Franklin and Cynthia Franklin to Augusta, Georgia, dated December 6, 2010, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 1289, Pages 0099-0105, said easement being shown as "Easement 3" on a plat prepared by Cranston Engineering Group, P. C., dated April 20, 2004, revised April 29, 2004, June 1, 1010, and November 22, 2010, attached hereto and made a part hereof, to which reference is made for a more accurate and complete description of the metes, bounds and courses; and WHEREAS, Augusta, Georgia, has been petitioned by James and Cynthia Franklin, the current owners of 1350 Augusta West Parkway, to abandon said "Easement 3", in exchange for the easements being granted to Augusta by and through two new Easement Deeds, one from James R. Franklin and Cynthia Franklin granting the easement shown as "Easement 1" on the aforesaid plat, and one from National Retail Properties, Inc. granting the easement shown as "Easement 2" on the aforesaid plat, said documents being filed contemporaneously with this document; and WHEREA , the Augusta-Richmond County Commission, at its regularly scheduled meeting, held on Y 2 did approve and accept the two new Easement Deeds and approve the abandonment of the said "Easement 3"; now THEREFORE, Augusta does hereby abandon and relinquish any interest it has in and to the easement contained in the Easement Deed from James R. Franklin and Cynthia Franklin to Augusta, Georgia, dated December 6, 2010, and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 1289, Pages 0099-0105, said easement being shown as "Easement 3" on a plat prepared by Cranston Engineering Group, P. SCRIVENER'S AFFIDAVIT Before me, the undersigned attesting authority in and for the State of Georgia came the undersigned Affiant who, being duly sworn, deposes and says on oath as follows: 1. That the affiant, Kayla E. Cooper was the attorney that caused the Abandonment of Easement to be filed on behalf of Augusta, Georgia, to be prepared and recorded in Deed Book 01324, Page 2046, Richmond County, Georgia Records. 2. That in the Abandonment of Easement set forth in Paragraph 1 and Paragraph 2 hereof, there appeared a scrivener's error as to the property address. The aforementioned property address incorrectly references the property address as "3150 West Augusta Parkway." Therefore, the property address should correctly read "1350 Augusta West Parkway." This Affidavit is made for the protection and benefit of the grantees in said deed, their successors and assigns, and all other parties hereafter dealing with or who may acquire an interest in the property herein described. This Affidavit is made with the understanding that it will be relied upon by a title insurance corporation in the issuance of a policy of title insurance. Therefore, the undersigned Affiant has caused the above Abandonment of Easement above to be corrected by correcting the property address set forth thereunder and affirming the correct information to be incorporated therein.
