HomeMy WebLinkAboutOWNERS AFFIDAVIT SOUTHEASTERN PARALIZED VETERANS OF AMERICA INCSTATE OF GEORGIA COUNTY OF RICHMOND OWNER'S AFFIDAVIT Personally appeared before me, the undersigned attesting officer, duly authorized by law to administer oaths, Homer Cole, who being first duly sworn, deposes and upon oath states: That Deponent is the President of SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f /k/a Georgia Carolina Paralyzed Veterans Association, Inc., a Georgia corporation, which is the owner in fee simple of the property described on Exhibit A hereto attached and by reference made a part hereof. Deponent further states that all of the improvements located on the Subject Property are within the limits of the Subject Property, that the lines and corners of the Subject Property are clearly marked, and the Deponent has no knowledge of any dispute or controversy as to said lines or corners. Deponent further states that there has been no violation of any restrictive covenants imposed on the Subject Property. Deponent further states that SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f/k/a Georgia Carolina Paralyzed Veterans Association, Inc., is in indisputable possession of the Subject Property, that SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f/k/a Georgia Carolina Paralyzed Veterans Association, Inc., has not sold or conveyed the Subject Property, or any interest therein, to any party whatsoever, and Deponent knows of no one claiming under any un- recorded deed, lease or instrument of any nature or claiming any interest in the Subject property whatsoever, except as set forth below. Deponent further states that there are no suits, judgments, bankruptcies or executions of any kind pending against SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f/k/a Georgia Carolina Paralyzed Veterans Association, Inc. in any court whatsoever that could in any way affect the title to Subject Property or constitute a lien thereon, and that SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f/k/a Georgia Carolina Paralyzed Veterans Association, Inc. is not a surety on the bond of any county or county official, nor is SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f /k/a Georgia Carolina Paralyzed Veterans Association, Inc., a surety under any other bond that upon a default of the principal therein, a lien would be created superior to the deed to Augusta, Georgia of even date herewith, nor are there any Security Deeds, Deeds to Secure Debt, Trust Deeds, Mortgages, Loan Deeds or liens of any nature whatsoever unsatisfied against the Subject Property, except as set forth below. Deponent further states that no labor, material or services have been furnished to or for the improvement of the Subject Property by any third person or entity during the three -month period immediately preceding the date of this affidavit; OR, if improvements or repairs have been erected or performed during said three -month period, the improvements or repairs were furnished or performed at owner's instance, have been fully completed, and the agreed upon price or reasonable value of said labor, material or service has been paid in full or has been waived in writing by the person or entity so furnishing or providing same. Deponent further states that SOUTHEASTERN PARALYZED VETERANS OF AMERICA, INC. f/k/a Georgia Carolina Paralyzed Veterans Association, Inc., is duly organized and authorized to do business and is in good standing with the Secretary of State of the state of its incorporation and the Sate of Georgia. Deponent further states that this Affidavit is given for the purpose of inducing Augusta, Georgia to purchase the Subject Property. Deponent further states that the Subject Property is free and clear of all liens of every character, except the following which are the only liens encumbering the Subject Property to wit: Judgments, security deeds, deeds to secure debt, trust deeds, mortgages, ad valorem taxes, water bills, sanitary assessments, and any other liens or encumbrances, if any on the Subject Property which are to be paid and satisfied from the proceeds, as reflected on the Settlement Statement of even date herewith. B As Its: President Exhibit A All that parcel or tract of land being located in Augusta - Richmond County, Georgia, beginning at a concrete marker on the western right -of -way of Willis Foreman Road and traveling N88 °02'03 "W for a distance of 200.72 feet to a #4 rebar, thence turning and traveling N01 °57'57 "E for a distance of 100.00 feet to a #4 rebar, thence turning and traveling S88 °02'03 "E for a distance of 123.76 feet to a #4 rebar, thence turning and traveling S35 °36'56 "E for a distance of 126.18 feet back to the point of beginning. Said parcel is shown as "Parcel B ", on a plat prepared by George L. Godman & Associates, dated January 18, 2012, a copy of said plat is attached hereto and made a part hereof, to which reference is made for a more accurate and complete description of the metes, bounds and courses. Also, 5,224 square feet of temporary construction easement, as shown on said plat. Said temporary easement will revert to Owner, upon the completion, testing and acceptance of the public sanitary sewer, by Augusta, which will be constructed in conjunction with this project.
