REQUEST for RELEASE of FUNDS On or after April 15 2011 the AHCDD will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) under Title I of the Housing and Community Development Act of 1974, Community Development Block Grant- Recovery (CDBG-R) under the American Recovery and Reinvestment Act of 2009, HOME Investment Partnership (HOME) under Title II of the Cranston-Gonzalez Nationa) Affordable Housing Act (42 U.S.C. 12701 et seq.), Neighborhood Stabilization Program 1(NSP1) under Division B Title III of the Housing and Economic Recovery Act (HERA) of 2008, and Neighborhood Stabilization Program 3(NSP3j under Section 2301(b) of the Housing and Economic Recovery Act of 2008 (Pub. L.110-289, approved July 30, 2008) (HERA) as amended, to undertake the follow projects: Proiect Title: Housing Tiered Environmental Review- CDBG, CDBG-R, HOME, NSP1 & NSP3 Purpose• The projects involve demolition (less than four (4) units), clearance of fire-damaged and/or dilapidated residential structures, acquisition, rehabilitation, minor repair, new construction, disposition, and the installation of sewer connections as needed. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Augusta Housing and Community Development Department, 925 Laney Walker Blvd., 2nd Floor, Augusta, GA 30901, (706)-821-1797 and may be examined or copied weekdays 7 A.M. to 6 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the Tiered ERR to the AHCDD. All comments received by April 15, 2011 will be considered by the AHCDD prior to authorizing submission of a request for release of funds. � RELEASE OF FUNDS The AHCDD certifies to HUD that David S. Copenhaver in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorizes and allows the CHDO/LP/LLC to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the AHCDD's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer of - the AHCDD; (b) the AHCDD has omitted a step orfailed to make a decision or committed funds or incurred costs not authorized by 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds or incurred costs not authorize by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CRF) Part 58, Sec. 58.76) and shall be addressed to HUD at 40 Marietta Street, Atlanta, GA 30303.
