HomeMy WebLinkAboutMEMORANDUM OF AGREEMENT BETWEEN RICHMOND COUNTY MARSHAL'S OFFICE AND AUGUSTA AVIATION COMMISSION MEMORANDUM OF AGREEMENT BETWEEN RICHMOND COUNTY MARSHAL'S OFFICE AND THE AUGUSTA AVIATION COMMISSION, AN ENTITY OF AUGUSTA, GEORGIA, A POLITICAL SUBDIVISION OF THE STATE OF GEORGIA /�� �--� This Memorandum of Agreement ("MOA") is made and entered into this `'�ay of � , 2011 ("Commencement Date"), by and between the Augusta Aviation Commission, an entit of Augusta, Georgia, responsible for the o eration of the Au usta Re ional Ai ort P g g �P ("Airport"), and the Richmond County Marshal's Office ("Marshal's Office"), as approved by M. Steve Smith in his capacity as the duly elected Marshal of Richmond County, Georgia ("Marshal") and the Augusta, Georgia Commission as the governing authority of Augusta, Georgia. NOW, THEREFORE, in consideration of the mutual agreements and promises set forth within this MOA, the receipt and sufficiency of which are hereby acknowledged, the Parties agree to the following terms: 1. Law Enforcement Services. The Marshal's Office shall furnish Law Enforcement Services to the Airport. Law Enforcement Services shall include, but not be limited to, furnishing an adequate number of sworn law enforcement personnel to: • Enforce all Augusta, Georgia Ordinances, laws of the State of Georgia, and TSA and FAA Regulations to ensure that the Airport is secure and compliant with said ordinances, laws, and regulations; • Operate as the Airport's primary and immediate contact for security-related activities and communications with the Transportation Security Authority (TSA); • Coordinate and enforce Security Identification Display Area (SIDA) badge processes (subject to TSA audit); • Coordinate and enforce key and lock processes (subject to TSA audit); • Perform Marshal's Operations Center duties twenty-four (24) hours per day; • Manage and control all Airport personnel SIDA applications and related security, law enforcement files and badges; and • Manage emergencies and other special events as determined by the Airport. 2. Personnel. The Marshal's Office shall have a minimum of two (2) Law Enforcement Officers ("LEO's") on duty at all times. The Marshal's Office shall have at least three (3) LEO's on duty from 8:00 a.m. to 6:00 p.m. or any other period of time designated by the Airport as peak time based on flight schedules. The Marshal will ensure that a11 LEO's assigned to the Airport, as well as a group of contingent LEO's, have been trained by the Airport on the federal regulations related to ramp driving, sterile area, and SIDA badging requirements. A contingent group of LEO's, who have received the required training, will be used to manage emergencies, special events, and vacation and sick leave. If deemed necessary by the Airport and the Marshal, the Parties will interview and select an Airport Security Chief to manage the Marshal's Office Detachment at the Airport, whose annual performance evaluation will be conducted by the Airport's Executive Director and will be submitted to Marshal to part of the individual's overall evaluation. 3. Budget. A separate Law Enforcement budget will be established within the Airport's budget, which will be compiled of detailed personnel (salary & fringe benefits of each position), operations, and capital expense. The Airport has approval authoriTy for expenses and the Marshal's Office will be responsible for management within budgetary constraints. The Airport will incur the cost of providing any equipment, supplies, or other items needed (i.e. uniforms, vests, weapons, vehicles, training, etc.) for the Airport Marshal's Detachment so long as such costs are within the budgetary constraints as described above. In consideration for providing and managing the Airport's Marshal's Detachment, the Marshal shall be granted an annual supplement of Twenty-Five Thousand Dollars ($25,000), for contract administration which shall be paid out of tlie Airport's Law Enforcement Budget. The Marshal and the Airport shall work together annually to come to an agreement on an operating and capital budget to be submitted to the Augusta Aviation Commission and the Augusta, Georgia Commission. 4. Term. The term of this MOA shall be from the Commencement Date through December 31, 2011. This MOA will then continue on an annual basis beginning January l of each year and ending December 31 St of each year unless this MOA is terminated under paragraph 5 herein. 5. Termination. The Marshal or the Airport may terminate this MOA upon sixty (60) days written notice. Further, in the event for any reason there is a change in the person holding the office of Marshal, such newly elected or appointed person shall have the right to terminate this MOA within thirty (30) days after taking office. In the event of termination, all vehicles, office furniture, uniforms, uniform equipment, weapons, resources, and other equipment or furnishings purchased by the Aviation Commission to support the Airport's Marshal's Detachment shall be retained by the Aviation Commission.
