THIS CONVEYANCE made and executed the { day of J 1 , 2012.
WITNESSETH that Eka Chemicals, Inc. f /k/a EKA Nobel, Inc. , the undersigned, is the owner of a tract
of land in RICHMOND COUNTY, through which Marvin Griffin Road , known as Marvin Griffin Road
Improvement Project has been laid out by Hussey, Gay, Bell & Deyoung, Inc., being more particularly described
in a map and drawing of said project in the Augusta Engineering office, to which reference is hereby made.
NOW, THEREFORE, in consideration of the benefit to said property by the construction and maintenance
of said project, and in consideration of ONE DOLLAR ($1.00), in hand paid, the receipt whereof is hereby
acknowledged, I do hereby grant, sell and convey to Augusta, Georgia, a political subdivision of the State of
Georgia, and their successors in office, so much land as to make a right -of -way for said project as surveyed.
SAID right -of -way is more fully described on Exhibit A, hereto attached and made a part hereof.
TO HAVE AND TO HOLD the said conveyed 10,573 sq. ft. of right of way in fee simple.
IN WITNESS THEREOF, the undersigned has caused this instrument to be executed by its duly authorized
officers and its seal affixed, the day and year above written.

All those certain lots, tracts, or parcels of land, situate, lying and being in the Eighty Sixth
G.M. District, City of Augusta, Richmond County, Georgia and known as Required
Additional Right Of Way and Easements for Marvin Griffin Road from lands of Eka
Chemical, Inc. f/k/a EKA Nobel, Inc. (TMS 134 -0 -007), being more particularly described
as follows:

BEGINNING at the point of intersection of the existing southern right of way line of
Marvin Griffin Road and the common property line of lands of Eka Chemical, Inc. f/k/a
EKA Nobel, Inc. (TMS 134 -0 -007) and Proctor & Gamble, The Manufacturing Company
(TMS 134 -0 -005) ; thence extend North 79 degrees 07 minutes 50 seconds East, along the
existing southern right of way line of Marvin Griffin Road, a distance of 537.76 feet to a
point marked by a 1" pipe at the common property line of lands of Eka Chemical, Inc. f/k/a
EKA Nobel, Inc. (TMS 134 -0 -007) and; Solutia, Inc. (TMS 134 -0 -008); thence leave the
existing southern right of way line of Marvin Griffin Road and extend South 14 degrees 14
minutes 43 seconds East, along said common property line, a distance of 19.57 feet to a
point; thence extend South 78 degrees 59 minutes 54 seconds West, a distance of 27.46 feet
to a point; thence extend South 78 degrees 58 minutes 51 seconds West, a distance of
55.75 feet to a point; thence extend South 79 degrees 09 minutes 14 seconds West, a
distance of 455.11 feet to a point on the common property line of lands of Eka Chemical,

(TMS 134 -0 -005); thence extend South 12 degrees 36 minutes 19 seconds East, along said
common property line, a distance of 19.57 feet to a point: thence extend North 79 degrees
09 minutes 14 seconds East, a distance of 105.63 feet to a point, which point is the POINT
OF BEGINNING of the hereinafter described property; thence continue North 79 degrees
09 minutes 14 seconds East, a distance of 90.00 feet to a point; thence extend South 10
degrees 50 minutes 38 seconds East, a distance of 40.00 feet to a point; thence extend
South 79 degrees 09 minutes 14 seconds West, a distance of 90.00 feet to a point: thence
extend North 10 degrees 50 minutes 38 seconds West, a distance of 40.00 feet to the
POINT OF BEGINNING.
Said temporary easement shall terminate at the earlier of the acceptance of the road
improvements by the Augusta, Georgia Planning and Development Department or thirty
six (36) months from the date of this instrument.
The above described conveyances being more particularly shown on a drawing of the
property prepared by Hussey, Gay, Bell & Deyoung, Inc. dated September 14, 2007,
attached hereto and made a part of this description.
