HomeMy WebLinkAboutORD 7246 AMEND THE HEALTH SANITATION SECTION OF TITLE 4 SECTION 2 SOIL EROSION SEDIMENTATION AND POLLUTION CONTROL Ordinance No. 7246 AN ORDINANCE TO AMEND THE HEALTH AND SANITATION SECTION OF TITLE 4, SECTION 2, OF THE AUGUSTA, GEORGIA CODE TO MODIFY ARTICLE 7, WHICH PROVIDES FOR SOIL EROSION, SEDIMENTATION AND POLLUTION CONTROL, TO REPEAL ALL ORDINANCES IN CONFLICT HEREWITH, TO PROVIDE AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the Augusta, Georgia Code needs to be updated and revised; WHEREAS, it is the desire of the Commission to update and improve the Augusta, Georgia Code to provide for Soil Erosion, Sedimentation and Pollution Control for citizens of Augusta, GA; THE AUGUSTA COMMISSION hereby ordains as follows: SECTION 1. AuGUSTA, GA CoDE Section §4-2-7 adopted November 16, 2010, provides in Title 4, for Public Health, Section 2, Health and Sanitation, Articles 1-7. It is the desire of the Augusta-Richmond County Commission that that Article 7 as set forth in `B�ibit A" hereto be amended by striking "Exhibit A" its entirety and inserting in lieu thereof new `E�ibit B" hereto. SECTION 2. This ordinance shall become effective upon its adoption in accordance with applicable laws, in accordance with the AuGUS`rA, GA CoDE, attached hereto as `B�ibit A." SECTION 3. All ordinances or parts of ordinances in conflict herewith are hereby repealed, except that nothing in this Ordinance shall be construed to repeal or modify Title 4, Public Health, Section 2, Health and Sanitation, Articles 1— 6 in their entirety, contained in AuGUSTA, GA, CoDE §§4-2-1 through 4-2-6. The minimum reauirements of subsection (bl of O.C.G.A. & 12-7-6 and the buffer zones nrovided bv this nara�ranh shall be enforced bv the Local Issuin� Authoritv: 5. A�ricultural onerations as defined in O.C.G.A. &1-3-3. "definitions". to include raisin�. harvestin� or storin� of nroducts of the field or or chard: feedine. breedin� or mana�in� livestock or noultrv: nroducing or storin� feed for use in the nroduction of livestock. includine but not limited to cattle. calves. swine. ho�s. �oats. sheen. and rabbits 35 or for use in the nroduction of noultrv. including but not limited to chickens. hens and turkevs: �roducin� nlants. trees. fowl. or animals: the nroduction of aaua culture. horticultural. dairv, livestock. noultrv. eggs and aniarian nroducts: farm buildin�s and farm nonds: 6. Forestrv land mana�ement nractices. including harvestin�: nrovided. however. that when such exemnt forestrv nractices cause or result in land-disturbin� or other activities otherwise nrohibited in a buffer. as established in Section IV.E. of this ordinance. no other land-disturbin� activities, excent for normal forest management nractices. shall be allowed on the entire nronertv unon which the forestrv �ractices were conducted for a neriod of three (31 vears after comnletion of such forestrv nractices; 7. Anv nroiect carried out under the technical sunervision of the Natural Resources Conservation Service (NRCSI of the United States Deaartment of A�riculture• 8. Anv nroiect involvine less than one (11 acre of disturbed area: brovided. however. hat this exemntion shall not apnlv to anv land-disturbin� activitv within a lar�er common nlan of develonment or sale with a nlanned disturbance of eaual to or �reater than one (11 acre or within 200 feet of the bank of anv state waters. and for nurnoses of this nara�ranh. "State Waters" excludes channels and draina�e wavs which have water in them onlv durin� and immediatelv after rainfall events and intermittent streams which do not have water in them vear-round: nrovided. however. that anv nerson resnonsible for a nroiect which involves less than one (11 acre. which involves land-disturbin� activitv. and which is within 200 feet of anv such excluded channel or draina�e wav. must nrevent sediment from movin� bevond the boundaries of the �ro�ertv on which such �roiect is located and �rovided, further. that nothin� contained herein shall nrevent the Local Issuin� Authoritv from re�ulatin� anv such nroiect which is not snecificallv exemnted bv narasrabhs 1. 2 3. 4. 5. 6. 7. 9 or 10 of this section: 9. Construction or maintenance nroiects. or both. undertaken or financed in whole or in art. or both. bv the Denartment of Transnortation. the Geor�ia Hi�hwav Authoritv. or the State Road and Tollwav Authoritv: or anv road construction ar maintenance nroiect. or both undertaken bv anv countv or municinalitv: nrovided. however, that construction or maintenance nroiects of the Denartment of Transnortation or the State Road and Tollwa Authoritv which disturb one or more contieuous acres of land shall be subiect to r isions of O.C.G.A. & 12-7-7.1: excent where the Denartment of Transnortation. the Geor�ia Hi�hwav Authoritv, or the State Road and Tollwav Authoritv is a secondarv nermittee for a nroiect located within a lar�er common nlan of develonment or sale under the state eneral nermit. in which case a conv of a notice of intent under the state �eneral nermit_shall be submitted to the Local Issuing Authoritv. the Local Issuing Authoritv shall enforce comnliance with the minimum reauirements set forth in O.C.G.A. & 12-7-6 as if a nermit had been issued. and violations shall be subiect to the same nenalties as violations bv nermit holders. 10. Anv land-disturbin� activities conducted bv anv electric membershin cornoration or municinal electrical svstem or anv nublic utilitv under the regulatorv iurisdiction of the 36 Public Service Commission. anv utilitv under the regulatorv iurisdiction of the Federal Ener�v Regulatorv Commission. anv cable television svstem as defined in O.C.G.A. &36- 18-1. or anv agencv ar instrumentalitv of the United States en�ased in the �eneration. transmission. or distribution of nower: except where an electric membershin cornoration or munici�al electrical svstem or anv nublic utilitv under the re�ulatorv iurisdiction of the Public Service Commission. anv utilitv under the regulatorv iurisdiction of the Federal Ener�v Regulatorv Commission, anv cable television svstem as defined in O.C.G.A. &36- 18-1. or anv agencv or instrumentalitv of the United states engaged in the generation. transmission. or distribution of nower is a secondarv nermittee for a nroiect located within a lar�er common nlan of develonment or sale under the state �eneral nermit. in which case the Local Issuin� Authoritv shall enforce comnliance with the minimum r auirements set forth in O.C.G.A. 12-7-6 as if a nermit had been issued. and violations shall be subiect to the same nenalties as violations bv nermit holders, and 11. Anv nublic water svstem reservoir: 1 The followin� � roiects are exemnt from the nermit reauirements of section V of this article bv O.C.G.A. &12-4-17. however. anv land disturbin� activities conducted as nart of anv such nroiect shall submit individual lot draina�e nlan includin� pronosed changes in lot �rade to the Au�usta Eneineerin� Denartment nrior to gettin� a building nermit and conform to the minimum reauirements as set forth in section IV of this article. including. but not limited to. the imnlementation of BMPs. 11 The construction of a sin�le-familv residence or commercial lot or institutional lot. when such construction disturbs less than one acre and is not a nart of a larger common nlan of develonment or sale with a blanned disturbance of eaual to or �reater than one acre and not otherwise exemnted under this section. SECTION IV MINIMUM REOUIREMENTS FOR EROSION. SEDIMENTATION AND POLLUTION CONTROL USING BEST MANAGEMENT PRACTICES A. GENERAL PROVISIONS: Excessive soil erosion and resultine sedimentation can take nlace durine land-disturbin� activities if reauirements of the ordinance and the NPDES General Permit are not met. Therefore. nlans for those land-disturbin� activities which are not exembted bv this ordinance shall contain nrovisions for annlication of soil erosion, sedimentation and ollution control measures and nractices. The nrovisions shall be incornorated into the erosion, sedimentation and nollution control nlans. Soil erosion. sedimentation and nollution control measures and nractices shall conform to the minimum reauirements of Section IV.B. D. & E. of this ordinance. The annlication of ineasures and nractices shall annlv to all features of the site. includin� street and utilitv installations. draina�e facilities and other temnorarv and nermanent imnrovements. Mea�ure shall be installed to 37 prevent or control erosion. sedimentation and nollution durin� all sta�es of anv land- disturbin� activitv in accordance with reauirements of this ordinance and the NPDES General Permit B. MINIMUM REOUIREMENTS/ BMPs/MONITORING REOUIREMENTS: 1. Best mana�ement nractices as set forth in Section IV.B. D. & E. of this ordinanc shall be reauired for all land-disturbin� activities. Proner design. installation, and maintenance of best mana ement nractices shall constitute a comnlete defense to anv ction bv the Director or to anv other alle�ation of noncomnliance with nara�rabh (21 of this subsection or anv substantiallv similar terms contained in a bermit for the discharge of storm water issued ursuant to subsection (fl of O.C.G.A. & 12-5-30. the "Geor�i Water Oualitv Control Act". As used in this subsection the terms "nroner design" and "nro�erlv desi�ned" mean designed in accordance with the hvdraulic design snecifications contained in the "Manual for Erosion and Sediment Control in Geor�ia" snecified in O.C.G.A. & 12-7-6 subsection (bL 2. A discharge of storm water runoff from disturbed areas where best mana�ement ractices have not been nronerlv desi�ned. installed. and maintained shall constitute a senarate violation of anv land-disturbin� nermit issued bv a local Issuin� Authoritv or of anv state �eneral nermit issued bv the Division nursuant to subsection (fl of O.C.G.A. 12-5-30. the "Geor�ia Water Oualitv Control Act". for each dav on which such discharge results in the turbiditv of receiving waters bein� increased bv more than twentv-five (251 nenhelometric turbiditv units far waters su��ortin� warm water fisheries or bv more than ten (101 nenhelometric turbiditv units for waters classified as trout waters. The turbiditv of the receivin� waters shall be measured in accordance with suidelines to be issued bv the Director. This naragranh shall not annlv to anv land disturbance associated with the construction of sin�le familv homes which are not nart of a lar�er common nlan of develonment or sale unless the nlanned disturbance for such construction is e ual to or �reater than five (51 acres. C. VIOLATIONS: 1. Failure to nronerlv desi�n. install. or maintain best management nractices shall constitute a violation of anv land-disturbin� nermit issued bv a Local Issuing Authoritv or of anv state �eneral nermit issued bv the Division nursuant to subsection (fl of Code Se tion 12-5-30. the "Geor�ia Water Oualitv Control Act". for each dav on which such failure occurs. 2. The Directar mav reauire. in accordance with re�ulations adonted bv the Board. reasonable and nrudent monitorin� of the turbiditv level of receivin� waters into which discharees from land disturbin� activities occur. 3. Failure to erform turbiditv monitorin� or to submit monitorin� results as reauired under the state �eneral permit(sl annlicable to the nroiect shall be a violation of this article far each dav on which such failure occurs ar continues 38 4. If anv nerson commences anv land-disturbing activitv reauirin� a land disturbin� ermit as described in this article without first obtainin� said nermit. the nerson shall be in violation of this Article far each dav on which such land disturbing activitv occurs. 5. onductin� land-disturbin� activitv in anv manner nrohibited bv or inconsisten with the reauirements of this article shall constitute a senarate violation of this article for each dav on which such �rohibited or inconsistent activitv occurs or continues. D. REOUIREMENTS: The rules and re�ulations. ordinances. or resolutions adonted nursuant to this chanter and .C.G.A. &12-7-1 et. sea. for the nurnose of �overnin� land-disturbin� activities shall re uir , as a minimum. nrotections at least as strin�ent as the state �eneral nermit: and best manaeement nractices. includin� sound conservation and en�ineerin� nractices to �revent and minimize erosion and resultant sedimentation. which are consistent with. and no less strin�ent than. those nractices contained in the Manual for Erosion and Sediment Control in Georgia nublished bv the Geor�ia Soil and Water Conservation Commission as of Januarv 1 of the vear in which the land-disturbin� activitv was nermitted. as well as the followine: 1. Stri ning of ve�etation. re�radin� and other develonment activities shall be conducted in a manner so as to minimize erosion• 2. Cut-fill onerations must be kent to a minimum• 3. Dev lonment nlans must conform to tonogranhv and soil tvne so as to create the lowest nracticable erosion notential: 4. Whenever feasible. natural ve�etation shall be retained. nrotected and sunplemented: 5. The disturbed area and the duration of exnosure to erosive elements shall be kent to a nracticable minimum• 6. Disturbed soil shall be stabilized as auicklv as nracticable: 7. Tem orarv ve�etation or mulchin� shall be emnloved to nrotect exnosed critical areas durine develonment: 8. Permanent veeetation and structural erosion control nractices shall be installed as oon as nracticable: 9. To the extent necessarv sediment in run-off water mu t be tranned bv the use of debris basins. sediment basins. silt trans. or similar measures until the disturbed area is stabilized. As used in this nara�ranh, a disturbed area is stabilized when it is brou�ht to a condition of continuous comnliance with the reauirement of O A&12-7-1 et sea • 39 10. Adeauate nrovisions must be nrovided to minimize dama�e from surface water to the cut face of excavations or the sloning of fills: 11. uts and fills mav not endan�er adioinin� nronertv: 12. Fills mav not encroach u�on natural watercourses or constructed channels in a manner so as to adverselv affect other nronertv owners: 13. radin� e uinment must cross flowin� streams bv means of brid�es or culverts excent when such methods are not feasible. nrovided. in anv case. that such crossings are ke�t to a minimum: 14. Land-disturbin� activitv nlans for erosion. sedimentation and nollution control shall include nrovisions for treatment or control of anv source of sediments and adeauate sedimentation control facilities to retain sediments on-site or nreclude sedimentation of iacent waters bevond the levels snecified in Section IV B. 2. of this ordinance E. BUFFERS: 1. Excent as nrovided in O.C.G.A &12-7-6(bl(161 for trout streams. there is e tablished a 25 foot buffer alon� the banks of all state waters. as measured horizontallv from the noint where ve�etation has been wrested bv normal stream flow or wave action. excent il where the Director determines to allow a variance that is at least as nrotective of natural resources and the environment. iil where otherwise allowed bv the Director nursuant to O.C.G.A. & 12-2-8. iiil where a draina�e structure or a roadwav drainaee structure must be constructed. nrovided that adeauate erosion control measures are incornorated in the nroiect nlans and snecifications. and are imnlemented: or ivl alone anv enhemeral stream. As used in this nrovision. the term 'enhemeral stream' means a stream: that under normal circumstances has water flowin� onlv during and for a short uration after nrecinitation events: that has the channel located above the �round-water table vear round: for which �round water is not a source of water: and far which runoff from nreci�itation is the nrimarv source of water flow. Unless exemnted as along an e hemeral stream. the buffers of at least 25 feet established bursuant to nart 6 of Article 5 Chanter 5 of Title 12. the "Georgia Water Oualitv Control Act". shall remain in force nless a variance is �ranted bv the Director as nrovided in this nara�ranh. There is established a 50 foot buffer as measured horizontallv from the noint where ve�etation has been wrested bv normal stream flow or wave action. along the banks of anv state waters classified as "trout streams" nursuant to Article 2 of Chanter 5 f Title 12. the "Geor�ia Water Oualitv Control Act". excent where a roadwav drainage structure must be constructed : nrovided. however. that small snrings and streams classified as trout streams which discharge an average annual flow of 25 �allons ner minute or less shall have a 25 foot buffer or thev mav be nibed. at the discretion of the landowner. �ursuant to the terms of a rule nroviding for a�eneral variance nromul�ated bv the Board. so lon� as anv such nine stons short of the downstream landowner's ronertv and the landowner comnlies with the buffer reauirement for anv adiacent trout reams. The Director mav �rant a variance from such buffer to allow land-disturbing activitv. nrovided that adeauate erosion control measures are incornorated in the nroiect plans and s�ecifications and are i�lemented The following requirements shall annlv to such buffer: al No land-disturbing activities shall be conducted within a buffer and a buffer shall remain in its natural. undisturbed. state of ve�etation until all land-disturbing activities on the construction site are comnleted. LOCAL ISSUING AUTHORITY: Nothin� contained in O.C.G.A. 12-7-1 et. sea. shall nrevent anv Local I ssuin� Authoritv from adontin� rules and re�ulations. ordinances. or resolutions which contain stream buffer reauirements that exceed the minimum reauirements in Section N.B. D. & E. of this ordinance. G. LAND-DISTURBING ACTIVITY: The fact that land-disturbin� activitv for which a nermit has been issued results in iniurv to the nronertv of another shall neither constitute nroof of nor create a nresumntion f a violation of the standards nrovided for in this ordinance or the terms of the nermi . SECTION V APPL.ICATION/PERMIT PROCESS A. �ENERAL: The nronertv owner. develoner and designated nlanners and engineers shall desi�n and review before submittal the �eneral develonment nlans. The Local Issuin� Authoritv shall review the tract to be develoned and the area surrounding it. Thev shall consult the zonin� ordinance. storm water management ordinance. subdivision ordinance. flood dama�e nrevention ordinance. this ardinance. and anv other ordinances. rules. re�ulations or nermits. which regulate the develonment of land within the iurisdictional boundaries of he Local Issuin� Authoritv. However. the owner or onerator with owner written consent is the onlv nartv who mav obtain a nermit. B. APPLICATION REOUIREMENTS: 1. No nerson shall conduct anv land-disturbin� activitv within the iurisdictional oundaries of Au�usta Geor�ia without first obtainine a Land Develonment Permit LDAI from the Local Issuin� Authoritv to nerform such activitv and nrovidin� a cobv of Notice of Intent submitted to EPD if annlicable. This also annlies to mass erading activities at individual lots within a common develonment such as subdivision and a builder shall obtain a Land Disturbin� Permit as well as a buildin� nermit to commence construction. 2. The abnlication for a nermit shall be submitted to the Local Issuin� Authoritv and must include the annlicant's erosion. sedimentation and nollution control nlan with a comnleted checklist and sunnorting data. as necessarv. Said nlans shall include. as a minimum. the data s�ecified in Section V.C. of this ordinance. Erosion. sedimentation and nollution control nlans. tosether with sunnortin� data. must demonstrate affirmativelv that the land disturbin� activitv nronosed will be carried out in such a manner that the nrovisions of Section IV.B. D. & E. of this ordinance will be met. Annlications for a nermit will not be accented unless accomnanied bv six (61 conies of he an�licant's erosion. sedimentation and nollution control nlans. All annlications shall 42 contain a certification statin� that the nlan nrenarer or the desi�nee thereof visited the site rior to creation of the nlan in accordance with EPD Rule 391-3-7-.10. 3. An administrative fee. in the amount of $5.00 ner disturbed acre (or nortion ther shall be char�ed bv the Local Issuin� Authoritv for each nroiect reauirin� a ermit under this article. The administrative fee shall be naid at the time the nlan is submitted to the Local Issuin� Authoritv. In addition to the local nermittin� fees. fees will also be assessed nursuant to nara�ranh (51 subsection (al of O.C.G.A. � 12-5-23. nrovided that such fees shall not exceed $80.00 ner acre of land-disturbin� activitv. and these fees h ll be calculated and naid bv the nrimarv nermittee as defined in the state �eneral ermit for each acre of land-disturbin� activitv included in the nlanned develonment or ach nhase of develonment. All annlicable fees shall be naid nrior to issuance of the land disturbance nermit. In a iurisdiction that is certified nursuant to subsection (al of O.C.G.A. & 12-7-8 half of such fees levied shall be submitted to the Division: excent that an and all fees due from an entitv which is reauired to �ive notice nursuant to nara�ranh 91 or 1101 of O.C.G.A. &12-7-17 shall be submitted in full to the Division. re�ardless of he existence of a Local Issuin� Autharitv i the iurisdiction 4. Immediatelv unon receint of an a�lication and �lan for a nermit the Local Issuin� Authoritv shall refer the annlication and nlan to the District for its review and annroval or disannroval concerning the adeauacv of the erosion. sedimentation and nollution control nlan. The District shall annrove or disannrove a nlan within 35 davs of receint. Failure of the District to act within 35 davs shall be considered an annroval of _ __ _ __ the endin� nlan. The results of the District review shall be forwarded to the Local I suin� Autharitv. No nermit will be issued unless the nlan has been annroved bv the District and anv variances reauired bv Section IV.E. has been obtained. all fees have been aid. and bondin�. if reauired as ner Section V B.6.. have been obtained. Such review will not be reauired if the Countv and the District have entered into an a�reement which allows the Countv to conduct such review and annroval of the nlan without referrin� the annlication and nlan to the District. The Local Issuin� Authoritv with nlan review authoritv shall annrove or disannrove a revised Plan �ubmittal within 35 davs of recei t. Failure of the Local Issuin� Authoritv with nlan review authoritv to act within 35 davs shall be considered an annroval of the revised Plan submittal. 5. Denial of Permit: If a nermit annlicant has had two or more violations of nrevious bermits. this ordinance section. or the Georeia Erosion and edimentation Act. as amended. within three vears nrior to the date of filin� the anblication under consideration. the Local Issuin� Authoritv mav denv the nermit annlication. 6. Bond Reauirement: The Local Issuin� Authoritv mav reauire the nermit annlicant to nost a bond in the form of government securitv cash irrevocable letter of credit or anv combination thereof un to. but not exceedin�. 3.000.00 ner acre or fraction thereof of the nronosed land-disturbin� activitv. nrior to issuin� the �ermit. If the annlicant does not comnlv with this section ar with the conditions of the nermit after issuance. the Local Issuin� Authoritv mav call the bond or anv nart thereof to be forfeited nd mav use the nroceeds to hire a contractor to stabilize the ite of the land-di turbin� 43 activitv and brin� it into comnliance. These nrovisions shall not annlv unless there is in effect an ardinance or statute s ecificallv nrovidin� for hearing and iudicial review of anv determination or order of the Local Issuins Authoritv with resnect to alleged nermit violations. C. PLAN REOUIREMENTS: l. Plans must be nrenared to meet the minimum reauirements as contained in Section IV.B. D. & E. of this ordinance. or throueh the use of more stringent. alternate esi�n criteria which conform to sound conservation and en�ineerin� nractices. The Manual for Erosion and Sediment Control in Georgia is herebv incornorated bv reference into this ordinance. The nlan for the land-disturbine activitv shall consider the interrelationshin of the soil tvpes, seolo�icat and hvdrolo�ical characteristics, tonograbhv. watershed. vegetation. nroposed nermanent structures including roadwavs. onstructed waterwavs. sediment control and storm water manaeement facilities. local ordinances and State laws. Mans. drawings and sunnortive combutations shall bear the si�nature and seal of the certified desi�n nrofessional. Persons involved in land develonment desi�n. review. nermitting. construction. monitoring, or insnections or anv land disturbin� activitv shall meet the education and training certification reauirements. denendent on his or her level of involvement with the nrocess. as develoned bv the Commission and in consultation with the Division and the Stakeholder Advisorv Board reated nursuant to O.C.G.A. & 12-7-20. 2. Data Reauired for Site Plan shall include all the information reauired from the a nronriate Erosion. Sedimentation and Pollution Control Plan Review Checklist established bv the Commission as of Januarv 1 of the vear in which the land-disturbin� activitv was nermitted. These check lists are included in this Ordinance bv reference. A filled conv of abnlicable checklist shall be submitted with the nlan. 3. Mans. drawin�s. and sunnortive comautations shall bear the sisnature/seal of certified desi�n nrofessional. 4. Maintenance of all soil erosion and sedimentation control nractices. whether tem orarv or nermanent. shall be at all times the resnonsibilities of the nronertv owner. 5. Plot lans for sin�le familv homes on individual lots shall illustrate the best mana�ement nractice the contractor will imnlement durin� construction to nrevent soil erosion and dama�e to adioinin� nroperties as result if erosion; the nlot nlan shall illustrate th method for controlline onsite draina�e and nermanentiv stabilizin� the disturbed soil unon comnletion of construction. Onsite draina�e shall be awav from the foundations throu�h and towards a define draina�e svstem. Direction of onsite flow to be indicated bv arrows. Plot nlans also include contractor name. street name and nronertv address. lot dimensions drawn to scale all easements. existin� drainaee features structures footnrints. buildin� setback dimensions. Th Aueusta Engineerin� Denartment. as an extension of the Local Issuin� Authoritv. will neriodicallv insnect the sites of land-disturbin� activities for which nermits have en issued to determine if the activities are beine conducted in accordance with the nlan and if the measures reauired in the nlan are effective in controlling erosion and sedimentation. Also. the Local Issuine Authoritv shall resulate nrimarv. secondarv and te i rv �ermittees as such terms are defined in the state �eneral nermit. Primarv nermittees shall be resnonsible for installation and maintenance of best mana�ement nractices wh�re the nrimarv nermittee is conductin� land-disturbin� activities. Secondarv ermittees shall be resnonsible for installation and maintenance of best mana�ement practices where the secondarv nermittee is conducting land-disturbing activities. Tertiarv �ermittees shall be resnonsible for installation and maintenance where the tertiarv ermitt e is conductin� land-disturbin� activities. If. throueh insnection. it is deemed th a nerson en�a�ed in land-disturbin� activities as defined herein has failed to comnlv with the annroved nlan. with nermit conditions. or with the nrovisions of this ordinance. a written notice to comnlv shall be served unon that nerson. The notice shall set forth the m asures necessarv to achieve comnliance and shall state the time within which such measures must be comnleted. If the nerson en�a�ed in the land-disturbing activitv fails to comnlv within the time snecified. he shall be deemed in violation of this ordinance. 1. Residential Construction of Individual Lots: The License and Inspection Denartment will insnect for comnliance with this Ordinance for residential construction on in ividual lots. If a nroiect is deemed not in comnliance with the a��roved nlot nlan. the contractor and builder will be issued a written notice to comnlv with the annroved nlan. If the contractor/builder en�aged in the land disturbins activitv fails to comnlv within the time snecified. he shall be deemed in violation of this chanter. B. The Local Issuing Authoritv must amend its ordinances to the extent annronriate within twelve 121 months of anv amendments to the Erosion and Sedimentation Act of 1975. C. The Local Issuine Authoritv and Augusta En�ineerin� Denartment. as an extension of the LIA. shall have the nower to conduct such investigations as it mav reasonablv deem necessarv to carrv out duties as nrescribed in this ordinance. and for this nurnose to enter at reasonable times unon anv nronertv. nublic or nrivate. for the nurnose of investigation and insnectin� the sites of land-disturbine activities. D. No erson shall refuse entrv ar access to anv authorized renresentative or agent of the L�cal Issuin� Authoritv an Au�usta En�ineerin� Denartment. as an extension of the 46 LIA. the Commission. the District. or Division who reauests entrv for the nurnoses of ins ection. and who nresents annronriate credentials, nor shall anv nerson obstruct. ham er or interfere with anv such renresentative while in the nrocess of carrving out his official duties. E. The District ar the Commission or both shall semi-annuallv review the actions of counties and municinalities which have been certified as Local Issuin� Authorities �uxsuant to O.C.G.A. & 12-7-8 (al. The District or the Commission or both mav nrovide technical assistance to anv countv or municinalitv for the burnose of imnrovin� the effectiveness of the countv's or municinalitv's erosion. sedimentation and �ollution control rogram. The District or the Commission shall notifv the Division and reauest 'nvestieation bv the Division if anv deficient or ineffective local nro�ram is found. F. The Division mav neriodicallv review the actions of counties and municinalities which have been certified as Local Issuin� Authorities nursuant to & 12-7-8 (al. Such review mav include. but shall not be limited to. review of the administration and enforcement of overnin� authoritv's ordinance and review of conformance with an a�reement. if anv. between the district and the �overnin� authoritv. If such review indicates that the �overnin� authoritv of anv countv or munici�alitvi certified nursuant to O.C.G.A. & 12-7-8 has not administered or enforced its ordinances or has not conducted the nro�ram in accordance with anv agreement entered into nursuant to O.C.G.A. & 12-7-7 (el. the Division shall notifv the governin� authoritv of the countv or municinalitv in writin�. The overnin� authoritv of anv countv or municinalitv so notified shall have 90 davs within which to take the necessarv corrective action to retain certification as a Local Iss in Authoritv. If the countv or municinalitv does not take necessarv corrective action within 90 da s after notification bv the division. the division shall revoke the certification of the countv or municinalitv as a Local Issuin� Authoritv. SECTION VII PENAL.TI.S IN .NTI . A. REVOCATION OF AUTHORIZATIONS TO CONDUCT BUSINESS: If anv nerson commences anv land-disturbin� activitv reauirin� a land-disturbin� nermit as rescribed in this ordinance without first obtainine said nermit the nerson shall be subiect to revocation of his busine license work nermit or other authorization for the conduct of a business and associated work activities within the iurisdictional boundaries of the Local Issuin� Authoritv. B. STOP-WORK ORDERS: 1. For the first and second violations of the nrovisions of this ordinance the Director r he Local Issuin� Authoritv hall issue a written warnin� to the violator. A notice mav be in an written form. includin� without limitation. a memo. letter. directive or citation to a bear in Ma�istrate Court. The violator shall have five davs to correct the violation. If he violation is not corrected within five davs the Director or the Local I uin� 47 __ . When a violation in the form of takin� action without a nermit. failure to maintain a stream buffer. or si�nificant amounts of sediment. as determined bv the Local Issuing Authoritv or bv the Director or his or her Desi�nee. have been or are being dischar�ed into state waters and where best mana�ement nractices have not been nronerlv designed. installed. and maintained. a ston work order shall be issued bv the the Local Issuing Authoritv or bv the Director or his or her Desi�nee without issuin� nrior written notices. All such ston work orders shall be effective immediatelv unon issuance and shall be in effect until the necessarv corrective action or miti�ation has occurred. Such ston work orders shall annlv to all land-disturbing activitv on the site with the excention of the installation and maintenance of temnorarv or nermanent erosion and sediment controls. C. BOND FORFEITURE: If the Local Issuine Authoritv determines that a nerson en�a�ed in land-disturbing activities at a nroiect where a Bond was reauired nursuant to Section V has failed to complv with the annroved nlan. the nartv resnonsible for the securin� the bond shall be deemed in violation of this Ordinance and a written warnin� notice to comnlv shall be served unon that �erson. The warning notice shall set forth the measures necessarv to chieve comnliance with the nlan and shall state the time within which such measures must be comnleted. If the nerson en�a�ed in the land-disturbin� activitv fails to comnlv within the time snecified. in addition to other nenalities annlicable under this Ordinance. he shall be deemed to have forfeited his nerformance bond. The Local Issuing Autharitv mav call the bond or anv nart thereof to be forfeited and use the nroceeds to hire a �ontractor to stabilize the site of the land-disturbin,�activitv and brin� it into comnliance. D. MONETARY PENALTIES: 1. Anv �erson who violates anv nrovisions of this ordinance, or anv nermit condition or limitation established nursuant to this ordinance. or who ne�li�entiv or intentionallv 48 fails or refuses to comnlv with anv final or emergencv order of the Director issued as rovided in this ordinance shall be liable for a civil nenaltv not to exceed $2.500.00 ner dav. For the nuroose of enforcin� the nrovisions of this ordinance. the Ma�istrate Court of Richmond Countv is authorized under &O.C.G.A. 12-7-15 to imnose nenaltv not to xceed $2.500.00 for each violation. Each dav durine which violation or failure or refusal to comnlv continues shall be a senarate violation. 2. Under nrovision of this section. anv nerson who continue to violate this Ordinance or knowinglv and intentionallv becomin� a habitual violator on the same or different site. will be liable for a civil nenaltv not to exceed 2.500.00 ner dav. 3. Persons involved in land develonment desien. review. nermitting. construction. m nitorin�. or insnection or anv land-dist activitv shall meet the education and trainin� certification reauirements. denendent on their level of involvement with the nrocess. as develoned bv the commission in consultation with the division and the stakeholder advisorv board created nursuant to O.C.G.A. & 12-7-20. B. F r each site on which land-disturbin� activitv occur each entitv or ner on actin� as either a nrimarv. secondarv. or tertiarv nermittee. as defined in the state general nermit. __ shall have as a minimum one nerson who is in resnonsible char�e of erosion and sedimentation control activities on behalf of said entitv or �erson and meets the annlicable education ar trainine certification reauirements develoned bv the Commission nresent on site whenever land-disturbin� activities are conducted on that site. If a state �eneral nermittee who has onerational control of land-disturbin� activities for a site has met the certification reauirements of nara�ranh (1) of subsection (bl of O C G A &12-7-19. then anv nerson or entitv involved in land-di turbin� activitv at that site and onerating in a subcontractor canacitv for such nermittee shall meet those educational re uirements snecified in nara�ranh (41 of sub ection (bl of O.C.G.A &12-7-19 and hall n t be reauired to meet anv educational reauirements that exceed those snecified in said ara�ranh. 49 �ECTION IX ADMINISTRATI .
