authority will operate a PBV program using up to 20 percent of its budget authority for the project based assistance. Additional details are described in Chapter 21 of the Administrative Plan. 10 This program is consistent with the statement of needs of families on its waiting list. Developments are identified in the annual and 5 -year capital plans where such improvements will be made and how the proceeds of the financing will be used and the amount of the annual payments required to service the debt. AHA plans to address capital improvement needs as outlined in the comprehensive Physical Needs Assessment (see attached) for each public housing property. The Augusta Housing Authority continued to offer higher income public housing households units at lower income developments through promotion of the rent determination polices, in addition, AHA continued to promote income mixing in public housing by assuring access for lower income families into higher income developments. 3. The 7 Annual Plan is consistent with the Augusta - Richmond county Consolidated Plan. Therefore, the Housing Authority will continue to provide rental housing, 10 housing assistance and home ownership opportunities 11 for extremely low income and moderately low income 12 families within our jurisdiction. 13 To accomplish this goal, the Housing Authority 14 will give a preference to Section 8 families who are 15 homeless or living in substandard housing, rent 16 burden, or involuntarily displaced 17 In order to bring higher income families into 18 the public housing program, the Housing Authority 19 will open the waiting list and give preferences to 20 "working" families, where the head, spouse, co -head, 21 or sole member is employed at least 20 hours per 22 week. Preferences will be given to families who are 23 homeless or have been involuntarily displaced by 24 government action. MCGEE: Thank you. My name is Annette 9 McGee. I'm president at Peabody. My written 10 comments were for when the work -- when they started 11 doing the work mainly is first of all, flooding in 12 the front of our building. I'm hoping that when they 13 start working on the front, something can be worked 14 out where we don't have standing water out there 15 because we have enough mosquitoes in the back; we 16 don't need them in the front and talk of West Nile is 17 scaring everyone from sitting out in the front 18 because you don't know what you're getting bitten by. 19 Well, if you're attending the front, I know 20 you're going to retire the US flag because there was 21 a tear in it and I had suggested that -- to be 22 retired and a new one put up but I'll wait until you 23 move the flag pole. 24 One of the basic concerns we're going to have 25 while you're doing the work is we need more human Augusta West /Culpepper Reporting (706) 722 -3746 2603 Commons Blvd., Suite B, Augusta, GA 30909 www.huseby.com Page 6 1 security; especially at night and on weekends. If 2 anything is going to be opened, we can't control 3 who's gonna be coming in and out and we're already 4 having enough trouble with other people coming into 5 our building uninvited. We have new residents that 6 are giving their fobs to other people to get into the 7 building and then walking around the building so, we 8 won't know who's a resident and who's not after a 9 while. 10 We need more pest control because we have a new 11 infestation that is taking over the building and we 12 need pest control like on a regular basis; that's 13 what I'm thinking, that will keep that under control. 14 There used to be a time I could set a glass down in 15 my apartment of water by the bed and wake up during 16 the night, take my medicine and wash it down. I 17 don't do that anymore for very good reasons. I don't 18 know; I may pick that glass up and something has beat 19 me to water. 20 Bicycle racks with chains so that people don't 21 be bringing their bikes in and tracking the floors. 22 As soon as the people, janitorial clean up, they 23 bring bikes in and they bring grass and dirt and 24 there's a trail -- you could follow it all the way to 25 the elevator and almost up to the person's apartment. We talked about that already, so -- and if 3 there's gonna be one in the back, that grass back 4 there needs to be cut down because it stays too high. 5 To upgrade the computers and we need a label 6 that specifies: For residents only - no exceptions 7 allowed because there is so much going on about the 8 computer room and, like I say, residents are giving 9 their fobs to other people and to young people and 10 they come down in the computer room and they're on 11 the computer and every now and then they're kind of 12 indignant if you ask them if they would let you get 13 on the computer; so we would like it if there is no 14 exceptions to the rule; just the residents. So I said, well, you know, if you can't come to the back, you might as well have to kick it in so he kicked the door in so we can get in the front, come out the front and he said that's a fire hazard and I said yeah, but I've been telling them about it and every time they come and fix it, they charge me for it, so -- and then, like, you know, other things -- infestation is not the problem, it's just like the wooded things that come from the trees like the bark, it creates a lot of roaches -- big roaches, the flying biting ones and so it's very unsafe to, like, leave your door open in the summertime because you have to watch what come in out the door, that's all. I just have a few comments and I want to 12 thank Ms. Roberson for giving me the material that I 13 requested that I haven't had a chance to go through 14 all of. 15 One of our -- one of the type cases that we 16 handle most often, especially in the Augusta area, is 17 housing areas, housing cases. Most of them are 18 public housing or subsidized housing so we -- at 19 least a third if not more than that of our clients 20 are subsidized and public housing clients so my 21 concern is that with the demolition of the public 22 housing units, that there -- that I would like to 23 make sure that there is replacement housing. 24 I know you talked about Section 8 housing. 25 Sometimes that's not the best fit for our clients. www.huseby.com Augusta West /Culpepper Reporting (706) 722 -3746 2603 Commons Blvd., Suite B, Augusta, GA 30909 Page 11 www.huseby.com AUGUSTA HOUSING AUTHORITY Public Hearing on 09/27/2012 1 They have to choose which type of housing they want 2 to live in but I am concerned about the public 3 housing units being demolished and there's already a 4 waiting list and no place for those people to go 5 sometimes but on a Section 8 voucher. 6 Now, I certainly applaud the goal to de- 7 centralize poverty and to have mixed - income 8 neighborhoods, but I would like to see a percentage 9 of public housing tenants increased in those housing. 10 Now, I know we don't want to make another housing 11 project, but I do want those tenants to have the 12 opportunity to live in the environment. Right now, 13 from my opinion, is that the percentage is, in my 14 opinion, it's too low. I would like to give those 15 public housing residents an opportunity to live in 16 those residences, too and that there be some 17 immediate plan for substitute housing if the 18 developments are going to be demolished rather than 19 having the tenants to linger; not to know exactly 20 what they want to do, so that's what they have to do. 21 So those are my concerns: to increase the actual 22 housing units and I think Section 8 is good, but I 23 think the actual housing units maintained by the 24 public housing is -- that we all see clients that 25 have problems. We are 6 -- of course, you know what we are doing at Wilson 7 Oaks where there will be some public housing units. 8 We're also getting under way with the Twiggs Circle 9 project which we hope to have a ground- breaking with 10 that in the next few months where we will be building 11 back specifically public housing units. 12 We anticipate there being somewhere between 100 13 and 120 brand new units that will be public housing 14 units but even though we tore down, say, 250 units at 15 Underwood Homes, we're building back 300 units there 16 even though they're all not public housing, they are 17 for low and moderate - income families and also we tore 18 down those units, we got 250 vouchers for the 19 government to help 250 families so ultimately we're 20 helping more families than we were helping prior to 21 us demolishing either Gilbert Manor or Underwood 22 Homes so we are concerned about that. We're going to put up some 6 permanent signs in there for them to, you know, not 7 be messing with stuff in there, those controls and 8 the TV but they're constantly doing that and the 9 issue -- you know, people that go in there have to 10 have a fob and, you know, if we've got problems going 11 on in there, particularly like the computer rooms, if 12 you see there's a child in there or somebody that's 13 not supposed to be in there, if you can alert the 14 housing manager the time that that happened, we can 15 go back and tell who used the fob to go in there so 16 if a grandchild used that little key to go in there 17 to those computers, we can pinpoint that and there 18 are cameras that show who goes in and out, as well, 19 so those type of issues we can address with y'all 20 separately but we can certainly address those things. 21 I know it's an issue because I see it because I go 22 over there, you know, sometimes before I start 23 working or during lunch or whatever and exercise 24 myself so I see that there are issues over there and 25 we can address them, certainly. www.huseby.com Augusta West /Culpepper Reporting (706) 722 -3746 2603 Commons Blvd., Suite B, Augusta, GA 30909 Page 15 AUGUSTA HOUSING AUTHORITY Public Hearing on 09/27/2012 MR.
