AN ORDINANCE TO AMEND THE AUGUSTA, GA CODE TITLE SEVEN
CHAPTERS ONE THROUGH THREE SECTIONS 7-1-19, 7-1-19.2, 7-1-19.6
THROUGH 7-1-19.9, 7-1-26 THROUGH 7-1-33, 7-1-47 THROUGH 7-1-48, 7-
1-86, 7-1-116-2, 7-1-116-4 THROUGH 7-1-116-5, 7-1-136, 7-2-3, 7-2-63, 7-2-
76, AND 7-3-73 RELATING TO THE POWERS AND DUTIES OF THE
LICENSE AND INSPECTION DEPARTMENT; TO REPEAL ALL CODE
SECTIONS AND ORDINANCES IN CONFLICT HEREWITH; TO
PROVIDE AN EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, on March 30, 2011, the Augusta, Georgia Commission approved the
Administrator's reorganization plan as described in the Augusta, Georgia Proposed
Government Reorganization Draft Project Plan; and
WHEREAS, such Proposed Government Reorganization Draft Project Plan
requires the abolishment of the License and Inspection Department and to have the
powers and duties of the License and Inspection Department to be transferred to
the Planning and Development Department; and
WHEREAS, Augusta, Georgia desires to update and amend the Code as related to
the abolishment of the License and Inspection Department and the transfer of those
powers and duties to the Planning and Development Department to be consistent
with the Proposed Government Reorganization Draft Project Plan; and
WHEREAS, 1997 Ga. Laws p. 4024 designates the name of the consolidated
government as "Augusta, Georgia"; and
WHEREAS, Augusta, Georgia seeks to update the local laws to reflect the name of
the consolidated government.
THE AUGUSTA, GEORGIA COMMISSION ordains as follows:
SECTION 1 AUGUSTA GA. CoDE Section 7-1-19 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 7-1-19, as set forth in
"Exhibit A" hereto.
SECTION 2. Augusta, GA. CODE Section 7-1-19.2 as set forth in the Augusta,
Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in
its entirety and inserting in lieu thereof new Code Section 7-1-19.2, as set forth in
"E�ibit B" hereto.
SECTION 3. AuGUSTA, GA. CoDE Sections 7-1-19.6 through 7-1-19.9 as set forth
in the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by striking
this section in its entirety and inserting in lieu thereof new Code Sections 7-1-19.6
through 7-1-19.9, as set forth in "Exhibit C" hereto.
SECTION 4. AuGUSTA, GA. CoDE Sections 7-1-26 through 7-1-32 as set forth in
the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by striking
this section in its entirety and inserting in lieu thereof new Code Sections 7-1-26
through 7-1-32, as set forth in "E�ibit D" hereto.
SECTION 5. AuGUSTa, Ga. CoDE Sections 7-1-47 through 7-1-48 as set forth in
the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by striking
this section in its entirety and inserting in lieu thereof new Code Section 7-1-47
through 7-1-48, as set forth in "E�ibit E" hereto.
SECTION 6. AuGUSTA, GA. CoDE Section 7-1-86 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 7-1-86, as set forth in
"Exhibit F" hereto.
SECTION 7. AuGUSTa, Ga. CoDE Section 7-1-116-2 as set forth in the Augusta,
Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in
its entirety and inserting in lieu thereof new Code Section 7-1-116-2, as set forth in
"Exhibit G" hereto.
SECTION 8. AuGUSTA, GA. CoDE Sections 7-1-116-4 through 7-1-116-5 as set
forth in the Augusta, Ga. Code, re-adopted July 10, 2007, is hereby amended by
striking this section in its entirety and inserting in lieu thereof new Code Sections
7-1-116-4 through 7-1-116-5, as set forth in "E�ibit H" hereto.
SECTION 9. AuGUSTA, GA. CoDE Section 7-1-136 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 7-1-136, as set forth in
"Exhibit I" hereto.
SECTION 10. AuGUSTA, GA. CoDE Section 7-2-3 as set forth in the Augusta, Ga.
Code, re-adopted July 10, 2007, is hereby amended by striking this section in its
entirety and inserting in lieu thereof new Code Section 7-2-3, as set forth in
"Exhibit J" hereto.
SECTION 11. AuGUSTA, GA. CoDE Section 7-2-63 as set forth in the Augusta,
Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in
its entirety and inserting in lieu thereof new Code Section 7-2-63, as set forth in
"Exhibit K" hereto.
SECTION 12. AuGUSTA, GA. CoDE Section 7-2-76 as set forth in the Augusta,
Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in
its entirety and inserting in lieu thereof new Code Section 7-2-76, as set forth in
"E�ibit L" hereto.
SECTION 13. AuGUSTA, GA. CoDE Section 7-3-73 as set forth in the Augusta,
Ga. Code, re-adopted July 10, 2007, is hereby amended by striking this section in
its entirety and inserting in lieu thereof new Code Section 7-3-73, as set forth in
"Exhibit M" hereto.
SECTION 14. This ordinance shall become effective on November 15, 2011.
SECTION 15. All ordinances or parts of ordinances in conflict herewith are
hereby repealed.

�1 In lieu of enforcement under other nrovision of this Code. the owner(sl
of a vacant structure ma y elect to close or `mothball' the structure is vacant and
unfit for human habitation and occu�ancy and it is not dila�idated, unsafe,
unsanitary or in dan�er of structural colla�se Mothballin� is defined as a method
used to �rotect a vacant structure from weather dama�e and vandals while
n reservin� the structure for future use. The �oal of mothballin is to temnorarilv
nrotect the �ro�ertv to allow the owner to �lan the pro�ertv's future or acauire
funds for �reservation, rehabilitation, or restoration. In historic districts, the
owner�rior to mothballin� must obtain a certificate of a�propriateness nursuant
� to Au�usta. Geor�Code Title 7. Cha�ter 4. Article 4. A�nlication to Preservation
Commission for certificate of an�ro�riateness.
_�bl Prior to mothballing a structure. the nronert owners will be reauired to
re�ister the vacant �ro�ertv with the Au�usta Planning and Develonment
De�artment The Au�usta Plannin� and Develo�ment De�artment will issue a
mothballin�nermit. Within ten (101 da�s of comnletion of the mothballin�. the
propertv owner must contact the Au�usta Plannin� and Development Denartment
to schedule an initial compliance ins�ection Annuall .��ropertv will be
ins�ected for compliance with the �rovisions of this Code Section.

Sec. 7-1-19.6 Comuletion Aeriod
(al Period of com�letion Owners of vacant structures shall have ninetv (901
davs from date of issuance of the mothballin�a �ermit to com�lete mothball the
buildin in�com�liance with these �rovisions.
(bl Extension The Director of the Plannin� and Develo�ment Denartment
mav extend the completion �eriod u� to ninet�901 davs based on unusual
circumstances and financial hardshi�s.
Sec. 7-1-19.7 Initial comnliance insAection.
(al Initial com�liance ins�ection The Plannin� and Develonment
De�artment will conduct an initial mothballin�com�liance ins�ection of the
buildin� and shall issue an acce�tance certificate if the nro�ertv owner has
substantiall� complied with the requirements as set forth in.
(bl Non-acce�tance If the owner has not substantiall�com�lied with the
rec�uirement of this ordinance the department shall issue an issue a note of non-
acce�tance durin� the initial compliance ins�ection the de�artment shall nrovide
the owner with a conv of the noted deficit area(sl. The buildin� owner will have
thirt� (30� davs from the date of ins�ection within which to take corrective
action sl and request another com�liance ins�ection The owner mav be subiect to
other enforcement �roceedin�s under this Code if the department notes the
structure as non-acce�tance durin� a follow-un com�liance ins�ection
Sec. 7-1-19.8 Annual comaliance inspections.
To ensure com�liance the Plannin� and Development De�artment will
conduct annual ins�ections of all structures re�istered under this Code section.
Sec. 7-1-19.9 Enforcement.
The Plannin� and Develo�ment de�artment will be res�onsible for enforcin�
com�liance with the mothballin� ordinance.

Section 7-1-26 Established.
The Plannin� and Development De�artment was effectivelv established bv
the Au�usta Georgia Commission in Au�usta Geor�ia Code Section 8-1-5 herein.
Section 7-1-27 Emalovee auali�cations.
(al Director-Buildin� Official c�ualifications The person in char�e of the
Plannin� and Develo�ment Department shall be known as the Director-Buildin�
Official. The Director-Buildin� Official shall have at least ten (101 vears'
ex�erience or ec�uivalent as an architect en�ineer ins�ector. contractor, or
su�erintendent of construction or anv combination of these, five (51 ea�rs of
which shall have been in res�onsible char�e of work. The Director-Buildin�
Official shall be certified as a buildin official throu�h a reco�nized certification
nro�ram The Director-Buildin� Official shall be annointed or hired bv the
Au�usta Geor�ia Commission and shall not be removed from the office except for
cause after full o�nortunitv has been �iven to be heard on s�ecific char�es before
the Commission.
Sec. 7-1-28. Restrictions on emolovees' business interests.
An office or em�lovee connected with the de�artment exce�t one whose
onlv connection is as a member of the board established bv this buildin� code,
shall not be financiallv interested in the furnishing of labor material, or ap�liances
for the construction, alteration, or maintenance of a buildin�, structure, service.
svstem or in the makin�of �lans or s�ecifications therefore unless he is the owner
of such buildin� Such officer or em�lovee shall not en�a�e in anv work which is
inconsistent with his duties or with the interests of the de�artment.
Section 7-1-29 Records and Renorts.
(al The Director-Buildin� Official shall kee� or caused to be ke�t a record
of the business of the de�artment The records of the de�artment shall be open to
nublic inspection.
(bl The Director-Buildin� Official shall annuall� submit a re�ort to the
Au�usta Geor�ia Administrator coverin� the work of the de�artment durin t�he
nrecedin�vear He ma i�r�orate in said report a summar� of the decisions of
the Construction Advisorv Board durin��ar•
Section 7-1-30 Liabilitv. defense of emulovees for actions taken in the course
of their duties.

Section 7-1-31 Powers and duties of Director-Building Of�cial.
(al The Director-Buildin� Official shall enforce the �rovisions of this
buildin� code and is authorized to render inter�retations of this buildin, c�ode
which are consistent with its spirit and purpose The Director-Buildin� Official's
�ower shall include, but not be limited to, the followin�:

enforce anv of the �rovisions of this buildin�code or whenever the
Director-Buildin¢ Official has reasonable cause to believe that there
exists in anv buildin��on an�aremises anv condition or code
violation which makes such buildin�, structure. premises. electrical.

hazardous the buildin official mav enter such buildin�. structure or
premises at all reasonable times to insnect the same or to �erform
anv dutv imposed u�on the Director-Building Official bv this buildin�

Sec. 7-1-47. Comuosition.
The Board shall be com�osed of the followin�:
a. One (11 licensed electrical contractor;
b. One (11 master �lumber;
c. One (11 licensed HVAC contractor;
d. One 11 commercial contractor;
e. One (11 residential contractor;
f. One (11 architect:
g. One (1) electrical en i� neer;
h. One (11 consultin en i� neer;
i. One (11 consumer member-Su�er District 9; and
�. One (11 consumer member-Su�er District 10.
k. One ( 11 Residential-Li�ht Commercial Contractor.
Members. other than the initial members, shall be a ointed for terms of
four (41 vears. Vacancies shall be filled for an unexpired term in the amount of
which the ori i�p.nointments are rec�uired to be made. Continued absence of
an member from re ular meetin s of the Board shall. at the discretion of the
Commission render any such member liable to immediate removal from office.
The Au�usta Geor ia�em�lovee holdin��osition of Director-Buildin�
Official of the Plannin� and Develo�ment De�artment shall be res�onsible for all
administrative duties and su�ort to the Advisorv Board. The Director-Buildin�
Official, Buildin��ectors. Plannin� Commission Director. Utilities Department
Director, and Fire Chief, em�loved bv Augusta Geor�ia shall serve in an advisorv
capacitv as non-votin�. ex-officio members of the Advisorv B, oard.
At its first meetin� of each calendar �ear, the construction Advisorv Board
shall elect one (11 of its members as Chairman and one (11 of its me mbers as Vice-
Chairman to serve durin� the calendar �ear and until his/her successor has been
elected and c�ualified for office The Chairman shall �reside at meetin�s of the
Advisorv Board. In the absence of the Chairman, the Vice Chairman shall preside
at meetin�s. In order to take anv action a auorum of at least a maioritv of votin�
members of the Advisorv Board must be �resent at the dulv called meetin .�A
vote of a maioritv of the votin� members present at the dulv called meetin�at
which a�uorum is �resent shall be rec�uired to ado�t or a��rove anv �roposed
action bv the Board.
The Construction Advisorv Board shall meet on the second Thursda in each
of the followin� months: Januarv March Ma��. Se�tember, and November.
Snecial meetin s�mav be called bv the Chairman, or Vice-Chairman, as he/she
deems necessarv.
Sec. 7-1-48. Duties.
The Construction Advisorv Board shall adont such reasonable rules and
re�ulations as are necessarv for the conduct of its affairs and shall, when needin�
le�al advice. consult with Au�usta, Geor�ia Attorne .��h the de�artment
Director/Buildin� Official. It shall be the duties of the Construction Advisorv
Board to:
(al Serve in an advisorv ca�acitv to the Commission on matters �ertainin�to
Construction.
(bl Conduct mediation hearin�s to resolve differences of opinions in the
inter�retation of all construction codes and insnection �rocedures in force in
Au�usta, Geor �i�a.
(cl Make recommendations to the Commission concernin� unresolved
matter in interpretation of codes and ins�ection �rocedures.
(dl The Advisorv Board Committee will not make anv chan�es from the
standard codes ado�ted if it is felt that anv code does not meet Au�usta,
Geor�ia's needs due to unique �hvsical or climatolo�ical conditions, a
pro�osal to modifv a code mav be submitted to the Commission throu�h the
de�artment DirectorBuildin� Official.
�e) Serve as a liaison between the Au�usta. Geor�ia and builders.
develo�ers desi n��rofessionals and other disciplines involved in the
buildin� and develo�ment industries This dutv includes dissemination of
information such as ado�tion of new buildin� codes and chan e� s in nolicies
to these r�ou�s and the e��ublic.

Sec. 7-1-86. Issuing Permits.
(al Action on nertnits. The Director-Buildin� Official shall act unon an
antilication for a permit with �lans as filed or as amended without unreasonable or
unnecessarv dela� If the Director-Buildin� Official is satisfied that the work
described in an a�nlication for permit and the documents filed therewith conform
to the rec�uirements of the technical codes and other �ertinent laws and ordinances,
he shall issue a permit therefor to the ap�licant.
(bl Refusal to issue �ermit If the a�nlication for a�ermit and the
accom�an�in� documents describin� the work do not conform to the rec�uirements
of the technical codes or other �ertinent laws or ordinances the Director-Buildin�
Official shall not issue a�ermit. but shall return the documents to the aunlicant
with his refusal to issue such �ermit Such refusal shall when requested, be in
writin� and shall contain the reasons therefor.

where said buildin� is to be chan�ed and said chan�e will affect the exterior walls,

aublic lane or for the �lacin o�n anv lot or �remises of lot or �remises unless the
annlicant has made a�nlication at the office of the Director of Plannin� and
Develo�ment for the lines of the public street on which he �ro�oses to build erect

Sec. 7-1-116-2. Definitions.
The followin� words. terms and �hrases. when used in this article. shall have
the meanings ascribed to them in this section exce�t where the context clearlv
indicates a different meanin�:
Buildin�s�ector/Consultant means a�rivate �erson or entitv which
performs or offers to �erform buildin��ection/consultin� services.
Buildin� official means that �erson desi�nated with the_title of buildin�
official em�loved within the Plannin� and Development.
Certificate means a re certificate issued in accordance with this

Commercial contractor means a�erson or entitv which performs, su�ervises
or offers to �erform or su�ervise the construction, installation, alteration.
re�lacement or re�air of a buildin� or structure or the improvement of anv kind to
real pro�erty for which a�ermit is rec�uired bv the Code of Ordinances of
Au�usta. Geor�
Commission means the Au�usta Geor �ia Commission which is also known
as the Au�usta Commission.
Construction Board means the Au�usta Construction Advisorv Board
established under this cha�ter see & 7-1-461.
Continuin Education Units means credits that are received for �artici�ation
in continuin� education and �rofessional develo�ment activities. i.e. attendin�
Construction Advisor Board meetin�s Subdivision Re�ulation Committee
meetin�s. and construction, develo�ment. and environmental seminars. etc.
De�artment means the Plannin� and Develo�ment De�artment
Desi �nated Committee means a committee of the commission desi�nated b�
the commission to act as �rovided for in this article.
Residential builder means a�erson or entit� which �erforms. su�ervises, or
offers to �erform or su�ervise the construction repair im�rovement or re-
im�rovement of a residential buildin� or structure which is not over three feet in
hei�ht and which does not have more than sixteen units in anv sin le�apartment
building_ and/or anv ancillarv structures or facilities related to such residential
buildin�s for which a�ermit is rec�uired bv the Code of Ordinances of Au�usta,
Geor�ia. Residential builders are authorized to builds commercial structures unon
to 5.000 sc�uare feet of heated area.
S�ecialtv contractor means a�erson or entit� which is not a re ist�ered
residential builder or commercial contractor which �erforms or offers to �erform
construction installation alteration repair imnrovement. or alteration of a s�ecific
asnect of an�nart of a buildin�. structure or other im�rovement to real estate which
reauires special skills and involves the use of specialized construction trades or
craft. involvin� the followin� elements of construction work for which a nermit is

meetin� or seminar that is attended.
(B) The Plannin� and Develo�ment De�artment shall re�ister the
�nlicant as a residential builder it based on the information �enerated in the
�ulication �rocess or obtained from sources reasonably believed bv the
commission to be credible the commission finds that the a�nlicant has met all the
requirements and demonstrated an abilitv t��age in the business of servin� as a
residential builder in the Cit The submission of false or misleadin information

(al An��erson mav a�neal a notice order or decision of the Director-
Buildin� Official to the Au�usta Geor�ia Construction Advisorv Board when it is
claimed that the true intent of the codes or standards described in this section have

Buffer shall mean a�ortion of a lot tract or parcel set aside for onen snace.
and visual screenin�nur�oses �ursuant to annlicant �rovisions of this ordinance.
to separate different use districts or to setiarate uses on one �ro�ertv from uses on
another�ro�ertv of the same use district or different use district.
Construction and demolition waste means waste buildin� materials and
rubble resultin� from construction. remodelin�, repair. and demolition oneration on
navements houses commercial buildin and other structures. Such waste
include. but are not limited to asbestos containin waste, wood. bricks. metal,
concrete. wall board. �a�er, card board. inert waste landfill material. and other
non-�utrescible waste which have a low�otential for �roundwater contamination
as defined in the Geor Rules for Solid Waste Mana�ement 391-3-4-.0(141.
Containment shall mean the act. �rocess. or means of containin� fluids to
nrevent s�illage of contents onto the soil water wavs sewer svstem, storm water
svstem or anv other means exce�t throu�h �ro�er dis�osal procedure
Contaminate shall mean the intrusion or contact with dirt or foulness from
an outside source to taint stresses the loss of �urit� or cleanliness that follows
contamination to soil stain stain corrun or infect b v contact or association.
Dis�osal facilit� shall means anv facilitv or location where the final
de�osition of solid waste occurs and includes. but is not limited to, land fillin�
solid waste thermal treatment technolo�v facilities.
Enforcement The Plannin� and Develo�ment De�artment.
Generator shall mean anv waste �enerated or accumulated at anv facilitv
�in� within Au�usta. Geor�ia under dail� o�erations. for commercial �ain or mass
distribution.
Inventorv shall mean a written recorded descri�tion and c�uantitv of
materials.
Junkvard salva�e vard recvclin� facilitv shall mean anv place where waste,
discarded or salva�ed materials are bought, sold. exchan stored, baled,
cleaned �acka�ed disassembled or handled• includin� automotive wreckin�
�ards automobiles used �arts lots used lumber vards. salva�ed buildin� materials,
salva�ed household a�nliances or other t�es of material: but excluded
establishments for the sale, �urchase. or stora�e of used automobiles in runnin�
condition used furniture or salva�ed materials used as �arts of a manufacturin�
�rocess on the same site.
Leachate shall mean a liquid that has �assed throu�h or emer�ed from solid
waste and contains soluble sus�ended or miscible materials removed from such
waste.
Le a�llv existin� business. A business that is in compliance with the Au�usta.
Geor i� a Com�rehensive Zonin� Ordinance and the business owner/onerator is in
nossession of a current Occu�ation Tax Certificate.
Mani�'ests/recei�t shall mean a form or document used for identifvin� the
auantitv or com�osition and the ori�in, routin� and destination of snecial solid or
lic�uid waste durin�anv intermediate point of �eneration throu�v intermediate
points to the �oint of dis�osal, treatment or stora�e.
Occu�ation tax certificate holder means any nerson(sl. firm or cor�oration
who owns a business and/or holds an Occu�ation Tax Certificate within Au u� sta,•
Geor�ia and/or o�eratin� with an Occu�ation Tax Certificate in Au�usta. Georgia.
Ordinance administrator The Director of the Plannin� and Development
De�artment.
Owner means the �erson(sl firm or corooration who owns a parcel of
pro�ertv lvin� within Au�;usta, Geor�

Person shall mean anv individual firm, �artnership. association. comnanv.
�rou ,� .��anization of any kind.
Petroleum contaminated soil shall mean an soil tainted or affected bv anv
netroleum or a substance containin�anv traces of �etroleum constitutes.
Pre-existin� iunkvard. salvage vard. automobile wrecking vard. and/or
recvclin� facilitv Prior to the date of Ordinance im�lementation.
Reclamation shall mean the reconditionin� or rehabilitation of affected land
under the iunkvard salva�e vard automobile wreckin�vard. and recvclin� facilitv.
Such as refillin� and re-�ackin¢ the excavated areas with suitable materials. such
as dirt. and/or sand.
Recovered materials �rocessing facilitv shall mean a facilitv en�a�ed solelv
in the stora�e �rocessin¢ and resale or reuse of recovered materials. Such term
shall not include a solid waste handlin f���rovided, however. anv solid
waste �enerated bv such facili� shall be subiect to all apnlicable laws and
re�ulations relating to such solid waste.
Recvcling shall mean an� �rocess bv which materials which would
otherwise become solid waste or collected se�arated nrocessed and reused or
returned in the form of raw materials or �roducts.
Regulato� fee. Pavment whether desi�nated at license fees. �ermit fees. or
bv another name which are re�c uired bv a local �overnment as an exercise of its
nolice �ower and as a nart of or an aid to re�ulation of an occu�ation, nrofession.
or business.
Run-off ineans an v rainwater, leachate. or other lic�uid that drains over land
from an nart of a facilitv.
Salva collec table mateYials shall mean those materials
which have known use reuse or recvclin�notential• can be feasiblv used. reused
or recycled• and have been diverted or removed from the solid waste stream for
sale use reuse or recvclin� whether or not rec�uirin s�c�uent senaration and �
processin�
Solid waste/waste shall mean an� �arba�e or refuse includin� solids. semi-
solids lic�uids �aseous materials that have no use or future use.
State waters includes anv and all rivers. streams. cr eeks. branches, lakes.
reservoirs �onds draina e�svstems s�rin�s wells and other bodies of surface or
subsurface water, natural or artificial, lvin� within or formin� a�art of boundaries
of the state which are not entirelv confined and retained completelv unon the
pro�ertv of a single individual �artnership or cor�oration
Tire shall mean a continuous solid or �neumatic rubber coverin� desi�ned
for encirclin� the wheel of a motor vehicle nor a nart of the motor vehicle as
ori i�c�ui�ment.
Waste shall mean all discarded substances and materials whatsoever
exceedin��ounds (10 lbs.l in wei�ht or fifteen cubic feet (15 ft.31 in volume.
or anv such substance in an��ht or volume if _ biomedical waste. hazardous
waste a hazardous substance or anv such substance or material dum�ed for
commercial pur�oses With the exce�tion of non-hazardous. low-impact animal
bv-nroducts classified bv the Geor i��artment of Natural Resources, "waste"
includes without limitation, sand. �ravel, slag brickbats, rubbish, waster material,
tin cans, refuse, ��e, trash, debris, dead animals, bottles, boxes. containers,
na�ers tobacco �roducts tires apnliances mechanical ec�ui�ment or �arts
buildin� or construction materials tools machinery wood motor vehicles and
motor vehicle �arts. vessels. aircraft equipment. waste oil. batteries. antifreeze.
slud�e from a wastewater treatment facility water sup.nlv treatment �lant. or air
pollution control facility air contaminants from anv source or facilitv, and anv
other discarded material or substance of every kind and descri�tion resultin fr�om
domestic, industrial, commercial, minin�, or �overnmental o�erations.
Waste stream shall mean the �oint of �eneration/ori�in of said waste (as
definedl manner in which it is recovered trans�orted final destination site for
generator and/or dis�osal �oint.

(a) Anpointment of nublic o�cer. The Au�usta Geor�ia Commission
a��oints and desi�nates the Director Plannin� and Develo�ment and his/her
desi ne�e as public officer(sl to exercise the�owers �rescribed bv this Article:
(b) Procedures for determining nremises to be unsafe or unhealthful.
(1) Whenever a rec�uest is filed with the public officer bv a nublic
authorit or bv at least five (51 residents of Au�usta char�in� that
anv dwellin� buildin� or structure is unfit for human habitation or
for commercial industrial or business use and not in Compliance
with a�nlicable codes• is vacant and bein� used in connection with
the commission of dru� crimes: or c onstitutes an endan�erment to
the �ublic health or safety as a result of unsanitarv or unsafe
conditions the �ublic officer shall make an investi�ation or
ins�ection of the specific dwellin� buildin� structure. or nronertv.
If the public officer's investi�ation or ins�ection identifies that anv
dwellin� building structure or �ronertv is unfit for human
habitation or for commercial. industrial, or business use and not in
com�liance with a�nlicable codes: is vacant and being used in
connection with the commission of dru crimes: or constitutes an
endan�erment to the �ublic health or safetv as a result of
unsanitatv or unsafe conditions the uublic officer shall make an
investi�ation or insnection of the s�ecific dwellin�. buildin�,
structure or progertv If the officer's investi�ation or insnection
identifies that an v dwellin buildin or structure is unfit for
human habitation or for commercial industrial. or business use and
not in com�liance with a�nlicable codes: is vacant. and bein� used
in connection with the commission of dru� crimes: or constitutes
an endan�erment to the �ublic health or safetv as a result of
unsanitarv or unsafe conditions the �ublic officer mav issue a
com�laint in rem a�ainst the lot, tract, or �arcel of real nronertv on
which such dwellin� buildin or structure is situated or where
such �ublic health hazard or �eneral nuisance exists and shall
cause summons and a co�v of the complaint to be served on the
owner and �arties in interest in such dwellin�, buildin�. or
structure The com�laint shall identifv the subiect real �ropertv bv
a���riate street address and official tax map reference: identifv
the owner of the parties in interest• state with �articularitv the
factual basis for the action: and contain a statement of the action
sou��the �ublic officer to abate the alleged nuisance. The
summons shall notifv the owner and parties in interest that a
hearin shall be held not less than fifteen (151 davs nor more than
fort�-five (451 davs after the filin� of said com�laint in court. The
owner and �arties in interest shall have the ri�ht to file an answer
to the com�laint and to a�ear in nerson or bv attornev and offer
testimonv at the time and �laced fixed for hearin�
(2) If after such notice and hearin� the court determines that the
dwellin� buildin� or structure in c�uestion is unfit for human
habitation or is unfit for its current commercial, industrial. or
business use and not in com�liance with a��licable codes: is
vacant and bein used in connection with the commission of dru�
crimes• or constitutes an endan�erment to the public health and
safetv as a result of unsanitarv or unsafe conditions. the court shall
state in writin f�gs of fact in sunnort of such determination
and shall issue and cause to be served u�on the owner and anv
narties in interest that have answered the complaint or a��eared at
the hearin� an order:
a. If the re�air alteration or im�rovement of the said
dwellin� buildin or structure can be made at a
reasonable cost in relation to the �resent value of the
dwellin�, buildin�. or structure, rec�uirin� the owner.
within the time s�ecified in the order, to re�air, alter, or
im�rove such dwellin� buildin� or structure so as to
brin� it into full com�liance with the a��licable codes
relevant to the cited violation and if a�nlicable, to secure
the structure so that it cannot be used in connection with
the commission of dru� crimes; or
b. If the re�air alteration or im�rovement of the said
dwellin buildin�. or structure in order to brins it into
full com�liance with a�nlicable codes relevant to the
cited violations cannot be made at a reasonable cost in
relation to the �resent value of the dwellin�. building. or
structure requirin� the owner within the time specified
in the order to demolish an remove such dwellin�.
buildin� or structure and all debris from the pronertv
For �ur�oses of this Article the court shall make its
determination of reasonable cost in relation to the �resent
value of the dwellin� buildin� or structure without
consideration of the value of the land on which the
structure is situated: �rovided. however, that costs of the
nre�aration necessarv to re�air alter, or im�rove a
structure mav be considered Income and financial status
of the owner shall not be a factor in the court's
determination The �resent value of the structure and the
costs of re�air alteration or im�rovement mav be
established bv affidavits of real estate a��raisers with a
Geor i��nraiser classification as �rovided in Chanter
39A of Title 41 of the O.C.G.A.. �ualified buildin�
contractors or c�ualified buildin��ectors, without
actual testimony nresented Costs of re�air. alteration. or
im�rovement of the structure shall be the cost necessarv
to brin� the structure into com�liance with the annlicable
codes relevant to the cited violations in force in the
iurisdiction.
c. If the owner fails to comnlv with an order to repair or
demolish the dwellin buildin or structure. the �ublic
officer mav cause such dwelling buildin , or structure. to
be repaired, altered. improved, to be vacated and closed,
or demolished The �ublic officer shall cause to be
nosted on the main entrance of the buildin�, dwellin .�or
structure a placard with the followin� words:
`This buildin is unfit for human habitation or
commercial industrial or business use and does not
complv with a�nlicable codes or has been ordered
secured to �revent its use in connection with dru� crimes
or constitutes an endan�erment to �ublic health or safetv
as a result of unsanitarv or unsafe conditions. The use or
occu�ation of this buildin� is �rohibited and unlawful.'
d. If the �ublic officer has the structure demolished,
reasonable effort shall be made to the salva�e reusable
materials for credit a�ainst the cost of demolition. The
�roceeds of anv�vs received form salvased
materials shall be used or annlied a�ainst the cost of the
demolition and removal of the structure. and �ro�er
records shall be ke�t showin� annlication of sales
nroceeds Anv such sale of salva�ed materials ma ��be
made without necessit of p ublic advertisement and bid.
The �ublic officer and Au�usta are relieved of anv and
all liabilit resultin form or occasioned bv the sale of
anv such salva�ed materials. includin�. without
limitation defects in such salva�ed materials.
e. The amount of the cost of demolition, includin� all court
costs a�nraisal fees administrative costs incurred bv the
tax commissioner, and all ot her costs necessarilv
associated with the abatement action, includin�
restoration to �rade of the real �ro�ertv after demolition.
shall be a lien a�ainst the real �ro�ertv u�on which such
cost was incurred.
i. The lien �rovided for in �ara�ra�h c of subsection
2. Of this Ordinance section shall attach to the real
nro�ertv u�on the filin� of a certified co�v�
order requirin� re�air closure or demolition in the
Office of the Clerk of Su�erior Court in Richmond
Countv and shall relate back to the date of the
filin� of the lis pendens notice rec�uired under
subsection (�1 of O.C.G.A. � 41-2-12. The Clerk
of Su�erior Court shall record and index such
certified co�v of the order in the deed records of
Richmond Countv and enter the lien on the e�
execution docket The lien shall be su�erior to all
other liens on �ro�ertv exce�t liens for taxes to
which the lien shall be inferior, and shall continue
in force until �aid After filin� certified co�v of
the order with Clerk of Sugerior Court. the �ublic
officer shall forward a conv of the order and final
statement of costs to the countv tax commissioner.
It shall be dutv of the countv tax commissioner to
collect the amount of lien in con with the
collection of ad valorem taxes on the nro�ertv and
to collect the amount of the lien as if it were real
nro�ertv ad valorem tax, includin�s�ecificallv
Cha�ter 4 of Title 48 of the O.C.G.A., �rovided.
however. that the limitation of O.C.G.A. & 48-4-78
which requires twelve (121 months of delinc�uencv
before commencin� a tax foreclosure shall not
annlv The tax commissioner shall remit the
amount collected to the �overnin� authorit of
Au�usta Geor�ia. Thirt�davs (301 after
im�osition of the lien the unnaid lien amount shall
bear interest and �enalties in the same amount as
annlicable to interest and uenalties on un�aid real
nro�ertv ad valorem taxes.
ii. The tax commissioner shall collect and retain an
amount equal to cost of administerin� a lien
authorized by O C G A � 41-2-7 et sec�. unless
such costs are waived b� a resolution of Au�
Anv such amount collected and retained for
administration shall be deposited in the e�
fund of the countv, to �a�the cost of administerin�
the lien.
iii. Au�usta ma� waive the release anv such lien
im�osed on �ro�ertv u�on the owner of such
nro�ertv en�terin_� into a contract with the countv or
municipalitv agreein� to a timetable for
rehabilitation of the real �ronertv or the dwellin�
buildin� or structure on the �ro�ert� and
demonstratin�the financial means to accomnlish
such rehabilitation.
iv. Where the abatement action does not commence in
the su�erior court review of a court order
requirin t�pair alteration, improvement. or
demolition of a dwellin� building� or structure
shall be bv direct a�neal to Richmond Countv
Su�erior Court under O.C.G.A. � 5-3-29.
v. The �ublic officers desi�nated herein mav issue
citations for violations of state minimum standard
codes o�tional building fire. life safety. and other
codes ado�ted b� ordinance. and conditions
creatin�a �ublic health hazard or �eneral nuisance.
and mav seek to enforce such citation in anv court
of com�etent iurisdiction �rior to issuin� a
complaint in rem as provided in this Article.
vi. Nothin� in this Article shall be construed to imnair
or limit in anv wa� the �ower of Au�usta to define
and declare nuisances and to cause their removal
or abatement bv summarv nroceedin�
otherwise.
(c) Powers of Public Officers. The nublic officer(sl designated in this
Article shall have the followin�nowers:
(1) To investi�ate the dwellin� conditions in Au�usta in order to
determine which dwellings buildin or structures therein are
unfit for human habitation or are unfit for current commercial_,
industrial. or business use are v acant, dilanidated, and bein� used
in connection with the commission of dru� c� rimes;
(2) To administer oaths and affirmations to examine witnesses. and to
receive evidence:
(3) To enter u�on premises for the �uroose of makin� examinations:
arovided however that such entries shall be made in such manner
as to cause the least �ossible inconvenience to the �ersons in
nossession:
(4) To a�noint and fix the duties of such officers, a�ents. and
em�loyees as he or she deems necessarv to carrv out the pur�oses
of this Article: and
(5) To dele�ate anv of his or her functions and �owers under this
Article to such officers and a�ents as he or she mav desi�
(d) Services of Com�laints.
�
(1) Com�laints issued bv a public officer �ursuant to this Article shall
be served in the followin� manner: __In all cases, a copv of the
com�laint and summons shall be conspicuouslv �osted on the
subiect dwellin� buildin� or structure within three (31 business
davs of filin� of the com�laint and at least ten (101 da�s prior to
the date of the hearin� A conv of the com�laint and summons
shall be served in one of the followin� wa�
a. Personal service u�on each owner and �artv in interest if
such �arties are residents of the countv. Service shall be
perfected at least ten (101 davs �rior to the date of the
hearin� Service mav be made b� the �ublic officer
desi�nated b� this Article to abate nuisances or b��v
law enforcement officer of Au�usta; and a return of
service filed with the clerk of the a�nropriate court shall
be deemed sufficient �roof that service was �erfected;
b. Pursuant to the �rovisions of O.C.G.A. � 41-2-12: or
c. Statuto overni ht deliverv.
(2) If anv owner or �art� in interest is a resident of this State but
resides outside of the Countv service shall be �erfected bv
certified mail or statutorv overni�ht deliver�, return receint
rec�uested to the most recent address shown on the Countv tax�files
and mailed at least fourteen (141 davs �rior to the date of the
hearin�
(3)Non-residents of this State, whose mailin� address is known, shall
be served bvi certified mail or statutor�overni�ht deliverv. return
recei t re uested, mailed at least fourteen (141 da s rior to the
date of the hearin For non-residents who mailin� address is
unknown. a notice statin� the date. time, and place of the hearin�
shall be �ublished in the newspaner in which the Sheriff s
advertisements a near in such Countv once a week for two (21
consecutive weeks �rior to the hearin�.
(4) In the event either the owner or an��art� in interest is a minor.
estate an incom�etent �erson or �erson laborin� under
disabilities the �uardian or other �ersonal representative of such
personal shall be served: should such �uardian or �ersonal
re�resentative reside outside the Count�or is a non-resident of this
State, he or she shall be served as �rovided for in (dl subsection (61
of this Section If such owner or partv in interest has no �uardian
or �ersonal re�resentative service shall be perfected bv servin� the
jud�e of the Probate Court of Richmond Count�at least thirty�301
davs �rior to the date of the hearin w�h�ich '�ud�e shall stand in the
n lace of and rotect the ri hts of such minor, estate. or
incom�etent �erson or a�noint a�uardian at litem for such �erson.
(5) In the event of unknown �ersons or unborn remaindermen who are
likel� to have an��hts in the nro�ertv or interest or the �roceeds
thereof the iud�e of the Probate Court of the countv wherein such
propert� or interest is located shall be �ersonallv served at least
thirtv (301 da��rior to the date of the hearin�, and it shall be the
dutv of the '�ud�e of the Probate Court to stand in the �lace of and
nrotect the ri�hts of such unknown �arties or unborn
remaindermen.
(6) In the event the whereabouts of anv owner or �art� in interest is
unknown and the same cannot be ascertained bv the �ublic officer
in the exercise of reasonable dili�ence or if anv owner or �artv in
interest cannot. after due dili�ence. be served as �rovided in this
Section, the �ublic officer shall make an affidavit to that effect ad
serve b��ublication in the manner provided in subsection (51 of
this Section and such �ublication shall be sufficient �roof that
service was perfected.
(7) A notice of lis �endens shall be filed in the Office of the Clerk of
Su�erior Court in the countv in which the dwellin�, building. or
structure is located at time of filing the com�laint in the
annronriate court Such notice shall have the same force and effect
as other lis �endens notices �rovided b� law.
(8) Orders and other filin�s made subsequent to services of the initial
com�laint shall be served in the manner �rovided in this Section on
the owner and an�nartv in interest who answers the comnlaint or
annears at the hearin Anv nart�who fails to answer or annear at
the hearin shall be deemed to have waived all further notice of the
uroceedin�s.
(9) Continued Use of Other Laws and Ordinances. It is the intent of
the Augusta Geor�ia Commission that nothin� in this Article shall
be construed to abro�ate or imnair the �owers of the courts or of
any de�artment of Au�usta to enforce an��rovisions of anv local
enablin Act charter, or ordinance or re�ulation nor nrevent or
nunish violations thereof and the �owers conferred bv this Article
shall be in addition to and sunnlemental to the �owers conferred bv
anv other law or ordinance le�islation. or regulation.
