HomeMy WebLinkAboutORD 7307 TO AMEND THE AUGUSTA GA CODE SIX CHAPER SIX SECTION RELATING TO THE POWER AND DUTIES PF THE LICENSE AND INSPECTION DEPARTMENT t t ORDINANCE NO. , �� AN ORDINANCE TO AMEND THE AUGUSTA, GA CODE TITLE SIX CHAPTER SIX SECTIONS 6-6-5 AND 6-6-37 THROUGH 6-6-47 RELATING TO THE POWERS AND DUTIES OF THE LICENSE AND - INSPECTION DEPARTMENT; TO REPEAL ALL CODE SECTIONS AND ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE AN EFF�CTIVE DATE AND FOR OTHER PURPOSES. ; WHEREAS, on March 30, 2011, the Augusta, Georgia Commission approved the Administrator's reorganization plan as described in the Augusta, Georgia Proposed Government Reorganization Draft Project Plan; and WHEREAS, such Proposed Government Reorganization Draft Project Plan requires the abolishment of the License and Inspection Department and to have the powers and duties of the License and Inspection Department to be transferred to the Planning and Development Department; and WHEREAS, Augusta, Georgia desires to update and amend the Code as related to the abolishment of the License and Inspection Department and the transfer of those powers and duties to the Planning and Development Department to be consistent with the Proposed Government Reorganization Draft Project Plan; and WHEREAS, 1997 Ga. Laws p. 4024 designates the name of the consolidated government as "Augusta, Georgia"; and WHEREAS, Augusta, Georgia seeks to update the local laws to reflect the name of the consolidated government. ,, THE AUGUSTA, GEORGIA COMMISSION ordains as follows: ,��- $ SECTION 1. AuGUSTA, Ga. CoDE Section 6-6-5 as set forth in the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in its entirety and inserting in lieu thereof new Code Section 6-6-5, as set forth in "Exhibit A" hereto. SECTION 2. Augusta, GA. CODE Sections 6-6-37 through 6-6-47 as set forth in the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in its entirety and inserting in lieu thereof new Code Section 6-6-37 through 6-6-47, as set forth in "E�ibit B" hereto. � { SECTION 14. Street vendor means an�person, firm or cor�oration which provides merchandise for sale. includin� but not limited to food and drink. in a ublic area within Au usta. Geor ia (such as on streets and/or sidewalksl: provided, however that anv nerson en�a�ed in a business or occu�ation who uses the nublic are immediatelv next to the location of the business for street vendin� shall not be considered a street vendor for �ur�ose of this Article (b) Business tax certificate rec�uired. An� person, firm or cor�oration who ouerates or does business in Au�usta, Georgia as a street vendor shall, before en�a i�n� in such business. obtain a business tax certificate in accordance with the Au�usta. Geor�ia Code: �rovided. further, that no �erson, firm or corporation who wishin .�perate or do business as a street vendor in the Riverwalk are (defined as the area from the south side of Revnolds Street to the Savannah River between Fifth and Thirteenth Streetsl will be �ranted a business tax certificate without the rior annroval of the Riverwalk Snecial Events De�artment. (c) Regulator-v fee. An� nerson, firm or cor�oration who o�erates or does business in Au�usta, Geor�ia as a street vendor shall, before en�a�in� in such business. �av such re ul�atorv fee as a�rovided in section 2-1-3 (cl. 4 � (d) Ri�o f susnension bv the Plannin� & Develo�ment De�artment. The Plannin� & Develonment Denartment shall have the ri�ht to sus�end anv business tax certificate issued under this article whenever a�erson firm or cor�oration doin� business shall deviate from the normal o�eration for which the business tax certificate was obtained of fails in �erformance to meet the rec�uired re�ulations and code as set forth bv the Plannin� & Develo�ment Department sheriff's denartment or health detiartment: or violates anv law or ordinance of the United States. or the state or the count�pursuance of such business conducted under such business tax certificate• or when it shall be �roven before the Plannin�& Develonment Denartment that there is a violation of a nuisance law: or when the health, morals interests and convenience of this �ublic demand the sus�ension of such business tax certificate to the next re�ular or called meetin� of the Commission: then the business tax certificate shall be sus�ended and �laced on probation. �ermanentiv revoked. or otherwise is shall be restored and remain in full force, accordin� to the decision of the Commission. (e) Penalty_ for violation of Article. Sec. 6-6-40. Temnorarv and transient vendors. (a) Defined. Tem�orarv and transient vendor means an�nerson, firm or cor�oration which maintains no office or �ermanent location within Au� Geor ia and who conducts temnorarv sale and/or business within the non�ublic area of Au�usta. Geor� (b) Business tax certificate �ec�uired. An�aerson, firm or cor�oration who operates or does business in Augusta Geor�ia as a tem�orar� and transient vendor shall. before en�a�� such business. obtain a business tax certificate in accordance with the Augusta. Geor�ia Code. (c) A��lication: bond No tem�orarv and transient vendor shall be �ranted a business tax certificate without havin� first made apnlication for some, which annlication shall recite the name of the vendor: the name of the a� conductin� the sale. if anv; the nlace where the sale is to be conducted: the hours of sale; and the number of davs durin� which the sale is to be conducted There shall be a�nended to the a�nlication a complete and accurate list of the articles to be sold which list shall be si�v the �erson seekin� the business tax certificate and the list shall also reflect the wholesale �rice of the articles to be sold. The inventorv shall be verified upon oath bv the a�nlicant. The a��lication and inventorv shall be accom�anied bv a�ood and sufficient bond in the �enal amount of five thousand dollars (�S,OOO.00�tiavable to Au�usta. Geor�ia and conditioned to a the countv or an one else suin� in its name, for their use, for in'uries or dama�es arisin� from dishonest or fraudulent conduct in the administration of the business. (d) Re ulator�fee. An�nerson. firm or cor�oration who o�erates or does business in Au�usta Geor�ia as a tem�orarv and transient vendor shall before en�a ing in such business �av such re ul�ator� fee as is �rovided in section 2-1-3 � (e) Right of sus�ension bv Planning & Develo�ment De�artment. The Planning & Develo�ment Department shall have the ri�ht to sus�end anv business tax certificate issued under this article whenever a person, firm or cor�oration doin�business shall deviate from the normal o�eration for which the business tax certificate was obtained or fails in �erformance to meet the rec�uired re�ulations and code as set forth bv the Plannin� & Develo�ment De�artment, sheriff's de�artment or health department: or violates an� law or ordinance of the United States, or the state of the count��ursuance of such business conducted such business tax certificate• or when it shall be �roven before the Plannin�and Develonment Department that there is a violation of a nuisance law: or when the health. morals. interest and convenience of the �ublic demand the sus�ension of such business tax certificate. The Plannin� and Develo�ment De�artment shall renort the susnension of such business tax certificate shall be sus�ended, placed on nrobation, nermanentiv revoked. or otherwise is shall be restored and remain in full force, accordin� to the decision of the Commission. Sec. 6-6-41. Vendin� machine onerators. (a) Defined. Vendin� machine o�erator means anv �erson, firm or corporation offering the sale of inerchandise. includin� without limitation food and drink, bv vendin� machine. which vendin� machine is either owned or o�erated bv said person, firm or cor�oration. (b) Business tax certifcate rec�uired: decals. An� �erson, firm or corporation who o�erates or does business in Au�usta, Geor�ia as a vendin� machine onerator shall. before en�a�� in such business, obtain a business tax certificate in accordance with the Au�usta Geor�ia Code. Said �erson, firm or cor�oration shall also obtain a decal from the license & ins�ection de�artment for each vendin� machine owned or o�erated which decals must be affixed to said machines. (c) Regulatorv fee Anv nerson firm or cor�oration who o�erates or does business in Au�usta. Geor�ia as a vendin� machine o�erator shall, before en�a�� in such business �av such re u�rv fee as is �rovided in section 2-1- � (d) Right of sus�ension bv Planning and Develo�ment De�artment. The Plannin� and Develo�ment De�artment shall have the ri�ht to sus�end anv Business Tax Certificate issued under this Article whenever a�erson, firm or cor�oration doin� business shall deviate from the normal o�eration for which the Business Tax Certificate was obtained or fails in �erformance to meet the required re�ulations and code as set forth bv the Plannin� and Develo�ment De�artment. Sheriff's Denartment or health de�artment; or violates anv law or ordinance of the United States. or the State or the count��ursuance of such business conducted under such Business Tax Certificate: or when if shall be �roven before the License and Insnection De�artment that there is a violation of a nuisance law; or when the health. morals. interest and convenience of the �ublic demand the sus�ension of such Business Tax Certificate. Sec. 6-6-42 Live adult entertainment. . _ (a) Defined. Live adult entertainment means dancin� or other entertainment nrovided bv one or more live male or females �erformin e,� nude or nartiallv nude: wet tee- shirt or bathing suit contests; Chi�pendale's or similar shows: or similar contests or events featurin n��ation bv either the audience or other non-nrofessional �erformers in nude or �artiallv nude states. Live adult entertainment as used in this section does not include dancers or other performers live on a re�ular basis at adult entertainment which are otherwise rec�uired to have a Business Tax Certificates. (b) Business Tax Certificate rec�uired. Anv �erson. firm or corporation who o�erates or does business in Au�.usta, Geor�ia featurin� live adult entertainment shall. before en a�in� in such business. obtain a Business Tax Certificate in accordance with the Au�usta. Geor�ia Code. (c) A�nlication. No �erson. firm or cor�oration offerin� live adult entertainment shall be �ranted a Business Tax Certificate without havin f�irst made annlication for some. which a�nlication shall recite the name of the �erson. firm or co oration; the name of the a ent rovidin the live adult entertainment. if anv; the �lace where the live adult entertainment: and the number of davs durin� which the entertainment is to be provided. (d) Re u�rv fee. An�nerson, firm or cor�oration who o�erates or does business in Au usta. Geor ia rovidin live adult entertainment shall, before en�a, �i�n� in such business .�av such re u�rv fee as is �rovided in subsection. 2- 1-3c. (e) Right to sus�ension bv Planning & Develo�ment De�artment. The Plannin� & Develo�ment De�artment shall have the ri�ht to sus�end anv Business Tax Certificate issued under this Article whenever a�erson. firm or cor�oration doin� business shall deviate from the normal operation for which the Business Tax Certificate was obtained or fails in �erformance to meet the reauired re�ulations and . code as set forth bv the Plannin� & Develo�ment Denartment, Sheriff's Denartment or health denartment: or violets anv law or ordinance of the United States. or the State or the count��ursuance of such business conducted under such Business Tax Certificate: or when it shall be �roven before the Plannin�& Development Denartment that there is a violation of a nuisance law: or when the health morals interests and convenience of the �ublic demand the sus�ension of such Business Tax Certificate. The License and Ins�ection Department shall re�ort the sus�ension of such Business Tax Certificate to the next re�ular or called meetin� of the Commission: then the Business Tax Certificate shall be sus�ended, nlaced on �robation, nermanentiv revoked. or otherwise it shall be restored and remain in full force. accordin� to the decision of the Commission. (� Penaltv for violation of Article. All �ersons, firms. or cor�orations failin� to com�lv with the mandatory nrovisions of this Article or doin�anv act nrohibited is this Article shall be �uilty of an offense. and u�on trial as a misdemeanor and conviction. shall be �unished as provided in section 1-6-1 of this Code. Section 6-6-43. Dance Halls. (a) Defined. Dance hall means a location where music, whether live or recorded. is �laved and/or otherwise.�rovided for the �ur�ose of dancin�bv the natrons of the location. or where such dancin� is allowed or permitted. (b) Application. A written a�nlication to the Au�usta, Geor�ia Board of Commission for a license under this Ordinance shall be made on forms a�proved bv the Au�usta. Geor�ia Commission. All Ouestions and information rec�uired bv the ap�lication form should be filled in and subscribed to b� all a��licants. under oath and shall disclose amon� other information whether the a��licant has been convicted of anv crime. misdemeanor or a violation of any munic�al ordinance (except minor traffic violationsl in anv state, county. munici�al or federal court. and the narticulars of same: the �rior business of a�nlicant for the �ast ten k 101 vears: names and addresses of three (31 �ersons who have known a�plicant for the past five (51 vears: whether the interest of a�nlicant is total. �artial, or exact extent of same. and, if �artial, the names and addresses of all others havin�a tiartial interest in said business and the extent of such interest• and such other and further information as the Commission shall deem necessarv. (c) Insnection of annlication bv license ins�ector: investi�ation bv Sheri��rovision of information to Plannin� and Develo�ment De�artment u�on re�uest. An ap.nlication under this Ordinance shall be sworn to and directed to the Director of Plannin� & Develo�ment for Au�usta. Georgia, who shall ins�ect the a nlication and refer same to the Au�usta, Geor�ia Sheriff, who shall investi a�te the character and renutation of the a�nlicant. owners. �artners, officers of the corooration. shareholders. managers. em�lovees. and others associated with the aaplication. and the suitabilitv of the location for the dance hall. (1) All annlicants shall furnish all data. information and records rec�uested of them bv the Plannin� & Develo�ment De�artment and/or the Au�usta, Geor�ia Sheriff's De�artment, and failure to furnish such data. information and records within thirtv (301 davs from the date of the rec�uest shall automaticallv serve to dismiss. with �reiudice, the a��lication A�plicants by filin a�n a�nlication a ree�to �roduce for oral interro�ation anv nerson or �ersons involved in anv transaction pertinent to the annlication or anv evidence relevant to the a�nlication as ma ��be rec�uested by the Au�usta. Failure to produce such evidence. nerson or persons within thirt��301 davs after bein�rec�uested to do so shall result in the automatic dismissal of the a�nlic� (d) Commission approval No person shall o�erate a dance hall within the limits of Augusta. Geor�ia without first receivin� a favorable action from the Board of Commissioners. The Au sta. Geor ia Commission shall have the ri�ht to determine whether the a�nlicant or location for the �roposed dance hall is �ro�er and a��ro�riate. (e) Business tax certificate rec�uired. Any uerson, firm or cor�oration who does business in Au usta, Geor ia as a dance hall shall, before en a in in such business. obtain a business tax certificate in accordance with the Augusta. Ga. Code. (� Regulato�fee. Anv t�erson, firm or cor�oration who does business in Au�usta, Geor�ia as a dance hall shall, before en�gin� in such business. �av such re u�rv fee as is nrovided in Section 2-1-3 (cl of the Au�usta, Ga. Code. (g) Ri�ht ofsusnension bv the Planning & Develo�ment De�artment. The Plannin� & Develo�ment De�artment shall have the right to sus�end anv business tax certificate issued under this cha�ter whenever a�erson, firm or cor�oration doin� business shall deviate from the normal o�eration for which the business tax certificate was obtained or fails in �erformance to meet the required re�ulations and code as set forth bv the Planning & Develo�ment De�artment, Sheriff's Denartment or Au�usta-Richmond Countv Health De�artment: or violates anv law or ordinance of the United States. or Au�usta. Geor i� a, in �ursuance of such business conducted under such business tax certificate: or when it shall be �roven before the Plannin� & Develonment Department that there is a violation of a nuisance law: or when the health. morals. interests and convenience of the �ublic demand the sus�ension of such business tax certificate. The Commission shall determine whether the certificate holder will be sus�ended. nlaced on probation, nermanentiv revoked. or otherwise it shall be restored and remain in full force. (h) Penaltv for violation of aYticle. All �ersons, firms or cor�orations failin� to com�lv with the mandator��rovisions of this article or doin� anv act prohibited in this article shall be �uilty of an offense, and, u�on trial as a misdemeanor and conviction. shall be �unished by a fine in an amount not to exceed one thousand dollars ($1.0001 and/or im�risonment in the Au�usta. Geor� jail for a neriod not in excess of sixtv (601 davs. Sec. 6-6-44. Fortune tellers. etc. � Business Tax Certificate rec�uired. An��erson, firm or cor�oration who does business in Au usta. Geor ia as fortune-teller, almist. astrolo er, clairvo ��phrenolo�ist. medium or anv other form of fortune-tellin� shall, before en�a �i�ng in such business. obtain a Business Tax Certificate in accordance with the Au�usta. The a�nlication for said business shall be si�ned and dated bv the a�nlicant and contain answers to the followin�auestions: (1) What is the kind of business to be o�erated? (2) What is the name of the business: (3) What is the location where such business is �ro�osed to be carried on and the tele�hone number of said location? (4) What is the name of the a�ulicant for the license. and the home address and telephone number of said ap�licant? (5) Where has ap�licant resided for the six (61 months �recedin� the date of this a�nlication: (6) What was the a�nlicant's �revious home address, and how lon� was apnlicant a resident there? (7) What is the Social Securitv number of said a�.�licant? (8) What the names and addresses of all persons havin��an interest in said business? (9) What interests do such persons have? Advertisin as referred to in this section. means there shall be a si n osted thirtv �301 davs nrior to the hearin� of the apnlication at a�rominent �osition on the pro�erty such as. for exam�le, on the front window of the buildin� where it can be read from the road. All new Business Tax Certificate a�nlicants shall be rec�uired to advertise there (31 times in the le��azette of Au�usta, Geor�ia to wit, the Au�usta Chronicle. before a�nlications are heard bv the Commission. The advertisin� in the le�al �azette shall be durin� the thirt�-dav neriod �rior to the hearin� of the a��lication bv the Commission. The Plannin� and Develonment Denartment shall renort the suspension of such business tax certificate to the next re�ular or called meetin� of the Commission, and shall �rovide the licensee with at least three (31 davs' notice of said meetin�, at which meetin� the licensee mav make such showin� as he/she mav deem �ro�er. After a hearin�, the Commission shall either continue the susnension. �lace the license on �robation, �ermanentiv revoke the license or restore the license such that it remains in full force. (1) Bona fide coin-o�erated amusement machine means the same as this term is defined in O.C.G.A. � 48-17-1(21 and anv aunlicable state re�ulations and of this Code. (2) Location. The �hvsical location of a business in Au�usta• Georgia which has been issued a valid business tax certificate. (3) Arcade. "Arcade" means anv location where three (31 or more bona fide coin-o�erated amusement machines are o�erated which nermit non-cash redemption as �rovided in O.C.G.A. � 16-12-35. or a location where ten (101 or more bona fide coin- ot�erated amusement machines are located, whether or not non- cash redem�tion for anv machine is allowed. Coin o�erated amusement machines shall be �laced at least two (21 feet a�art and have four (41 feet of free s�ace in front of the machine set�arate and a�art from walkin a� (4) License. All amusement devices within the premises shall be visible to and su�ervised bv an adult attendant who shall be �resent at all times when anv amusement device is bein� onerated. (b) Distance rec�uirements — Plat rec�uired. Everv a��lication for a license to o�erate an arcade in Au�usta. Geor�ia shall be verified bv a�lat pre�ared bv a licensed Geor�ia survevor or civil en�ineer. showin� the distance for the �ronosed business. as hereafter urovided. (1) No license for the o�eration of an arcade shall be issued for anv location: i. Within one thousand two hundred fiftv (1,2501 feet of the pro�ertv line of any school or colle��us. The schools and colle es referred to herein shall include onlv such �ublic. �rivate, or church-su�norted schools which teach the subiects commonlv tau�ht in the common schools and colle�es of this state, and shall not include private schools or colle�es wherein a s�ecialized sub��ect such as law. steno�ra�h�, business. music, art. vocational occu�ations. and other s�ecial subiects are tau h� ii. Within one thousand two hundred fiftv ( L2501 feet of anv similar use re�ulated under the Com�rehensive Zonin� Ordinance of Richmond County or the Au�usta, Geor�ia Code. (2) The distance requirements set out above shall a�plv in anv and all directions from the �ro�erty lines of the �ro�osed location, as measured in a strai�,ht line. The �lat shall accom�anv and be made a�art of the a�lication for such license. (3) In determinin� whether or not a license a�nlied for hereunder shall be �ranted, renewed. transferred or issued to a new location, in addition to all the �rovisions of this section, the following shall be considered in the �ublic interest and welfare: (i) Re�utation. character. The a�?plicant's re�utation, character. trade and business associations or �ast business ventures. mental and �hvsical ca�acitv to conduct this business. �ii) Previous violations of Augusta. Geor�ia Code. If the a�plicant is a previous holder of an arcade license. whether or not he has violated anv law, regulation or ordinance relatin� to such business. � � (iii) Manner of conductin� prior arcade business. If the a��licant is a�revious holder of an arcade license. the manner in which he conducted the business thereunder es�eciallv as to the necessitv for unusual policv observation and ins�ection in order to prevent the violation of an law. re ulation or ordinance relatin� to such business. �ivl Location. The location for which the license is sou h� t, as to traffic con estion, eneral character of nei hborhood and the effect such an establishment would have on the adi acent and surroundin� nro�ertv values. (vl Number of licenses in trading area. The number of licenses alreadv �ranted for similar business in the trading area of the �lace for which the license is sou�ht. vil Previous revocation of license. If the a�plicant is a �erson whose license issued under the �olice �owers of anv �overnin� authoritv has been �reviouslv sus�ended or revoked or who has �reviouslv had an arcade license sus�ended or revoked. �vii) Pavment of taxes and other char�es. If the a��licant and business are not delinc�uent in the �avment of an lv ocal taxes or other fees or char e�s. (viiil Congre�ation of minors. Anv circumstances which mav cause minors to con�re�ate in the vicinitv of the uro�osed location even if the location meets the distance rec�uirements under subsection 6-6-45(bl herein. ixl Prior incidents. Evidence that a substantial number of incidents rec�uirin��olice intervention have occurred within the immediate area durin� the twelve (121 months immediatelv nrecedin� the date of a��lication. �xl Previous denial or revocation. The denial of an annlication. or the revocation of a license. occurrin� within the precedin twelve 121 months, which was based on the qualifications of the �ro�osed location. xil Renewal. a. All licenses �ranted hereunder are �rivile�e licenses and shall ex�ire on December 31 of each vear. Licensees who desire to renew their licenses therefore shall file an a�nlication, to�ether with the rec�uisite fee with the Plannin� and Develo�ment Department for such renewal u�on forms a��roved bv the Director of Plannin� and Develo�ment. on or before December 1 of each vear. b. All licenses to be renewed for the subsequent calendar vear shall be submitted bv the Plannin� and Develo�ment De�artment to the Commission for a�nroval no later than December 15 of each vear. Anv licenses that have been �laced on probation. sus�ension or have been revoked b�� Au�usta. Geor�ia Commission durin��ear shall be submitted on a se�arate list b��the Plannin� and Develo�ment De�artment for review and consideration for a��roval. c. No license shall be randfathered as to anv p rovision of this section. (c) Individuals not eli i� ble for license. The followin� individuals are not eli�ible for an arcade license. (1) A person or nersons or anv of the officers and directors who have been convicted of a felony in anv iurisdiction. A conviction. for �ur�oses of this �aragra�h, includes a��iltv lea or nlea of nolo contendere. (2) A uerson or �ersons or anv of the officers and directors who have been convicted of a non-felonious crime or moral turoitude. lottery. or illegal �ossession and sale of narcotics or liauors within the five (51 vears �recedin� the filing of the a��lication. A conviction. for �ur�oses of this para�ra�h, includes a u�'ilt�nlea or �lea of nolo contendere. (3) A�erson whose license to o�erate an arcade has been revoked for cause in anv state or territorv of the United States within the ten (101 e�precedin� the filin� of the a��lication. (4) A nerson who has knowin�lv falsified information or made anv material misre�resentation on the annlication for a license under this Ordinance. (5) Should anv such a�nlicant �artner or officer or director of anv analicant entity, after a license has been �ranted. be convicted or �lead u�iltv or nolo contendere to a crime involvin m�oral tur�itude. or to the violation of anv laws of the State of Geor� re u���amblin� or the lotterv laws. said license shall be subiect to immediate sus�ension or revocation as set forth in sub �art lhl of this Code section. (d) Proner zoning rec�uired. No license shall be issued for the o�eration of an arcade unless the license holder's �lace of business is located in an area within Au�usta. Geor�ia that is �ro�erlv zoned. (e) Business Tax Certificate rec�uired. An�nerson. firm or cor�oration who owns. otierates or does business in Au�usta, Geor�ia as an arcade is rec�uired to obtain a business tax certificate in accordance with the Au�usta, Geor�ia Code. (� Re u�r�fee Anv person firm or cor�oration who owns bona fide coin-onerated amusement machines and places the machines in an arcade operatin� in Au�usta Geor�ia is required to �av such re ul�atorv fees as �rovided in subsection 2-1-3(cl of the Au�usta. Geor�ia Code. (g) �nlication for license. All annlicants for a license to operate an arcade shall �ive notice of their intention to make such a��lication bv advertisement in the form �rescribed bv the Plannin� and Development Denartment. Advertisin� as referred to in this section means there shall be a si�n posted thirtv (30l davs nrior to the hearin� of the a�nlication in a�rominent nosition on the �ro�erty�front window where it can be read from the roadl: also. all new business tax certificate a�nlicants shall be rec�uired to advertise three (3� times in the le a�l aze�tte ( Chroniclel before a�nlications are heard bv the Au�usta, Geor�ia Commission. Advertisin� in the news�a�er shall be durin t�he thirtv-dav neriod nrior to the hearin� of the aunlication bv t��usta. Geor� Commission. Before the a�nlication is �resented to the Commission, the applicant shall furnish proof that the advertisement has been completed as rec�uired hereinabove. (h) Sus�ension. Probation and Revocation. The Plannin� Development Denartment shall have the ri�ht to sus�end anv license issued under this article whenever a person, firm or cor�oration doin� business shall deviate from the normal oneration for which the business tax certificate was obtained for fails in nerformance to meet the rec�uired re�ulations and code set forth b� the Plannin� and Develonment Department, Sheriff's Department or Health Denartment: or violates anv law or ordinance of the United States. or the state or Au�usta. Geor i�a. in �ursuance of such business conducted under such license: or when it shall be nroven before the Plannin� and Development De�artment that there is a violation of a nuisance law: or when the health. morals, interests and convenience of the �ublic demand the sus�ension of such license. The Planning and Develo�ment Department shall report the susnension of such license to the next re�ular or called meetin� of the Au�usta. Geor�ia Commission. The Commission make a determination re ar�d'�n� whether the license shall be suspended. nlaced on nrobation or �ermanentiv revoked. or otherwise it shall be restored and remain in full force. (i) Cost of arcade license. The cost of the arcade license is one hundred dollars ($100.001 and must be submitted at the time that the a�nlication and other documentation is submitted to the local �overnment officials. (j) Penaltv for violation of article. All �ersons, firms or cor�orations failin� to complv with the mandatorv nrovisions of this article or doin�anv act prohibited in this article shall be uiltv of an offense, and, u�on trial as a misdemeanor and conviction. shall be as �rovided in section 1-6-1 of this Code. Sec. 6-6-46. Amusement game Aermit. (a) Defnitions. (1) Bona fide coin-o�erated amusement machine means the same as this term is defined in O.C.G.A. � 48-17-1 21 and anv a��licable state re�ulations and of this Code. , , (2) Location. The �hysical location of a business in Au�usta• Geor�ia which has been issued a valid business tax certificate. (3) Machine owner. Any nerson. firm or cor�oration which owns a bona fide coin operated amusement machine. (4) Permit. An Amusement Game Permit issued �ursuant to this article. (b) Pur�ose o securing a�ermit. The pur�ose of securin�a �ermit is to nrovide a record of machine owners who own bona fide coin-o�erated amusement machines and have nlaced those machines in a business in Au�usta. Geor,� (c) Failure to a� lv for �ermit. The failure of a machine owner to annlv for a�ermit under this article before makin� a covered machine available to the nublic shall result in a fine of one hundred dollars ($100.001. (d) Affect on machine owner's other statutorv duties. This article a��lies independentl� from and has no affect on other statutorv obli�ations of an amusement machine owner within this Code. Sec. 6-6-47. Goin�-out-of-business sales. (a) Definitions. For the nurposes of this Article the followin t_, e��s vhrases. words. and their derivations shall have the meanin�s �iven herein. When not inconsistent with the context. words used in the �resent tense include the future, words in the nlural number include the sin�ular number, and words in the sin�ular number include the �lural number. The word "shall" is alwavs mandatorv and not merelv directorv. (1) Countv. The Countv of Richmond. (2) Countv license officer. The Director of Plannin� Develo�ment of the Countv of Richmond. 4 � (3) Fire and other alte�ed �oods sale. A sale held out in such a manner as to reasonably cause the �ublic to believe that the sale will offer �oods dama�ed or altered bv fire. smoke, water or other means. (4) Goin -out-o.f-business sale. A sale held out in such a manner as to reasonably cause the �ublic to believe that u�on the disposal of the stock of oods on hand ithe businessl will then move to and resume business from other existin� locations in the co� (b) Business Tax Certificate re�uired. An� �erson. firm or cor�oration who �lans to sell or offer for sale an��oods at a sale to be advertized or held out b an means to be a oin -out-of-business sale. a removal of business sale or a fire and other altered oods sale shall, before en a�in in such sale. obtain a Business Tax Certificate in accordance with the Au�usta, Geor�ia Code. (c) A��lication of �egulations. (1) Provisions su�nlement �eneral licensin� ordinance. The provisions of this Article are intended to au�ment and be in addition to the �rovisions of the �eneral licensin� ordinance of this countv. Where this Article im�oses a�reater restriction u on nersons. remises. businesses. or ractices than is imposed bv the �eneral licensing ordnance of this count .� Article shall control. (2) Established business rec�uisite. Anv aerson who has not been the owner of a business advertised or described in the atinlication for a Business Tax Certificate hereunder for a eriod of at least twelve (121 months �rior to the date of the pro�osed sale shall not be �ranted a Business Tax Certificate. a. Exce�tion for survivors of businessmen. U�on the death of a tierson doin� business in this count�, his or her heirs, devises or le�atees shall have the ri h���lv at anv time for a Business Tax Certificate hereunder. (3) Interval between sales. Anv �erson who has held a sale as regulated under this Article. at the location stated in the a��lication within one (11 vear last past from the date of such a��lication. shall not be �ranted a Business Tax Certificate. (4) Restricted location. Where a�erson a�lvin� for a Business Tax Certificate hereunder o�erates more than one (11 place of business the Business Tax Certificate issued shall an�lv onlv to the one � 11 store or branch s�ecified in the a��lication; and no other store or branch shall advertise or re�resent that it is cooneratin� with it. or in any way nartici�atin� in the business tax certified sale: nor shall the store or branch conductin� the business tax certified sale advertise or represent that anv other store or branch is cooneratin� with it or partici�atin� in anv wav in the business tax certified sale. (5) Persons exemnted. The �rovisions of this Article shall not a��lv to or affect the followin�nersons: a. Persons actin�nursuant to an order or �rocess of a court of comnetent iurisdiction; b. Persons actin� in accordance with their nowers and duties as ublic officials• c. Dulv business tax certified auctioneers. sellin� at auction: d. Persons conductin� a sale of the t�e re�ulated in this Article on the effective date of this Article unless such sale is continued for a�eriod of more than sixtv (601 davs from and after such effective date, in which event. such � . nerson, at the la se of the sixt -da eriod, shall comnlv with the �rovisions of this Article: e. An��ublisher of a news�a�er, ma�azine or other nublication. who ublishes in ood faith, anv advertisement. without knowled�e of its false, dece�tive or misleadin� character, or without knowled�e that the �rovisions of this Article have not been com�lied with. Le�islative Dele�ation choose to a��oint two (21 members as �rovided in the Consolidation Act. such members shall serve for a term of four (41 vears and until their successors are a�nointed and c�ualified. In the event the a�pointed authoritv of the Le�islative Dele�ation is removed from the Consolidation Act. this subsection shall automaticallv be re�ealed. (d) Apnlication reauirements. �1 Written information rec�uired. A�erson desirin� to conduct a sale re�ulated bv this Article shall make a written a��lication to the license office settin� forth and containin� the followin� information: a. The true name and address of the owner of the oo�ds to be the ob�ect of the sale; b. The true name and address of the person from whom he purchased the �oods to be sold and the �rice therefor, and if not nurchased. the manner of such acc�uisition; c. A description of the �lace where such sale is to be held; d. The nature of the occu�ancv, whether bv lease or sublease and the effective date of termination of such occu�ancv: e. The dates of the �eriod of time in which the sale is to be conducted: f. A full and com�lete statement of the facts in re�ard to the sale. includin� the reason for the ur�ent and the expeditious dis�osal of �oods thereby and the manner in which the sale will be conducted: g. The means to be em�loved in advertising such sale to�ether with the�ro�osed content of anv advertisement; h. A com�lete and detailed inventorv of the �oods to be sold at such sale as disclosed b tX he a�nlicant's records. Said inventorv shall be attached to and become a�art of the rec�uired a�ulication. a. Bona fide orders. All �oods included in such inventorv shall have been �urchased bv the a�nlicant for resale on bona fide orders without cancellation �rivile�es and shall not comprise �oods �urchased on consi nm�ent. b. Goods �urchased for sale under this Article. Such inventorv shall not include goods ordered in contem�lation of conductin� a sale re�ulated under this Article. Anv unusual �urchase or additions to the stock of �oods of the business herebv affected within thirtv (30l davs before the filin� apnlication hereunder shall be deemed to be of such character. � l �21 Nature of sale. The Business Tax Certificate shall authorize onlv the one (11 t�e of sale described in the a�nlication at the location named therein. (b) Saleable �oods. The Business Tax Certificate shall authorize onlv the sale of �oods described in the inventorv attached to the a�nlication. (c) Surrender of �eneral Business Tax Certificate. U�on bein� issued a Business Tax Certificate hereunder for a��-out-of- business sale the Business Tax Certificate holder shall surrender to the license officer all other Business Tax Certificates he mav hold at that time a�nlicable to the location and �oods covered b� the a�lication for a Business Tax Certificate under this Article. (d) Nontransferabilit�v Business Tax Certificate �rovided for in this Article shall not be assi�nable or transferable. (� Duties ofBusiness Tax Certificate holder. A Business Tax Certificate holder under this Article shall: (1) Adhere to inventorv. Make no additional whatsoever, durin� the �eriod of the business tax certified sale. to the stock of �oods set forth in the inventor� attached to the a��lication for Business Tax Certificate. (2) Advertise �ro�erlv Refrain from em�lovin�v untrue decentive or misleadin� advertisin� (3) Adhere to advertisin�. Conduct the business tax certified sale in strict conformitv with any advertisin� or holdin� out incident thereto. . . (4) Kee� duplicate inventor� Kee� available at the �lace of sale a du�licate co�v of the inventorv submitted with the a�plication and shall �resent such du�licate to ins�ectin� officials unon re� (5) Se�re�ate noninventoried �oods Kee� anv other �oods se�arate and a�art from the �oods listed in the filed inventorv as bein ob iects of sale and shall make such distinction clear to the �ublic b n��ta�s on all inventoried �oods in and about the nlace of sale a�nrisin� the �ublic of the status of all such �oods. (g) Regulatorv fee An��erson firm or cor�oration who. in the unincor�orated area of the count��lans to sell or offer for sale an��oods at a sale to be advertised or held out bv anv means to be a o��ing-out-of-business sale, a removal of business sale or a fire or other altered stock sale shall, before en�a�in� in such sale �a� such re u�rv fee as is �rovided in subsection 2-1-3 (cl of the Augusta. Geor�ia Code. (h) Right of sus�ension bv Planning and Develo�ment De�artment The Plannin� and Develo�ment De�artment shall have the ri�ht to suspend anv Business Tax Certificate issued under this Article whenever a�erson, firm or cor�oration doin� business shall deviate from the normal o�eration for which the Business Tax Certificate was obtained or fails in �erformance to meet the rec�uired re�ulations and code as set forth by the Plannin�and Develo�ment Denartment, Sheriff's De�artment or Health De�artment• or violates anv law or ordinance of the United States or the State or the count��ursuance of such business conducted under such Business Tax Certificate• or when it shall be �roven before the Plannin� and Develo�ment De�artment that there is a violation of a nuisance law; or when the health morals interests and convenience of the �ublic demand the sus�ension of such Business Tax Certificate The Plannin� and Develo�ment De�artment shall re�ort the Sus�ension of such Business Tax Certificate to the next re�ular or called meetin� of the Au�usta, Geor�ia Commission; then the Business Tax Certificate shall be sus�ended. �laced on nrobation. �ermanentiv revoked, or otherwise it shall be restored and remain in full force. � r (i) Penaltv for violation of Article.
