HomeMy WebLinkAboutMARKO INVESTMENT SALES OPTION (PROJECT ICU-0068 FORT GORDON GATE 4 WATER MAIN AND PUMPING STATIONAUGUSTA, GEORGIA SALES OPTION PROJECT: ICU-0068 Fort Gordon Gate 4 Water Main and Pumping Station Augusta Utilities Department PARCEL IDENTIFICATION NUMBER: 138 -0- 006 -00 -0 ADDRESS: 4002 Deans Bridge Road THIS INDENTURE made and entered into this 6 day of _ ► 2012, between MARKO INVESTMENT CO., INC., formerly known as K & W Investment Co., Inc., a company established under the laws of the State of Georgia, hereinafter referred to as OWNER, and AUGUSTA, GEORGIA, a political subdivision under the laws of Georgia, hereinafter referred to as AUGUSTA; WITNESSETH, that OWNER, for and in consideration of ONE DOLLAR ($1.00), the receipt whereof is hereby acknowledged, and in consideration of the benefits derived by said OWNER from the proposed Project mentioned herein, OWNER agrees to be bound, and to bind their successors, representatives, assigns and heirs as follows: If AUGUSTA shall, within one hundred and twenty (120) days from the date first written above, pay the sum of $12, 000.00,, the OWNER agrees to execute and deliver to AUGUSTA parcel, or tact, of property, in fee simple, described as: All that parcel, or tract, of land being located in Augusta- Richmond County, Georgia, beginning at a #4 rebar marker on the western right -of -way of Willis Foreman Road and traveling S16 °042'45"W for a distance of 103.11 feet to a concrete marker, thence turning and traveling N35 °36'56"W for a distance of 126.18 feet to a #4 rebar, thence turning and traveling N88 °02'03 "E for a distance of 102.10 feet back to the point of beginning. Said parcel is shown as "Parcel A ", on a plat prepared by George L. Godman & Associates, dated September 19, 2011, attached hereto and made a part hereof, to which reference is made for a more accurate and complete description of the metes, bounds and courses. Said parcel is a portion of that parcel conveyed by Fast Fare, Inc. to K & W Investment Co., Inc., by indenture dated January 20, 2004, and recorded January 29, 2004, on Realty Reel 909, Pages 2321 -2322, in the Office of the Clerk of Superior Court, Richmond County, Georgia. ALSO, 4,576 square feet of temporary construction easement, as shown on said plat. AUGUSTA does agree that, in addition to the sum written above, it will decommission the septic tank of the convenience store, which is located on the parcel known asl 38-0-006-00-0/4002 Deans Bridge Road, and connect the store into the public sanitary sewer system, which will be constructed in conjunction with the Gate 4 project. Decommission will include pumping and filling the septic tank, installing the private service line between the store and the lateral line, and connecting the service line to the lateral line. This will be done at the sole cost and expense of AUGUSTA. And no agreement that would adversely affect these rights has been, or will be, made within the option period. written.
