An Ordinance to Amend the Augusta, GA. Code Title Eight Chapter One
Article One Sections 8-1-5 through 8-1-9 Relating to the Creation and Duties
of the Planning and Development Department; To Repeal All Code Sections
and Ordinances and Part af Code Sections and Ordinances in Conflict
Herewith; To Provide an Effective Date and for Other Purposes.
WHEREAS, on March 30, 2011, the Augusta Georgia Commission approved the
Administrator's reorganization plan as described in the Augusta, Georgia Proposed
Government Reorganization Draft Project Plan; and
WHEREAS, such Proposed Government Reorganization Draft Project Plan
requires the creation of an Augusta, Georgia Planning and Development
Department; and
WHEREAS, Augusta, Georgia desires to update and amend the Code as related to
the creation of the Augusta, Georgia Planning and Development Department to be
consistent with the Proposed Government Reorganization Draft Project Plan;
THE AUGUSTA, GEORGIA COMMISSION, ordains as follows:
SECTION 1. AuGUSTA, GA. CoDE Sections 8-1-5 through 8-1-9 as set forth in the
Augusta, Ga. Code, re-adopted July 10, 2007, are hereby amended by striking
these sections in their entirety as set forth in "Exhibit A" hereto and inserting in
lieu thereof new Code Sections 8-1-5 through 8-1-9, restated as set forth in
"Exhibit B" hereto.
SECTION 2. This ordinance shall become effective the first day of November,
201 L
SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby
repealed.

(a) The Augusta. Geor�ia Plannin� and Develo�ment De�artment is herebv established and
the Commission shall emplov the necessarv staff to administer and enforce the provisions
of this and related Chaoters
(b) The nerson in charge of the Au�usta Geor�ia Plannin��and Develooment De�artment
sllall be known as the Director of Plannin� and Develonment The Director shall enforce
the nrovisions of this and _related_Chanters. and he/she or his/her dulv authorized
renresentative shall perform anv dutv imbosed upon him/her bv this and related Cha�ters
(c) The Plannin� and Development Department shall have as its dutie� and res�onsibilities
the folIowin�:
(1) �'rebare and recommend to the Plannin�Commission a Master Plan or �arts thereof
for the develonment of Au�usta. Geor�a.
(2) Prenare and recommend to the Plannin� Commission a Comnrehensive Zonin�
Ordinance and ma o� r ma�s thereto•
(3) Prenare and recommend to the Plannin� Commission zonin� man(sl and S�ecial
Excentions:
(4) Prenare, bublish. and distribute mans. �lans. reborts, and recommendations relating to
the nlannin� and develo�ment of Au�usta Geor�ia�
(5) Recommend to the Augusta Georgia Commission pro�rams for �ublic improvements
and financin� thereof
(6) �n the performance of these functions enter unon land make examinations and
surve�place and maintain necessarv si��ns monuments or markin�s thereon•
(7) An other function or dutv dele�ated to the Plannin� and Development Department or
its Director unaer the nrovisions of this Code• and
($) Anv other function or dutv which may from time to time be dele�ated to the Plannin�
and Development Denartment or its Director
5ec. 5-1-6. Performance of d�ties — Master Plan.
(a) It shall be the dutv of the Planning and Develo�ment Denartment to nrenare and
recommend for ado�tion and amendment a Master Plan of Au�usta Geor�ia to the
Plannin� Commission.
(b) Such Master Plan mav show. amon� other thinas the followin�:
(1) Existing and pro�osed streets hi�hwavs ex�resswavs brid�es tunnels and viaducts
and apnroaches thereto• routes of railroads and transit lines: terminals, oorts and
a ll'pOT'CS.
(2) Parks �lav�rounds forests and other nublic onen soaces
(3) Sites for �ublic buildin�s structures and facilities.
(4) Land areas for residential business industrial recreational. a�ricultural, forestrv. and
special burnoses and uses.
(5) Limited develooment areas for purnoses of conservation, water sunplv, sanitation,
draina�e historic nreservation nrotection against floodine and similar environmental
considerations.
(6) Areas for housin� develonment slum clearance and urban renewal and
redevelobment.
(7) Location of bublic utilities whether publiclv or nrivatelv owned includin� but not
limited to sewera�e and water sunolv.
(8) Zonin� districts and other plannin� features.
(9) Time and�rioritv schedules and cost estimates for the accomplishment of the
pronosals.
(c) The Master Plan shall be based uoon and include annronriate studies of the location and .
extent of�resent and anticivated other �ertinent data.
(d) Such Plan mav be adobted added to and changed from time to time bv the_ Au�usta.
Geor�ia Commission It shall be a public record but its ournose and effect shall be
solel�to aid the Plannin� and Development Denartment and the Plannin� ('ommission in
the berformance of their duties.
Sec 5-1-7 Performance of duties — nin� ordinance and maps.
(a) It shall be the dutv of the Plannin� and Develoo Debartment to nrenare and
recommend for adobtion and amendment to the Plannin� Commission a zonin� ordinance
and mab or maos The purpose of such ordinance and map or mabs shall be to reQulate:
(1) The location hei�ht bulk number of stories and size of buildinas and other
structures.
(2) The nercenta�e of lot which mav be occuuied the sizes of vards courts. and other
ooen areas.
(3) The densitv and distribution of booulation and dwellin� units.

(4) Land areas for residential business industrial recreational. a�riculture, forestrv.
conservation historic breservation water sunnlv sanitation nrotection a�ainst floods.
governmental activitv and other snecial ourooses.
(b) The map or mabs shall divide Augusta Geor¢ia into districts of such number, shave and
size as the Plannina Commission mav determine• and within such districts the Plannin�
Commission mav re�ulate the erection construction reconstruction alteration and use of
buildin� and struc tures and uses of land All such re�ulations shall be uniform for each
class or kind of building throu¢hout each district but the re�ulations in one district. but
the re�ulations in one district mav differ from those in other districts.
(c) At such time the Auausta Geor�ia Commission deems it necessarv to enact an entirelv
new zoning ordinance and ma on r maps the governing bodies shall hold a nublic hearin�
thereon after at least fifteen (151 davs notice of the time and blace of which shall be
�ublished in a newsnaner of �eneral circulation in Au�usta. Geor�ia. All nrocedural
standards set forth in the Official Code of Geor�ia shall be comnlied with.
(1) No chan�e or de�arture from the text or maps as certified bv the Plannin�
Commission shall be made unless such chan e o�r de�arture is first submitted to the
Plann Commission for review and recommendation.
(2) The Plannine Commission shall have thirtv (301 davs within which to submit its
renort If the Plannin� ('ommission fails to submit a report within a thirtv-dav beriod.
it shall be deemed to have a�proved the chan�e or departure.
(d) The zonin� ardinance includin� the map or maps mav be amended from time to time:
but no amendment shall become effective unless it shall have been nroposed b or shall
have first been submitted to the Plannin� Commission for review and recommendation.
(1) The Plannine Commission shall conduct on behalf of the Au�usta Geor�ia
Commission all nublic hearin�s on nrobosed amendments to the zoning ordinance
and mans.
(2) Policies and procedures as specified bv the Official Code of Georeia shall be
followed bv the Plannin� Commission in considerin� such public hearin�s.
