THiS AID AGREEMENT, entered into this the � day of _ f _ 2011, by and amon Columbia County, Georgia, a political subdivi ion of the State of or,�ia (the � "County") and the Augusta, Georgia a political subdivision of the State of Georgia ("Augusta"). � 'VV�Ei2EAS, Augusta owns ti�e Augusta Regional Airport (the "Airport") which serves, among others, the residents af the County, with many of the flights arriving and departing from the Airpart flying aver the County; �VHEit�A5, Augusta has establis�ed and maintains at t�e �lirport, a fire department (the "Airport Fire Department") that has the equipment, supplies and training to fight fires occurring from a plane crash or conflagration; 'V4��REAS, the pwrpose of this agreem�,mt is to have the parties hereto estabiisi�, through their mutual cooperation, a pre-determined plan for dealing with an airplane crash or conflagration in the County, which may demand special fire services, equipment, supplies and trained personnel that the County's Fire Department does not have; �VHEREAS, it is deemed ta be in the public interest for the parties heretv to enter into an agreement for mutual assistance in fire protection and support during an airplane crash or conflagration in the County, in order to increase fire defenses a.nd to assure proper fire control; NOW, THEREFORE, in consideration of the mutual covenants contained herein by and between the pasties hereto, it is hereby agreed as follows: l. Should it become necessary to activate the terms ofthis Agreement as herein set forth, due ta a plane crash or conflagratian in the County, Augusta gha.�l give the Chief of the Airpart's Fire Department or his desig�nees, the authority, upon notification by the County to Augusta or the Airpprt Fue Departrnent that a plane crash or canflagration emergency in the County does, in fact, e�st and that aid is needed, to order availabte apparatus, equipment, supplies and manpower of th� Airport Fire Department into action to assist the County as may be needect. 2. it sha11 be the responsi�iirty ofthe Ci�ief ofthe Airport's Fire Department to see that �li personnel responding to the County's request for assistance are responsible persons and that the conduct and actions of said personnel sha11 be the responsibility of Augusta. Such emplayees shall have the same powers, duties, rights, privileges, and immunities as if they were performing their duties in Augusta. 3. Each party to this Agreemettt shall assume a11 liability and responsibility for the death of or injury to any personnel of their own command responding to the request for aid from the County. 4. Augusta while responding under the terms of this Agreement through its Airport Fire Department shall assume no responsibility or liability for property damaged or destroyed at the 1 � ♦ _ , actual scene of any airplane crash or conflagration in the County due to firefighting ancl rescue operations, fire control tactics and strategy or other operations as may be required or ordered; said liability and responsibility shall rest solely with the party requesting such aid and within whose boundaries the praperty shall exist, or the incident occur. 5. Augusta while responding to the request for aid under the terms of this Agreement sha11 assume all liability and responsibility for dama$e to its own apparatus and/or equipment. Augusta while responding shall alsa assume all liability and responsibility for any damage caused by its own apparatus or equipment while in route to or returning from a specific location in the County. 6. The County when requesting aid shall in no way be deemed liable or responsible for the personal property of the members of the Airport Fire Department which may be lost, stolen or damaged while performin� their duties under the response terms herein. Augusta when responding and fumishing any equipment shall bear the loss or damage to such equipment and sha11 pay any expense incuned in the oper�tion and maintenance theFeof. 7. Each party to this A�reement shail assume a11 costs of salaries, wages, bonuses or other compensation for its own personnel that respond for duty under the terms of this Agreement; shall compensate its employees during the time of fighting the fire from the airplane crash or conflagration; and shall defray the actual travel and maintenance eacpenses of such employees whiie they are engaged in such activities. Such compensation shaii include any amounts paid or due for compensation due to personal injury or death while such employees are engaged in rendering such aid. 8. Each party shail also assume ail costs invoiving the use of its apparatus, equipment and tools used specifically fighting the plane crash fire or conflagration and shall make no charge for such use to the other party; however, any special eartinguishing agents used by Augusta from its own supply shall be paid for by the County upon receipt of an itemized statement of costs for such e�inguishing agents. 9. Upon receipt of a request for assistance by the County and upon a determination by the Chief of the Airport Fire Department that the request may be honored without unreas,.qnably imnairin� the capacitv to provide fire �roteetion at the Airp4rt. the Chief af the Airport Fire Department may take such steps as necessary to fumish apparatus, equipment, supplies, manpower and assistance to the County as he deems appropriate. Such response sha11 remain solely the decision of the Chief of the Airport Fire Department. 10. The Chief of the County Fire Department sha11 in a11 instances be in command of the emergency as tq the aspects of strategy, fire control tactics and over-all direction of the operations. All orders or directions regarding the operations of the Airport Fire Department shall be relayed to the Chief firefighting officer in comrnand of the Airpart Fire Department. 11. Augusta shall not be bound to dispatch apparatus, equipment, supplies or personnel to the assistance of the County but every ei�ort should be made by the Airport Fire Department to furnish such assistance if, in the judgment of the Clvef of the Airport Fire Departmem, such dispatch would not impose upan the Airport a serious imv�o its fire defenses and fire �rptection. 2 f� �•` ♦ � 12. To the extent permitted by law or by contract, a11 of the privileges and immunities from liability; exemption from laws, ordinances, and rules; and all pension, insurance, relie� disability, workers' compensation, salary, death, and other benefits which apply to the activity of sueh officers, agents, or ennployees af Augusta when performing their respective funEtions within the territorial limits aF Augusta shall apply to such officers, agents, or employees to the same degree, manner, and extent while engaged in the performance of any of their functions and duties in the County. Neither party shall be liable for any acts or omissions of the employees of others rendering assista.nce e�raterritorially. This provision shall apply with equal effect to paid, volunteer, and auxiliary employees. 13. Upon notice from the Auport tower of a plane crash in Columbia County, the Airport Fire Department will respond by contacting the Caunty Fire Department personnel to determine if they are aware of the crash and confirm that County is requesting the aid of the Airport Fire Department. 14. Breach af this Agreemez�t by the County or by Augusta shall terminate the entire Agreement. This Agreement shall be in effect untxl June 30, 2013 and will automatically be renewed for an additional period o£two years, unless written notice requesting termination is received by one party from the ather party at least thirty (30) days pz�ior to the date of renewal. Either party may, at any time terminate this agreement upon thirty (30) days prior written notice to the other party. 15. This Agreement sha11 not create any rights for any non-signatory third party.
