This First Amendment to the Contract executed by and between the Parties on January i, 2oZZ, is made and entered into on the 4� day of October 2011, by and between AUGITSTA, GEORGIA, (hereinafter referred to as "GRANTEE"), and AUGUSTA 1VII�TI THEATRE, INC., (hereinafter referred to as "SUBRECIPIENT"). WHEREAS, GR.ANrEE desires to amend the ORIGINAL CONTRACT to allow additional funds to assist with expending Year 2009 reprogrammed funds: WHEREAS, GRANTEE has determined that this amendment is in its best interest and , SUBRECIPIENT agrees to said amendment; NOW THEREFORE, it is mutually understood and agreed by and between the undersigned contracting parties to amend the previously executed agreement as follows: ( Article III. PROJECT, Paragraph i, is hereby deleted in its entirety and changed to read: "The Grantee agrees to reimburse the Subrecipient in an amount not to exceed Eighteen Thousand and Five I�undred and �'ive Dollars and Seventy Six cents ($i8,so5.�6) (hereinafter the "Grant') to fmpleraent the foilowing project(s): "Artisiic Program". � E�ibit A, Paragraph III, BUDGET, is hereby deleted in its entirery and changed to read: Line Item Amount Sa1a (Artistic Drama Instructors) $9,i28•Q7 Utiltties (Water/Electrical) �9,377• Total $i8,5o5.�6 Any amendments to the budget must be in writing and approved by the Grantee's Ih'rector of Housing and Community Development Department. ExhibitA, Paragraph IV, PAYMENT, is hereby deleted in zts entirety and changed to reQd: It zs expressly agreed and understood that the totai amount to be paid by the Grantee under this Agreement shall not exceed $YS,�o�.76. Drawdowns for the payment of eligible expenses sha11 be made against the tine item budgets specified in Paragraph III herein and in accordance with performance. Expenses for general administration sha11 also be paid against the iine item budgets specified in Paragraph III and in accordance with performance. Subrecipient is also responszble for submitting to the Grantee, monthly progress reports, time sheets (if applieable), mileage (if applicable), invoices, and any other documentation deemed necessary by the monitoring official during the funding cycie. These records shall be retained up to fcve (5) years after the Agreement expires. AII other provisions of CONTRACT between said PARTIES shall remain in full force and effect.
