appeared P. Mike Clanton ( "Affiant ") who, being duly sworn,
deposed and said on oath that:
1. Affiant is the Vice President -Land of Georgia Power
Company ( "Seller "), is fully and personally familiar
with the matters set forth herein, and has the
authority to give this Affidavit.
2. Seller is conveying to City of Augusta, Georgia
( "Purchaser ") Seller's interest, if any, in the real
property containing 1,970 square feet, more or less,
together with a temporary construction easement, less
and except the Reserved Rights, all as described in the
Quitclaim Deed from Seller to Purchaser dated on or
about even date herewith (the "Property ").
3. Seller has not entered into any agreement, written or
oral, with any commercial real estate broker with
respect to the Property for the payment of a real
estate commission or fee relating to the purchase,
sale, management, leasing or other licensed services
pertaining to Commercial Real Estate (as defined in
O.C.G.A. § 44 -14- 601(3)).
This Affidavit is given to induce Purchaser to purchase the
Property and a title insurance company to permit a policy or
policies of title insurance to be issued without exception for
any possible lien against the Property arising from the
Commercial Real Estate Broker Lien Act (O.C.G.A. § 44 -14 -600, et
seq.).
