RESOLUTION
RESOLUTION AUTHORIZING THE SETTLEMENT OF
SUBROGATION CLAIM NUMBER 038094355-0101-019 BY GEICO
INSURANCE COMPANY, RELATED TO THE DAMAGE OF PERSONAL
PROPERTY OWNED BY DEREK M. SNEAD, IN THE AGGREGATE
AMOUNT OF NINE THOUSAND SIX HUNDRED FORTY SEVEN
DOLLARS AND FORTY SEVEN CENTS ($9,647.47); AUTHORIZING
THE ADMINISTRATOR TO DISBURSE THIS AMOUNT; AND FOR THE
OTHER PURPOSES PROVIDED IN THIS RESOLUTION.
WHEREAS, On or about June 15, 2011 during a significant rain and wind storm a large
tree limb fell from a tree located in the Augusta, Georgia right-of-way; and
WHEREAS, said tree limb fell on policyholder Derek M. Snead's 2007 Chevy Tahoe
parked at 1405 Glenn Avenue; and
WHEREAS, Derek M. Snead filed a claim with GEICO INSURANCE COMPANY
(hereinafter "GEICO") for the damage to his vehicle; and
WHEREAS, GEICO paid to repair the vehicle owned by its policyholder, Derek M.
Snead: and
WHEREAS, GEICO is seeking reimbursement for these costs in the farm of a
Subrogation Claim; and
WHEREAS, GEICO has agreed to settle its Subrogation Claim number 038094355-
0101-019 against Augusta, Georgia for the sum of Nine Thousand Six Hundred Forty Seven
Dollars and Forty Seven Cents ($9,647.47); and
� WHEREAS, it is in the best interes�s of Augusta to resolve this matter and pay the
amount of Nine Thousand Six Hundred Forty Seven Dollars and Forty Seven Cents ($9,647.47)
to GEICO to settle Subrogation Claim number 038094355-0101-019 of GEICO against Augusta,
Georgia, arising out of the alleged facts; and
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia and liability is expressly
denied;
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Commission,
Section l: The Augusta, Georgia Commission will settle Subrogation Claim number
038094355-0101-019 of GEICO for the sum of Nine Thousand Six
Hundred Forty Seven Dollars and Forty Seven Cents ($9,647.47) and shall
be taken from account number 611015213-5523101. �

Section 2: The Administrator is authorized to pay a total sum of One Nine Thousand
Six Hundred Forty Seven Dollars and Forty Seven Cents ($9,647.47) to
GEICO at the direction of the Commission and payment shall be in the
form of a check payable to "THE LAW OFFICE OF MICHAEL W.
MILLIANS, on behalf of GEICO INSURANCE COMPANY."
Section 3: To the extent that any section of the AuGUSTA, GA. CoDE is in conflict
herewith, that subsection is waived for this instance only.
