As a follow-up to your recent memo of September 1, 2011, this is to inform you that under the
provisions of 24 CFR Part 58.35 (b)(5) the down payment assistance program is categorically exc(uded
from the environmental review requirements of the (Vational Environmental Policy Act (NEPA) and the
refated Federa( laws and authorities listed at 24 CFR Part 58.5. Because the program is categorically
excluded from environmental review, Augusta-Richmond County does not have to publish a Finding of
No Significant Impact (FONSI) and does not have to submit an environmental certificatian and Request
of Release of Funds (RROF) to HUD.
The Housing and Urban Development Department's (HUD) environmental regulations do require that
Augusta-Richmond County document in its Environmental Review Record (ERR) to carry out any
requirements listed at 24 CFR Part 58.6 related to the Flood Disaster Protection Act, the Coastal Barriers
improvement Act, and the purchase or sale of existing property in a Runway Clear Zone. I have reviewed
the focations of the Subject property and found it is not located in a specia! flood hazard area, coastal
barrier resources area, or runway clear zone.
The environmental review for the above referenced property is now compfete.
