As a follow-up to your recent memo of September 12, 2011, this is to inform you that under the
provisions of 24 CFR Part 58.35 (b)(5) the homebuyer subsidy program is categorically excluded from the
environmental review requirements of the National Environmental Policy Act (NEPA) and the related
Federal laws and authorities listed at 24 CFR Part 58.5. Because the program is categorically excluded
from environmental review, Augusta-Richmond County does not have to publish a Finding of No
Significant Impact (FONSI) and does not have to submit an environmental certification and Request of
Release of Funds (RROF) to HUD.
The Housing and Urban Development Department's (HUD) environmental regulations do require that
Augusta-Richmond County document in its Environmental Review Record (ERR) to carry out any
requirements listed at 24 CFR Part 58.6 related to the Flood Disaster Protection Act, the Coastal Barriers
Improvement Act, and the purchase or sale of existing property in a Runway Clear Zone. I have reviewed
the locations of the Subject property and found it is not located in a special flood hazard area, coastal
barrier resources area, or runway clear zone.
The environmental review for the above referenced property is now complete. -
