RESOLUTION AUTHORIZING THE SETTLEMENT OF
SUBROGATION CLAIM NUMBER 0206929977 SRT BY ALLSTATE
FIRE AND CASUALTY INSURANCE COMPANY, IN THE AGGREGATE
AMOUNT OF ONE THOUSAND, TWO HUNDRED, FIFTY-SIX
DOLLARS AND THIRTY-THREE CENTS ($1,256.33); AUTHORIZING
THE ADMINISTRATOR TO DISBURSE THE AMOUNT OF ONE
THOUSAND, TWO HUNDRED, FIFTY-SIX DOLLARS AND THIRTY-
THREE CENTS ($1,256.33); AND FOR OTHER PURPOSES.
WHEREAS, on or about June 15, 2011 a tree limb fell at 940 D'Antignac Street,
Augusta, Georgia 30901; and
WHEREAS, said limb fell on Theodore R. McNeal and two vehicles owned by Theodore
R. McNeal; and
WHEREAS, Theodore R. McNeal suffered injuries, and Theodore R. McNeal's vehicles
were damaged;
WHEREAS, Theodore R. McNeal filed a claim with Allstate Fire and Casualty Insurance
Company for the damage to his two vehicles;
WHEREAS, Allstate Fire and Casualty Insurance Company paid to repair the vehicles
owned by its policyholder, Theodore R. McNeal;
WHEREAS, Allstate Fire and Casualty Insurance Company is seeking reimbursement for
these costs in the form of a Subrogation Claim;
WHEREAS, Allstate Fire and Casualty Insurance Company has agreed to full settlement
of Subrogation Claim Number 0206929977 SRT against Augusta, Georgia, pursuant to the
attached Settlement Agreement and Release, for the negotiated sum of One Thousand, Two
Hundred, Fifty-Six and Thirty-Three Cents ($1,256.33); and
WHEREAS, it is in the best interests of Augusta, Georgia to resolve this matter and pay
the amount of One Thousand, Two Hundred, Fifty-Six and Thirty-Three Cents ($1,256.33) to
Allstate Fire and Casualty Insurance Company to settle Subrogation Claim Number 0206929977
SRT against Augusta, Georgia arising out of the alleged facts; and
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia and liability is expressly
denied; and
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Board of
Commission,

Section 1: The Augusta, Georgia Board of Commission will settle the Subrogation
Claim Number 0206929977 SRT of Allstate Fire and Casualty Insurance
Company for the sum of One Thousand, Two Hundred, Fifty-Six and
Thirty-Three Cents ($1,256.33).
Section 2: The Administrator is authorized to pay a total sum of One Thousand, Two
Hundred, Fifty-Six and Thirty-Three Cents ($1,256.33) to Allstate Fire
and Casualty Insurance Company at the direction of the Commission and
payment shall be in the form of a check payable to "ALLSTATE FIRE
AND CASUALTY INSURANCE COMPANY". Said Payment shall be
with funds available from Account No. 6110152135523101.
Section 3: To the extent that any section of the Au�usTA, GA. CoDE is in conflict
herewith, that subsection is waived for this instance only.

CERTIFICATION
The undersigned Clerk of Commission, Lena J. Bonner, hereby certifies that the
fore oing esolution was duly adopted by the Augusta, Georgia Board of Commission
