1. Augusta Regional Airport at Bush Field (KAGS /AGS), hereinafter called "Borrower ", is
requesting the loan of a McDonnell Douglas F -15 Eagle aircraft for static display adjacent
to the airport's industrial park.
2. Eligibility /Qualification. Borrower is a department of Augusta Richmond County
(Augusta Georgia). Augusta Georgia is a county government of the State of Georgia.
Borrower is a commercial service public airport owned and operated by Augusta Georgia
through the Augusta Aviation Commission. See attached files.
3. Proof of Incorporation. Augusta Georgia, as a political subdivision of the State of
Georgia, acts through the Augusta Aviation Commission, to operate Augusta Regional
Airport. In 1996, the City of Augusta and Richmond County were consolidated into a
single government under the direction of a Commission - Council. 1995 Georgia Laws 3648;
1996 Georgia Laws CCCXXXIX. Attached is a copy of the Charter provisions creating the
consolidated government.
4. As part of its duties and responsibilities, the consolidated government owns and operates
the Augusta Regional Airport at Bush Field. The Commission - Council chose to delegate its
operational control of Bush Field to the Augusta Aviation Commission, a county agency or
entity created by ordinance and act of the Commission - Council, Ordinance § 1 -3 -1 et seq.
The Airport Executive Director is a department Director, however, he is hired by and
reports to the Augusta Aviation Commission (Aviation Commission).
a. The Aviation Commission functionally operates independently of the
consolidated government Commission - Council. Ordinance § 1 -3 -5. It has taken
charge of Bush Field and all property incidentals to the operation of the airport
and is authorized to enter into contracts with commercial airlines and other
aircraft operators for the use of the airport. This power to contract includes
entering into contracts with the federal government for airmail and other services.
The Aviation Commission may also enter into other revenue producing operations
at the airport.
b. It is the mission of Augusta Regional Airport to be a pre- eminent source of air
travel to our flying public by providing reliable quality services, competitive fares
and courteous and helpful staff in a safe secure environment. Further, it is the
Airport's duty to provide cost effective, high value full service airport facilities
which will enhance the economic well -being and quality of life in the Central
Savannah River Area (CSRA) and establish Augusta Regional Airport as one of
the premiere airport facilities in the country.
5. Proposed Use and Display Location. To fulfill its mission, the Augusta Regional Airport
is committed to the following goals:
• Foster economic growth; provide leadership and incentive for development at the
airport and within the CSRA Region.
• Promote Community Partnerships through close business fellowship.
• Support commercial air carrier and new route development at AGS.
• Maintain financial self sufficiency and enhance revenue production through new and
sustainable lines of business.
• Insure that the Airport's leadership and organization is aligned and structured to
support best management practice standards of the industry.
• Conduct strategic planning initiatives to insure that the Augusta Regional Airport is
always positioned for change and growth.
To provide additional opportunities for development of the CSRA and the Airport,
Borrower is developing an industrial park inside the Airport's boundaries. The entryway to
the industrial park is the General Perry Smith Parkway. General Smith is a command pilot
with over 3,500 hours in fighter aircraft including the F -15 Eagle. He is a local resident
who is involved in many local activities. The Airport plans to display the F -15 Eagle
adjacent to the parkway. Parkway construction has been awarded and construction will
begin in November 2012. The static display location is part of the parkway construction.
6. Funding and Cost. Borrower acknowledges that it is responsible for and will pay all
costs, charges and expenses related incident to the loan of this property, including the cost
of preparation, demilitarization, hazardous material removal, disassembly, packing, crating,
handling, transportation, and all other actions incidental to the movement and set up of
loaned property to the Borrower's location. Further, Borrower understands that it will bear
continuing monetary responsibilities to include insurance coverage, significant
maintenance cost that include periodic painting, repair of damage, and day -to -day care as
per the terms of the Loan Agreement. Augusta Georgia is self - insured, however the
Aviation Commission purchases additional insurance to insure the buildings and property
at the Airport. A copy of the commercial insurance policy is attached hereto.

7. Photographs of the Proposed Site. As stated above, proposed site is under construction.
Parkway completion is scheduled for spring 2013. Architectural drawing of parkway and
site are attached.
8. Proof of Insurance. Borrower agrees to provide proof of insurance to cover the repair or
replacement of any loaned property. Proof of insurance and any renewals will be forwarded
to the National Museum of the United States Air Force (NMUSAF). Borrower understands
that it will bear full financial liability for the loss or damage of any loaned property
resulting from negligence, misconduct, or willful violation of the loan terms. Should loaned
property incur catastrophic damage as a result of circumstances beyond the Borrower's
control, (i.e. tornado, hurricane, flood, etc.) the Borrower will be responsible for all cleanup
and removal to the location designated by the NMUSAF.
9. Loan Agreement. Borrower agrees with detailed responsibilities and care requirements as
identified in the sample loan agreement with attachments.
10. Failure to Maintain Standards. Borrower understands that if it fails to observe any of the
conditions set forth in the Loan Agreement and Attachments 1, 2 and 3 shall be sufficient
cause for the lender to repossess the loaned property. Repossession of all or any part of the
loaned property by the Lender shall be made at no cost or expense to the Government; the
Borrower shall defray all demilitarization, maintenance, freight, storage, crating, handling,
transportation and other charges attributable to such repossession.
11. Augusta Regional Airport has a proud and extensive military history. Airport was
originally Bush Field a US Army flight training base. Currently Fort Gordon is located in
Augusta. The F -15 Eagle static display will enhance the communities pride in the military
community and demonstrate our continued support. Our goal is fully in agreement with
your purpose "...in fostering a deeper appreciation and interest in aerospace history,
education, and technology as well as memorializing the accomplishments of American
Airmen."

Hereby certifies that the foregoing is a true and correct copy of § 1- 27Augusta- Richmond

§ 1 -26 AUGUSTA- RICHMOND COUNTY CODE. READOPTED 7 -10 -2007
Sec. 1 -26. Malpractice in office.
Any elected county officer, including the judge
of the probate court, clerk of the superior court,
tax receiver, tax collector, and tax commissioner,
where the office has replaced the tax receiver and
tax collector, any member of any board of commis-
sioners, or any mayor or member of any municipal
governing authority, presently or formerly hold-
ing such office, who shall be charged with mal-
practice, misfeasance, or malfeasance in office; or
with using oppression or tyrannical partiality in
the administration or under the color of his office;
or, when required by law, with willfully refusing
or failing to preside in or hold his court at the
regular terms thereof, or when it is his duty under
the law to do so; or with using any other deliber-
ate or illegal means to delay or avoid the due
course or proceeding of law; or with any other
illegal conduct in the performance or administra-
tion of the office which is unbecoming the charac-
ter of a public officer; or who shall willfully and
knowingly demand more cost than he is entitled
to by law in the administration and under color of
his office my be indicted. The indictment shall
specially set forth the merits of the complaint
against the accused public officer. A copy of the
indictment shall be served on the accused public
officer at least 15 days before it is presented to the
grand jury. The accused shall have the right to
appear before the grand jury to make such sworn
statement as he shall desire at the conclusion to
the presentation of the state's evidence. The ac-
cused shall not be subject to examination, either
direct or cross, and shall not have the right
individually or through his counsel to examine
the state's witnesses. The accused and his counsel
shall have the right to be present during the
presentation of all evidence and alleged state-
ments of the accused on the proposed indictment,
presentment, or accusation, after which he and
his counsel shall retire instanter from the grand
jury room to permit the grand jury to deliberate
upon the indictment. If a true bill is returned by
the grand jury, the indictment shall, as in other
cases, be published in open court and shall be
placed on the superior court criminal docket of
cases to be tried by a petit jury. If the accused is
convicted, he shall be punished by a fine or by
imprisonment, or both, at the discretion of the
court; and if still in office, he shall be removed

ARTICLE 5. CHARTER
Sec. 1-27. Augusta - Richmond County Com-
mission; creation; powers.
The governing authority of Richmond County
shall be a board of commissioners of said county.
Said board is designated as the Augusta -Rich-
mond County Commission, referred to in this Act
as the Commission. The chief executive officer of
said board is designated and referred to in this
Act as the Mayor and the other members of said
board are designated and referred to in this Act as
commissioners. The board shall consist of a Mayor
and ten commissioners. The Commission shall
exercise and be subject to all of the rights, powers,
duties, and obligations imposed by this Act or
previously applicable to the governing authorities
of the City of Augusta and Richmond County, and
the City of Hephzibah if consolidated with the
government of Richmond County as authorized by
this Act, and to any general laws, local law, or
constitutional provisions applicable or effective
within the former City of Augusta, the former
City of Hephzibah if consolidated with the gov-
ernment of Richmond County as authorized by
this Act, and Richmond County. The Commission
shall constitute a county as well as a municipality
for the purpose of the application of the general
laws and Constitution of this state. The consoli-
dated government shall have a municipal form of
government. The Commission may exercise the
powers vested in the governing authority of the
municipality or municipalities and municipalities
generally as well as the powers vested in the
former governing authority of the county and
counties generally. Said county -wide government
shall be a new political entity, a body politic and
corporate, and a political subdivision of the state
to be known as 'Augusta, Georgia,' at times in this
Act called the 'consolidated government' or 'Au-
gusta- Richmond County,' having all the govern-
mental and corporate powers, duties, and func-
tions hereto fore held by and vested in the City of
Augusta and Richmond County, and also the
powers, duties, and functions provided in this
