RESOLUTION
RESOLUTION AUTHORIZING THE SETTLEMENT OF ALL CLAIMS
BY THEODORE R. MCNEAL, IN THE AGGREGATE AMOUNT OF
SEVENTEEN THOUSAND AND FIVE HUNDRED DOLLARS
($17,500.00); AUTHORIZING THE ADMINISTRATOR TO DISBURSE
THE AMOUNT OF SEVENTEEN THOUSAND AND FIVE HUNDRED
DOLLARS ($17,500.00); AND FOR OTHER PURPOSES.
WHEREAS, on or about June 15, 20ll a tree limb fell at 940 D'Antignac Street,
Augusta, Georgia 30901; and
WHEREAS, said limb fell on Theodore R. McNeal and two vehicles owned by Theodore
R. McNeal; and
WHEREAS, Theodore R. McNeal suffered injuries, and Theodore R. McNeal's vehicles
were damaged; and
WHEREAS, Theodore R. McNeal lost wages, and amassed medical bills as a result of
the incident; and
WHEREAS, Theodore R. McNeal has not filed a lawsuit and wants to resolve his claims;
and
WHEREAS, Theodore R. McNeal has agreed to settle all claims against Augusta,
Georgia, pursuant to the attached Settlement Agreement and Release, far the sum of Seventeen
Thousand and Five Hundred Dollars ($17,500.00); and
WHEREAS, it is in the best interests of August, Geargia to resolve this matter and pay
the amount of Seventeen Thousand and Five Hundred Dollars ($17,500.00) to Theodore R.
McNeal to settle all claims of Claimant against Augusta, Georgia arising out of the alleged facts;
and
WHEREAS, Augusta, Georgia acknowledges that the payment set forth herein does not
constitute any admission of liability on the part of Augusta, Georgia and liability is expressly
denied; and
NOW, THEREFORE, BE IT RESOLVED by the Augusta, Georgia Board of
Commission,
Section l: The Augusta, Georgia Board of Commission will settle the claims of
Theodore R. McNeal for the sum of Seventeen Thousand and Five
Hundred Dollars ($17,500.00).
Section 2: The Administrator is authorized to pay a total sum of Seventeen Thousand
and Five Hundred Dollars ($17,500.00) to Theodore R. McNeal at the
direction of the Commission and payment shall be in the form of a check

payable to "THEODORE R. MCNEAL" and shall be taken from account
number 6110152135523101.
Section 3: To the extent that any section of the AUGUSTA, GA. CoDE is in conflict
herewith, that subsection is waived for this instance only.
