RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS
BY BEATRICE MAXWELL IN THE AGGREGATE AMOUNT OF FIFTY
TWO THOUSAND FIVE HUNDRED DOLLARS ($52,500);
AUTHORIZING THE GEORGIA ADMINISTRATIVE SERVICES, INC.
TO DISBURSE THE AMOUNT OF FIFTY TWO THOUSAND FIVE
HUNDRED DOLLARS ($52,500); WAIVING AUGUSTA, GEORGIA
CODE OF ORDINANCES SECTIONS IN CONFLICT FOR THIS
INSTANCE ONLY; AND FOR OTHER PURPOSES.
WHEREAS, Beatrice Maxwell, a former employee of Augusta, has two pending
Workers' Compensation claims arising out of the job injuries in 2006 and 2007;
WHEREAS, all parties to said Workers' Compensation proceedings desire to settle all
claims; and
WHEREAS, Claimant has agreed to settle all claims against Augusta and the Augusta -
Richmond County Commission for the sum of fifty two thousand five hundred dollars ($52,500);
WHEREAS, it is in the best interests of Augusta, Georgia to resolve this matter and pay
the amount of fifty two thousand five hundred dollars ($52,500) to Claimant as set out above to
settle all claims of Claimant against Augusta, Georgia arising out of the facts in said Workers'
Compensation claims:
Section 1:
On October 18, 2006, Claimant suffered an on the job injury in
which she injured her lower back and right knee, which knee injury
necessitated surgery and resulted in permanent disability to
Claimant. On April 19, 2010, Claimant suffered an additional on
the job injury in which she injured her shoulder resulting in two
shoulder surgeries and further permanent impairment. Both on the
job injuries require Augusta - Richmond County to provide
permanent disability benefits as well as ongoing medical treatment
for Claimant's on the job injuries and resulting conditions.
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia and liability is expressly
denied;
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission,
The Augusta, Georgia Commission will settle the claims of Beatrice
Maxwell for the aggregate amount of fifty two thousand five hundred
dollars ($52,500).
Section 2: The third party administrator for Augusta, Georgia Administrative
Services, Inc. is authorized to pay the total sum of fifty two thousand five

Section 3: To the extent that any section of the AUGUSTA, GA. CODE is in conflict
herewith, that subsection is waived for this instance only.

The undersigned Clerk of Commission, Lena J. Bonner, hereby certifies that the
foregoing Resolution was duly adopted by the Augusta, Georgia Commission
on Gt ' 7 , 2012 and that such Resolution has not been modified or rescinded as
of the dat' hereof and the undersigned further certifies that attached hereto is a true copy of the
Resolution which was approved and adopted in the foregoing meeting(s).
